HomeMy WebLinkAbout01-02-2001 Planning Commission MinutesThe Planning & Zoning Commission of the City of Fairhope met Monday, January 2, 2001 at 5:OOPM at the City Administration Building, 161 N. Section Street Present: Dick Charles, Vice -Chairman; members Tim Kant, Dan McCrory, Debbie Quinn, Bob Clark, Ed Brinson, Lee Turner The minutes of the December 12, 2000 meeting and December 21, special meeting were duly approved on motion by Debbie Quinn, 2"d by Bob Clark and unanimously carried. ZC01-01 - Public hearing - rezoning request from R-1 Single Family to PUD Planned Unit Development, land of Fred Hayek, generally located on the east side of Greeno Rd south of Hwy 104. Christopher Baker was asked to give his comments and said that the subject property contains 3.1 acres and the adjacent property is zoned R-1. That the issues relating to this project are: 1. Not in conformance with the adopted comprehensive plan, 2. Drainage - generalized drainage plans have been provided complete engineering will be provided during the development process. 3. Setbacks - 40 feet on all sides. 4. Uses: permitted uses for the PUD included only professional offices with typical office hours. No retail or residential component is included. 5. Parking will be provided as indicated. 6. Access. Access will be from U.S. 98. 7. Building Height: 50' maximum is proposed. 8. Landscaping: General landscaping has been provided. 9. Sidewalks: No information provided. 10. Special Fire Protection: none anticipated. 11. Dumpster: a common, screened dumpster is proposed. 12. Lighting: A maximum of 20 'is proposed. 13. Phased Development: Three phases are indicated with the first being on Greeno Rd. Staff recommendation was to deny because it is not in compliance with the adopted comprehensive plan. Peter Sikorowski/Mike Baker did presentation on what proposed, showing site plan and buildings and outlining timetable on phases. Starke Irvine spoke on Fred Hayek/Dr. Staggers behalf(the proposed buyer and owner of proposed medical complex) Saying that they were trying to keep Fairhope character & scale, natural landscaping, planned Spanish mission style buildings. That in his field(plastic surgeon) needs degree of privacy, historic flavor, said there would be 3 physicians. Discussion followed and a motion was made by Tim Kant, 2"d by Dan McCrory to deny rezone request and pass recommendation to city council. Saying he liked everything about this but the proposed location, should be closer to hospital, trying to make city pedestrian friendly and that there is a lot of vacant property closer to hospital, going with comprehensive plan recommendation. Motion carried with 5 votes, Ed Brinson abstaining, and Dick Charles voting against motion. SDOO-58 Minor Plat of Calfee Subdivision (generally located at the southeast corner of Greeno and Hwy 32) Christopher commented that this contains 8.5 acres and two lots and is located on S. Greeno Rd near the airport. He said issues are: request is in conformance with comprehensive plan 2. Drainage calculations have been provided and a note on the plat indicates that drainage information will have to be provided at the time of building permit. 3. Public water source: the City has a public water well approximately 800 ft east of the proposed lot 1. That he and Water & Sewer Dept have Planning & Zoning Commission Page two - January 2, 2001 extreme concern regarding impacts that development will have on the water well.( Gas station is proposed on lot 1) Special geotex fabric will be used by the developer with double tank, have an oil and gas separator system, and agreed to have a note on the plat that they will have pollution control system and allow city to access site and inspect required maintenance. 4. That public water and sewer will be used. 5. Permits - city and county will issue permits. 6. County/ADEM have already approved the development. Recommendation was for approval subject to requiring drainage for the entire parcel to be designed now in conjunction with pollutant/water separator and installation of appropriate barriers for the gas tanks. Dan McCrory remarked that he had a letter saying they would use permalon on tank, not sample shown tonight. Discussion revealed two driveways proposed, one on Greeno, one on Hwy 32, 40 ft. wide. That between city water supply and station - 4 detention structures and alarm sensors. The proposed lighting was questioned and whether or not they planned to use lighting as proposed by city ordinance. Dan McCrory moved to approve contingent on safety equipment and Chris's comments on drainage being adhered to. Bob Clark 2"d and motion carried unanimously. SD01-01Minor Plat of Cypress Trace - land of Chris Fogarty(generally located on Cty Rd 34 east of U.S. Hwy. 98) Christopher in his comments said this is two lot division, the smallest being 3.1 acres. Land located outside the city limits. Also, a private 30' access and utility easement is being provided for the rear lot. That because of the size of the lots drainage is not an issue, that the lots will be served by Fairhope water but will utilize septic systems. Staff approval was recommended subject to appropriate documentation of access and utilities easement. After discussion a motion was made by Lee Turner, 2"d by Ed Brinson to approve subject to staffs recommendations. Motion carried unanimously. SD01-02 Replat of Planters Plaza, land of Arthur Corte(generally located north of Fairhope Avenue just to the west of the Satellite Courthouse). In Christopher's comments he said that Mr. Corte is seeking to create one lot on the 10 acre parcel. That the property is currently zoned B2 General Business. The issues being: 1. This is in conformance with the Comprehensive Plan 2. That access from an existing street will be used and existing utilities will serve the development. That a 20' mutual access easement along the southernmost property line has been agreed to. That sidewalks adjacent to Courthouse Drive will be installed. That a waiver of the drainage study requirement has been asked for. He recommended approval subject to drainage study being performed and note on plat that proper access to lot 1 will be provided. He also said that he had letter saying no improvements planned at this time but when proposed they wish to be able to perform drainage study at that time. Discussion led to motion by Tim Kant to approve re -subdivision request. Dan McCrory 2"d motion and it carried unanimously. Christopher reported he is still researching new development sidewalk requirements and will have a report next meeting. Planning & Zoning Commission January 2, 2001 - Page three A committee was formed of Ed Brinson, Bob Clark, Tim Kant to look into perimeter of Central Business District, to report in 60 days if we need to redefine after Charlie Bassett came up requesting a change in piece of property on perimeter that is currently zoned B-2 and he is wanting to rezone to R3TH. There being no further business, meeting was duly adjourned.
