HomeMy WebLinkAbout03-05-2001 Planning Commission MInutesThe Planning & Zoning Commission of the City of Fairhope met Monday, March 5, 2001 at 5:OOPM at the City Administration Building, 161 N. Section Street Present: Larry Green, Chairman; Dan McCrory, Debbie Quinn, Bob Clark, Dick Charles, Lee Turner, Ed Brinson, Tim Kant. Christopher Baker, Director of Planning & Zoning, Betty Rivenbark, Secretary The minutes of the February 5, 2001 meeting were considered and approved as written on motion by Dick Charles, 2"d by Lee Turner and unanimously carried. SD01.03 Minor Plat Approval - Cedar Breeze/Barbara Achee( generally located east of Cty Rd 33 just south of Meadow Rd) Christopher had commented that this is located outside of the city containing 22 acres. She is requesting a two lot subdivision and there is an existing mobile home park located on the proposed lot 2. His recommendation was to approve. Dick Charles questioned the drainage and he was told that it is noted on the plat, that Charlie Bassett did the engineering. A nearby resident expressed her concerns and it was determined that everything she was asking about would have to be addressed by the county. A motion was made by Dick Charles to approve, Debbie Quinn 2"d and motion carried unanimously. SD01.04 Replat of Old Church Street Subdivision land of Dexter and Dan Corte(generally located on the west side of Church St just north of the K-1 center) Christopher commented that this request contains a reduction in lots from 10 to 8. That it is in the CBD and is zoned B-2 General Business. That issues associated with this are: access that lots 5-8 have access from a private drive and lots 1-4 will have direct access to St. James. That the current plat contemplates no access changes from the previously approved plat. The engineer has certified that the drainage meets city requirements. A 4' drainage easement is shown on the plat. Subdivision regulations require 15' and the developer is requesting a waiver of this. His recommendation was to approve. Peter Garsed was present representing the Cortes. Questions were asked about the planned 4' drainage easement between buildings. Mr. Garsed answered this will be the sole responsibility of the property owners association if any problems occur. The accesses were discussed but there have no changes from the previously approved plat. Further discussion led to a motion made by Tim Kant, 2"d by Lee Turner to approve replat as presented. Motion carried with one nay vote by Debbie Quinn who also commented it was very sad that they have to tear down this house. SD01-05 Preliminary Plat Approval for The Woodlands Phase 2 - request of Trae Corte (generally located east of US Hwy 98 and north of Hwy 104) Under comments Mr. Baker said that this is a 104 acre tract containing some 67 lots and is currently zoned R2 Single Family Residential. He said issues associated with this are: 1. Comprehensive Plan - That the developer indicated they wished to have private streets and the new comprehensive plan calls for the creation of neighborhoods on a modified street system. The developer requests to not provide ROW stub outs. This is not in conformance with the Comprehensive Plan. 2. Gully: There is a steep Planning & Zoning Commission March 5, 2001 - page two topography located on lots 64-67. The drainage easement has been increased at this point to further protect the gully from damage. A note has been added to the plat that indicates that no building will be permitted in this easement. 3. Electricity: The City of Fairhope will provide power. 4. Sidewalks: 5' sidewalks are proposed on one side of the street. 5. Dam - A dam is proposed to be constructed to create a 7.5 acre lake. The dam has been engineered by Southern Earth Science. His recommendation was to deny because the development does not make provisions to connect and the private streets dictates/precludes public access. In discussion Larry Green said he wished to suggest that 1. The proposed streets run to the property line, 2. He has issues with the private streets and 3. the proposed gated community, that this is not in concert with the comprehensive plan. Joe Bullock spoke on behalf of Trae Corte saying that each lot was 1.1 acre with a 7 acre lake and nature trail that will become part of Woodlands. That the entry feature will be similar to Woodlands now, no gate is planned and sidewalks on the perimeter. Comments from the commissioners indicated this was not compatible with comprehensive plan, an easement around the lake was suggested. Further comments led to a motion by Dick Charles to approve subject to 1. The streets being public, 2. An easement around the lake, 3. Stub out to edge of Auburn property. Debbie Quinn 2"d the motion and it carried unanimously. SR01-01 Site Plan Review for Joe Johnson for a Medical Development(generally located west of Greeno Rd just south of Thomas Hospital) Mr. Baker said that Mr. Johnson is seeking to redevelop several existing office buildings and construct an additional building. He said that no new curb cuts are proposed and that lighting and landscaping has been discussed with the architect. That a 6 ft. privacy fence is proposed on the southern and western property line. That this property is zoned B2 General Business. He recommended approval subject to meeting lighting requirements and installing the required shrubs next to the parking area for Building 1. Mr. Johnson was told this is a tremendous improvement, he was asked if he had tenants yet and said no. Tim Kant moved to approve, Dick Charles 2nd motion and it carried unanimously. IR01-02 Informational Report regarding Big Boxes - Christopher Baker reported that there had been much discussion centered around "big boxes" during comprehensive planning process. A term generally used to define large single use retail buildings that are set back from the street with plentiful parking and no architectural or pedestrian accommodations. He is putting forth for consideration and discussion before an ordinance prepared that big box development be considered on B2 zoned property that falls within the Greeno Rd Community Village Center and maximum building footprint shall be 20,000 ft. He was asking for thought and input. There being no further business, meeting was duly adjourned.
