at 5:OOPM at the City Administration Building, 161 N. Section Street at 5:OOPM.
Present: Larry Green, Chairman; Dick Charles, Bob Clark, Dan McCrory, Debbie
Quinn, Ed Brinson, Lee Turner, members. Christopher Baker, Director of
Planning & Zoning, Betty Rivenbark, Secretary
The minutes of the March 5, 2001 meeting were considered and duly approved on
motion by Debbie Quinn 2nd by Dick Charles and unanimously carried.
ZC01-02 Public hearing to consider the request of Klumpp-Boone LLC for R-6 Mobile
Home Park zoning concurrent with annexation(generally located east of Hwy 27 just
south of Gayfer Extension). Mr. Baker was asked his comments and said that this
contains 6.61 acres and that they are wishing to annex as is currently outside the city.
That it has already been developed but there are currently no units in this phase of the
park. He said that the park is served by City of Fairhope water and sewer and by
Baldwin EMC power. That Baldwin EMC had installed overhead electric service which
violated our regulations for underground installment and applies throughout our
planning jurisdiction and are applicable in any development. He stated further that
Baldwin EMC had been made aware of this requirement by letter dated January 10,
2000. His recommendation was to table the request until the underground utilities
installed. Larry Green questioned Mr. Baker about the streets. Christopher said he had
not looked into infrastructure issues. Kevin Boone spoke on his behalf, saying that the
streets are not being turned over to the city. He said the drainage was hooked up
today and approved by county. Larry Green said he has a problem wherein something
is built then asked to take into city but not meet city requirements then down the road
ask the city to take over. Mr. Boone said water and sewer built to city standards but
streets remain private, approved by county. He said the only thing different they did not
have curb and gutter. Larry Green said the unpaved turnaround at the east end
suggested he would develop more. Kevin said he has developed all he plans to
develop, he cannot speak for the Klumpps. Further discussion followed on utilities and
private street issues. It was mentioned if we have a policy about underground utilities
we need to enforce it. After discussion a motion was made by Dick Charles to hold
over until utility situation resolved with EMC. More discussion followed and motion was
amended to say approval subject to burial of utility lines. Lee Turner 2"d and motion
carried with one no vote by Bob Clark. It was noted that the reason for the exception
( accepting private streets) was that this part connected to private streets already
installed. Also noted, the storm drainage was not part of the acceptance.
SD01-06 Request of FSTC for a final plat of Colony Place Phase 2 (generally
located south of Twin Beach Rd just east of FHS) Mr. Baker commented that this is
final plat approval of some 19.3 acres and 35 lots. The property is zoned R1 Single
Family Resi. Staff recommended approval subject to financial guaranty being received
and landscaping being accomplished. No one was present representing the colony.

After discussion a motion was made by Dick Charles to accept staff recommendation,
subject to the guaranty, striping of the road and chicane. Ed Brinson 2nd and motion
carried unanimously.
SD01-07 Preliminary Plat of Cahoon Commercial Park(generally located south of
town off of Wagonner Rd and west of the airport) Christopher commented that this was
a 10 acre parcel that they wished to divide into 14 lots. That it is located outside the
city and is not zoned. He said further he had not received word from the health
department on whether or not the septic tanks will be acceptable which is an issue. He
said Waggoner Road will be paved but the developer is requesting a waiver from
requirement that this should be paved to the property line. He recommended tabling
until information received. Discussion followed on merits of connecting commercial
businesses by cul de sac, how far from city sewer(less than % mile), planned detention
ponds. Randy Ard from Stifler Engineering was present and said that normally they do
perk tests after preliminary approval. Mr. Ard was told that requirement is all streets
should go to the property line. Mr. Ard said that reason this was not connecting was
cost of $20,000 culvert that would have to be installed. Further discussion led to a
motion by Dick Charles to table for 30 days until we get the information from the health
department regarding the septic system and discuss further the issue of connectivity.
Dan McCrory 2nd motion and it carried unanimously.
SR01.08 Public hearing to consider amending the subdivision regulations to require
sidewalks on both sides of all new streets. Staff recommended approval. The
recommendation was 5' sidewalks at least 10 feet from the curb on both sides of the
street. Lee Turner made an argument for not having this requirement, wherein there
would be a u-shaped subdivision with outside lots. Also, John Avent spoke telling of
problems he has had an example being the slope of lots in Rock Creek. He said best
was to bring sidewalk against right of way. Further discussion led to a motion by
Debbie Quinn to amend subdivision regulations as presented. Dan McCrory 2nd
motion. Motion carried with the following vote. For motion - Debbie Quinn, Dan
McCrory, Bob Clark, Larry Green. Against motion - Lee Turner, Dick Charles, Ed
Brinson.
There being no further business, meeting was duly adjourned.
