at 5:OOPM at the City Municipal Complex, 161 N. Section St in the Council Chambers
Present: Larry Green, Chairman; Dick Charles, Debbie Quinn, Tim Kant, Dan McCrory,
Bob Clark, Ed Brinson, Lee Turner, Jean Wilson. Christopher Baker, Director of
Planning & Zoning, Betty Rivenbark, Secretary
The Chairman advised the members of the Advisory Committees that had been formed.
(Copy in file) and stated they are activated.
The minutes were considered and approved with one addition on motion by Dick
Charles, 2nd by Debbie Quinn and unanimously carried.
ZC01.07 Public hearing to consider amending the Zoning Ordinance to address
freestanding commercial buildings. Mr. Baker told how the committee concluded
that this needed to be addressed in 3 parts: 1. Free standing retail buildings; 2.
Parking requirement, and; 3. Shopping centers. Tonight he had the ordinance on Free
standing retail buildings and in essence this ordinance limited footprint to 18,000 sq ft
and that any building larger than 8,000 sq ft would be directed to locate within the
Greeno Rd village Center. He recommended approval. He stated he had sought an
opinion from the city attorney on validity but so far had not received an answer.
Discussion led to a motion to recommend approval of ordinance to City Council subject
to getting favorable opinion from City Attorney. Ed Brinson 2"d motion and it carried
unanimously.
ZC01.06 Public hearing to consider the request of Juanita Griffing for a zoning
change from RA Residential Agriculture to R2 Single Family(generally located on
Morphy east of Cty Rd 13) Mr. Baker reported that this is a 4.4 acre tract of land
currently zoned RA. That they wish to divide the property and create 3 lots fronting on
Morphy Avenue retaining the back portion for herself. His recommendation was to
approve. Discussion followed. It was determined that a gravel drive would be used to
access the back lot. Lee Turner pointed out that he would like to see access from the
rear if possible to these 3 planned lots. It was also pointed out that if any further
development of the back property is planned that the ROW would be an issue.
Requirement is 50 feet. Pam Sterrett was representing her aunt and said there was no
further planned development at this time but she appreciated the input. A motion was
made by Dick Charles to recommend approval to the City Council. Ed Brinson 2"d the
motion and it carried unanimously.
S1301.13 Minor Plat approval of Druid Hills(Generally located south of County Rd 11
and west of Mary Ann Beach Road) Mr. Baker commented that this is an 8.5 acre tract
and they wish to create 3 lots. That the property is located near the Barnwell
Community and is outside the city limits. He said that a copy of the application had
also been submitted to the county. He said there is a large drainage easement
indicated on the property and a creek bed runs through the property and included in the

easement. He said there is a large amount of delineated wetlands on the property and
a copy of the plat had been submitted to the corps. A note has been placed on the plat
that said that a disturbance of the wetlands would result in action by the corps. The
county review has indicated that there is enough upland area to build on the proposed
lots. County health department approval has been given for septic systems on the
subdivision. He recommended approval. He said he had verbal approval from the
county but has not received a letter yet. Dick Charles moved to give final approval as
recommended, Lee Turner 2"d the motion and it carried unanimously.
SD01.15 Preliminary Plat CAD, LLC-Canebreak Subdivision(Generally located on N.
Section St. south of the Episcopal Church and north of Fairhope North) Mr. Baker said
this is an application of Robert Clark containing some 5.2 acres and zoned R2. It will
be divided into 11 lots. The issues associated with this and of concern were: the buffer
strip - The development is providing the required undisturbed buffer strip adjacent to
Section Street. Cul de Sac - because the land is landlocked this is what proposed,
although this not what we wish to create. Property is smaller than 10 acres and is not
required to provide greenspace. However, the developer is providing greenspace..
Sidewalks - Sidewalks are being provided on both sides of the street. And a sidewalk is
proposed through the greenspace that will link adjoining neighborhoods to the trail on
north Section St. Charlie Bassett was present representing the developer. Several
residents were present from Richmond Square area and asked questions about
planned buffer and connectivity. Discussion led to recommendation to leave 20 ft
buffer all around planned subdivision. Residents asked that it be clarified that they not
remove anymore trees than necessary. A motion was made by Dick Charles to
approve the preliminary plat with it being noted that they not cut down any city trees
other than what necessary and create buffer zone. Debbie Quinn 2"d and motion
carried unanimously.
SD01-16 Final Plat approval of Bayou Volanta Unit II(Generally located on the west
side of the 4 lane south of Parker Road). Mr. Baker commented this is land of Olympia
Dyas and this is a replat of several lots that are located outside the city. Proof of
submission to the County has been provided. The erosion at Fly Creek is an issue and
no drainage calculations have been provided as the number of lots is being reduced.
Staff recommendation was to approve subject to appropriate erosion control plans in
order to protect the integrity of Fly Creek and Lot 2 having no vehicular access to the
four lane. Mr. Baker said he had a letter from Starke Irvine that says that Lot 3 will give
a dedicated ROW to Lot 2 so that takes care of one concern, and there will be a note
on the plat. And, to have county involved in protection of Fly Creek. A motion was
made by Tim Kant to approve subject to no curb cuts of 4 lane and protection of four
lane area. Ed Brinson 2"d motion and it carried unanimously.
SD01-17 Final Plat approval of Fairfield 5(Generally located east of Booth Rd and
north of Twin Beech Road) Mr. Baker commented that there are no major issues. That

he has asked that a traffic calming be installed on Lakeview Drive. That the required
bonds have yet to be received but the developer has been advised that no permits will
be issued until the Council accepts maintenance of the public improvements. He
recommended approval. Tim Kant moved for final approved as recommended. Dick
Charles 2nd and motion carried unanimously.
Christopher was asked to look into issue of concrete street mailboxes.
There being no further business, meeting was duly adjourned.
