City Administration Building, 161 N. Section Street.
Present: Larry Green, Chairman; members Pauline Anders, William Richmond, Dick
Charles, Lee Turner, Tim Kant, Thad Ingram. Christopher Baker, Director of
Planning & Zoning, Betty Rivenbark, Secretary
The minutes of the November 1, 1999 meeting were considered and approved as
written on motion by Pauline Anders, seconded by Lee Turner and unanimously
carried.
SD99-50 Minor Subdivision - Walley's Corner(located southwest corner of Hwy 27
and County Road 44) land of William Walley located outside the city limits.
Christopher was asked for his comments and said this is a simple plat one lot on 2.6
acres there are no public improvements, that they did provide drainage information,
they have indicated a 30' private easement on the plat and all permits will be sought
from the county. Staff recommended approval. Lee Turner moved to approve as
requested. Dick Charles seconded and motion carried unanimously.
SD99-61 Final plat of Rock Creek Phase 6(located east of the existing Rock Creek)
Christopher said this is the last portion of the approved PUD. That this had come
before the Commission several months ago. It contains some 42 acres and 41 lots and
is in compliance with the comprehensive Qlan. That the street names have been
verified and the sidewalks agreed to in the preliminary plat will be constructed. A
performance bond has been posted to certify that the improvements will be constructed.
All requirements have been met and staff recommended approval. Mr Green called for
comments and Mr. Ramado, A property owner spoke saying that he bought his property
thinking this would be an ideal place to retire and now with expanded development he
feels he has been blindsided. Dick Charles pointed out that there are two other
accesses dedicated to the city and -that as need arises they would be developed. Tim
Kant moved to give final approval, Dick Charles 2"d and motion carried unanimously.
SD99-52 A replat to be known as Sullivan Subdivision(located on Oak Street).
Christopher commented this was a simple plat request, that Mr. Sullivan bought a
portion of land from his neighbor and wishes to incorporate this lot into their existing lot
so they can use it in the future if additions are needed to their home. No new public
improvements are required. it is in conformance with the comprehensive plan and staff
recommended approval. Pauline Anders moved to approve, Thad Ingram 2"d and
motion carried unanimously.

provided in conjunction with this plat and it was his feeling that the study should be

done now even though the developer has a note on the plat that indicates the drainage
would be dealt with at the time of building permit application. Denial was recommended
because no drainage information was provided. Ray Moore spoke representing BWP,
Inc. and said they are taking 3 lots into 2 and there is potential development for one lot
at this time. That they do know the drainage problems as the land is flat. He said that
more than likely they will use underground stormwater detention. He said if they have
to do study at this point may be throwing money out the window. That it will have to
come back for review. He said all the utilities are there and that the discharge is to the
west to the right-of-way. That they don't know what else going to be there. That they
will also have to have a permit from the state. The curb cuts were asked about and
Ray said they plan one for each lot. It was asked if they could utilize one. Dick Charles
said if they put on plat that there be one access only and that the drainage calculations
have to be done and paid for before permits issued by the property owners, he moved
for approval. Lee Turner 2"d and motion carried unanimously.
SD99-55 Preliminary Plat of Battles Wharf Landing(located at the corner of Heard
Rd and Nelson Rd.) Christopher come ehaevethat this is conformance submitted proof of submissth ionhe to the

and there is a statement on the plat that the drainage meets the requirements of the
county sub regulations. That the city is aware of drainage problems in this area and
there is a proposal of a detention pond that will release into the wetlands. In his
opinion it does not make sense that wetlands could be used as a detention pond
because of the high water table. That a drainage study taking into account ultimate
development of the drainage basin should be performed. He remarked that Heard
Road is a dirt road and although the county said they will pave it no time frame other
than calendar year 2000 is associated with a letter. The sub regulations indicate that
no major subdivision shall be approved unless the area to be subdivided shall have
frontage upon and access from an existing publicly maintained paved street. No
construction plans for the street were provided. That they will use both public water and
sewer. Lot size requirements have been met. It was staff recommendation to deny
approval because the access requirement has not been met. Larry Green remarked
that we have some real problems with drainage in this area. He remarked the Moffetts
had come to us seeking recommendations in trying to do a development in this area.
That the overall drainage area has to be considered . Several residents in that area

Parker.spoke saying he has tried over the years to balance property rights with
development in that area. .That three times previously this property has been tried to be
developed and it was concluded it wasn't adequately designed, that this would have the 45

He is asking that an overall plan of the area be put on the table and the big picture
considered, all 130 acres, not done in increments. It calls for thorough drainage plans.
The developer said that none of the wetlands would be impacted, they would be
preserved in a conservation easement over 35 acres. Pauline Anders said she feels
they came ill prepared and would like to move to deny. Dick Charles moved to modify
the motion that they would have to show drainage if's and buts and what the county
would do. Pauline accepted modification. William Richmond 2"d and motion carried
unanimously.
99-56 Silverwood Phase III Preliminary Plat(located on Hwy 27 south of 32)
Christopher said this property is located outside the limits of the comprehensive plan
but they have submitted proof of submission to the county for review. Drainage
certifications have been provided, that public water will be used but private septic
systems. That drainage easements have been added to the plat. That one point of
access to adjoining property has been shown but it would seem prudent to have a
connection made to the property to the south. That greenspace has been provided but
it does not meet the design requirements as it is located at the rear of the property
behind lots. Staff recommended denial. Lee Lovitte spoke saying this is a resubmittal
and this is the best place for the green area a lot of pretty trees that they did not wish to
cut down some big trees. That they have one lot fronting on a cul de sac that they did
change the frontage, only 25 lots. Larry Green told him that we try to make the
greenspace useable. Discussion followed on a better design with the result being Dick
Charles moving to deny, come up with better solution. Pauline Anders 2"d and motion
carried unanimously.
99-57 Finger Industrial Park- Informal Plat Review (located on Hwy 98 by the airport)
Christopher remarked that this a 13 acre parcel fronting on US 98 and they are
proposing to divide into 6 lots. That this development is in conformance with the
comprehensive plan. George Roberds was representing the applicant. He passed out
a drawing saying this is in the industrial park. He remarked that 4 of the 6 lots would
face-Greeno Rd. 20,000 feet each. That a 25 ft. alley would join the lots and he would
provide drainage calculations. No one had a problem with what proposed.
Tim Kant mentioned that he thought sidewalk easements need to be included in review
of all development plans to prevent problems down the road if/when sidewalks are built.
Approval was also given for reinstatement of site plan review for commercial
development by the commission after Tim pointed out that at some point the
commission had stopped reviewing these site plans.
