HomeMy WebLinkAbout09-04-2001 Planning Commission MinutesThe Planning & Zoning Commission met Tuesday, September 4, 2001 at S:OOPM at the Fairhope Municipal Complex, 161 N. Section Street. Present: Dick Charles, Vice -Chairman; members Timothy Kant, Dan McCrory, Pauline Anders, Bob Clark, Lee Turner, Jean Wilson, Ed Brinson. Christopher Baker, Director of Planning & Zoning, Betty Rivenbark, Secretary The minutes of the August 6, 2001 meeting were duly considered and approved as written on motion by Ed Brinson, 2"d by Dan McCrory. SD01.33 Final Plat Approval request of Clarence Burke - River Oaks Phase 2(Generally located west of Booth Rd and South of Belle Chase. Mr. Baker commented that this is a 29 lot subdivision containing some 10.83 acres, zoned R-2 Single Family and is located in the City Limits. He said that the required calculations and certifications have been provided, that during the course of public improvement there was much erosion that drained into the detention pond but the engineering company has verified that the pond is constructed to plans and that it has the required capacity. That sidewalks will be constructed in increments during home construction. His recommendation was to approve subject to 5' sidewalk installation. John Avent of EDS was present and said he would be glad to answer any questions. Lee Turner commented that it looked like a good bit of wash continued on the north side. John said that they plan to reshape and regrass this area. The question was asked when do the property owners have to take maintenance of this pond and Mr. Avent said usually when the development is completed, at the discretion of the developer probably in three years. A motion was made by Lee Turner to approve subject to the detention pond being corrected on the north side to original specifications and the recommendation of staff subject to 5' sidewalk installation. Pauline Anders 2"d and motion carried unanimously. SD01-.34 Preliminary Plat request of Richard Brunson/Manchester Place(Generally located south of Cty Rd 34 and East of US Hwy 98 - 4 lots. Mr. Baker commented that this is located outside the city. He has provided the needed drainage information and certifications. He has submitted information to the county and been approved for his septic systems. A private ingress/egress easement will provide access by a common driveway and is located solely on Mr. Brunson's property. The developer is requesting a waiver of the sidewalk requirement because of the large lots and the rural setting. His recommendation was to approve. Mr. Brunson came forward and said he has tried to conform. Mr. Charles asked him about the letter that the Commission had received from a group of property owners. Mr. Brunson said that was a misunderstanding. Mr. Charles asked for any further comments and Dan Valentim one of the property owners who wrote the letter(in file) said he sees two errors on the engineer's calculations. It was asked if he was present and reported he is on vacation. Further discussion led to a motion by Tim Kant, 2"d by Dan McCrory to table for 30 days in order to have the engineer present to answer questions. Motion carried unanimously. Planning & Zoning Commission September 4, 2001 - Page Two SD01-35 Replat of Lot 40 in Fairfield Phase 1. Request of Ken Hess(Generally located on the north side of Cty Rd 44 and west of Cty Rd 13) Mr. Baker said that the lot owner, Mr. Hess, was only trying to square up his rear property line, no additional construction. He recommended approval. Mr. Hess was present and said he purchased additional footage, that there would not be anything built just put fence around property. A motion was made by Dan McCrory, 2"d by Bob Clark to approve request. Motion carried unanimously. SR01.01 Request of Joe Johnson for a revised site plan of Johnson Commercial Park (Generally located on Greeno Rd just south of the hospital) Mr. Baker said that site plan approval was given earlier this year and that a building permit has been issued and construction began. An alteration to the previously approved site plan is what is being asked for, removing some landscaping and adding 10 parking spaces. He recommended approval subject to meeting landscape requirements. Discussion followed and it was pointed out that this is a significant upgrade to property and they will still meet landscape requirements. A motion was made by Pauline Anders subject to the landscaping requirements being met. Ed Brinson 2"d and motion carried unanimously. Under old business, Cindy Vines asked to be heard as her replat request at the last meeting was tabled. Property located at the northeast corner of Cty Rd 13 and Morphy Avenue. Subject is wishing to divide one lot into two and said that it was not approved because of the drainage situation, that they are providing the correct calculations. Tim Kant moved to untable this. Pauline Anders 2"d. Mr. Kant said he talked with Mr. Baker and Mrs. Vines and that before getting a building permit they will have to submit correct drainage calculations. Mrs. Vines said they want to do the right thing and will adhere to any and all requirements. Mr. Kant moved to approve replat subject to the revised calculations on drainage being approved by Mr. Baker before issuance of any permits. Ed Brinson 2"d motion and it carried unanimously. Jeff Kennedy of EDS asked the Commission to consider Jackson Place which was withdrawn at the last meeting at request of developer due to problems with the preliminary plat. Mr. Kennedy was told that there was nothing before the commission and they could not consider anything that they had not had a chance to review. There being no further business, meeting was duly adjourned.
