HomeMy WebLinkAbout08-05-2002 Planning Commission MinutesThe Planning & Zoning Commission of the City of Fairhope met Monday, August 5, 2002 at 5:OOPM at the City Administration Building, 161 N. Section St. Present: Larry Green, Chairman; Tim Kant, Dan McCrory, Cecil Christenberry, Bob Clark, Dick Charles, Lee Turner, Ed Brinson, Jean Wilson. Christopher Baker, Director of Planning & Zoning, Betty Rivenbark, Secretary. No one was absent. The minutes of the July 1, 2002 meeting and July 111 special meeting were considered and approved with two corrections noted on motion by Dick Charles, 2"d by Bob Clark and unanimously carried. SD02.33 Final Plat approval of Quail Creek Villas, Phase 4(Generally located east of Cty Rd 27 to the south of the clubhouse) Mr. Baker related that the development met the comprehensive plan, the needed certifications had been supplied, the final inspection made. He said sidewalks were a point of discussion previously. His recommendation was to approve as requested. Commissioner Wilson asked about the sidewalks and Ack Moore answered saying he understood that a meeting had been held with the Mayor and the outcome was they were grandfathered in, to continue putting the sidewalks in as they had before - 2 ft. behind the curb. They would be built as they build houses. Dick Charles noted they were shown on the plat. Lee Turner moved to give final plat approval, Ed Brinson 2"d the motion and it carried unanimously. SD02.34 Preliminary Plat approval of Colony Place Phase 3, application of Fairhope Single Tax Corporation(Generally located south of Twin Beech Rd and east of Greeno Rd adjacent to Founder's Park) Mr. Baker related that this meets the comprehensive plan, the planned corner lots are 10' wider than interior lots, that there is a small portion of wetlands that they are proposing to fill, the needed drainage certifications have been provided, and that they are proposing double fronted lots with a 10' buffer strip adjacent to Manley Road. Access will be off of Manley Road which is a dirt road. Christopher in recommending approval, related a meeting he had with the county, Southland Place Developers and Colony Place developers saying it was very productive and the county had provided a letter saying they would pave Manley Road within 90 days. He talked about the row of oak trees that they are trying to save with the improvements to Manley Rd. Discussion followed on paving and fences with a suggestion being made to have restrictions on the fences regarding types, and height. A motion was made by Lee Turner to accept, Ed Brinson 2"d the motion and then it was amended to include that Manley Road had to be paved before final approval given, including restrictive covenants regarding the fences on lots 66-76 on Manley Road, and including the proposal on sidewalks of 4' in Phase 3 with construction of 4' sidewalks in Phase 1. Motion carried unanimously. SD02.35 Final Plat Approval of Southland Place Phase 2(Generally located south of Manley Road and east of Greeno Rd) application of Southland Place LLC.. Christopher said the development meets the comprehensive plan, the improvements have been constructed, drainage has been certified, sidewalks will be constructed as approved by Planning & Zoning Commission August 5, 2002 - Page two the PUD, there will be an access point to Manley Rd. and wetlands mitigation will be provided to us before the plat signed. He said all issues had been addressed,corrected Jean Wilson moved to approve, Dick Charles 2"d motion carried unanimously. SD.02.36 Replat of Chupek Subdivision(Generaliy located west of Greeno Rd south of Middle and north of Twin Beech Rd) Mr. Baker said this is a division of 1 lot into 3. Mr. Chupek owns the property where Fairhope Paint and Body is located and contains some 2.38 acres. The issues being: the plat is consistent with the comprehensive plan, a drainage waiver is being requested due to no plans having been developed for lots 2 and 3. Lots 2 and 3 will have access to Greeno Rd via a common access easement. Sidewalks are not required and we have communicated to the developer that it would be a great demonstrative action to provide a donation to the sidewalk fund- and we requested they use signs that meet the spirit of our sign ordinance. He recommended approval. A motion was made by Dick Charles to approve, Cecil Christenberry 2"d the motion and it carried unanimously. S13.02.41 Consideration of the New Subdivision Regulations Mr. Green commented that the public hearing was held at the 7/11102 meeting, opened and closed and comments taken, the commission had concerns for specific purpose of clarifying issues and tabled passage until this meeting. Mayor Kant presented to the commission a petition from developers asking for a 30 day delay before passage to hold meetings with them for further clarification. Mr. Green responded that he, and he felt any member of the commission, would be available to talk at any time. That the comprehensive plan had been worked on for 18 months, numerous public hearings were held and public input sought. These regulations were part of 3 part plan to fine tune - revise zoning regulations, some city ordinances and subdivisions regulations. That the subdivision regulations are a clarification, actually easier to understand the language. Christopher Baker addressed each concern that was talked about at the special meeting. He passed out papers and related that he had our lawyers look at proposed subdivision changes and they suggested attached changes. Lee Turner gave a report on the Errors & Omission requirement and said all policies/ premiums have come down considerably. Mr. Green said he would take comments and Hop Allen, Dan Blackburn, Kevin Boone spoke. Further discussion led to a motion by Cecil Christenberry to table until September 3 meeting in order to hold 2-3 informal discussions. Dick Charles 2"d. A vote was called for and the vote was For motion: Cecil Christenberry, Dick Charles, Lee Turner, Ed Brinson. Against: Tim Kant, Bob Clark, Dan McCrory, Larry Green, Jean Wilson. Another motion was made by Jean Wilson to adopt the subdivision regulations, including the errors & omissions requirement, and changes presented(in p*� file). Bob Clark 2"d the motion and the vote was For motion: Lee Turner, Tim Kant, Dan McCrory, Jean Wilson, Larry Green, Bob Clark. Against: Cecil. Christenberry, Dick Charles, Ed Brinson. Motion passed.
