at 5:00 PM at the City Administration Building, 161 N. Section Street.
Present: Chairman Larry Green; members James P. Nix, William Richmond,
Dick Charles, Thad Ingram. Christopher Baker, Planning & Zoning
Official and Betty Rivenbark, Secretary
The minutes of the May 3, 199 meeting were duly approved as written on motion by
Dick Charles, seconded by Thad Ingram and unanimously carried.
ZC99-08 Public Hearing re -zone from RA- Rural Agricultural to RI -Single Family
Residential and R3PGH-Patio Garden Homes on approximately 40 acres, lands of
Pauline Moyd(located south of Bay Meadows and west of Cty Rd 27). Christopher was
asked to give his comments and as issues associated with this zoning mentioned:
compatibility with adjacent zoning which is R2 Single Family Residential saying it is in
relative conformity; the 2 lot sizes being shown as R1- 23,000 sq. ft. and R3PGh- 5200
sq. ft. which exceeds city requirements; having alleys - the whole development is
served by rear alleys; turning radii- which he stressed as important that emergency
vehicles and garbage collection vehicles could comfortably navigate. He also stated the
applicant is willing to work towards this end. That the Cty Road 27 setback(100 ft. from
the centerline of the highway) has been met, although the alleys are located in this
setback, he advised the developers that no permanent structures will be allowed in
these setbacks. That this is somewhat similar to a Traditional Neighborhood
Development but it lacks connectivity in that it uses cul-de-sacs. There is only one
street connecting to Bay Meadows Avenue. A lengthy discussion followed on the
issues that Christopher mentioned. Mr. Charles asked if Cty Rd 27 four-laned would it
eliminate the alley facing the road and would there be room to erect a fence. Mr. Avent
said he talked to Kevin Cowper of the County and that he indicated there would be
plenty of room. Christopher responded to the fence issue saying logically he would
expect the property owners association to deal with it, put it in deed restrictions. Jeff
Kennedy explained the reasoning behind the cul-de-sacs and what they were trying to
achieve in this development. Clay Adams showed a rendering pointing out the
neighborhood activities center and play area and said they were trying to encourage
people to walk. A couple of residents from Bay Meadows Avenue expressed their
concern over the increased traffic due to the subdivision. Matt Dial questioned where
their sewer lines will go expressing his concern that they will go to Quail Creek and that
Quail Creek developers planned for their future growth but if this subdivision will be
taking their sewer to this substation what will happen to Quail Creeks future plans.
Larry Green said the city is responsible to make sure that facilities are adequate to
handle developments. Chris said this is relevant but not issue now. Dick Charles
questioned cul de sac plan. Jeff said this is the design they were trying to achieve, it is
unique and they don't see it as an issue. Larry Green said he had gotten calls from two
members questioning density and also concern over approval given to a certain zoning
of land and then the land sold off and not developed as stated. He just wanted to
express these concerns. Thad expressed concern of parking vehicles in alley. It was
pointed out that there would be two spaces allowed for in rear and two in front. That
alley parking could be handled in deed restrictions. Larry Green raised the question
why it was not submitted as a PUD and would they consider it. Discussion followed on

this and they said they would not be adverse to resubmitting as a PUD. As a result Dick
Charles moved to reject this proposal and have them resubmit. James P. Nix 2"d
motion. Motion passed unanimously. It was determined that July meeting would be
moved and date was set for July 13"' and John Avent said they could resubmit and
meet this deadline.
ZC99-09 Public Hearing re -zoning request of Bill Callies from RA -Rural Agricultural
to R-2 Single Family Residential on 4.1 acres located on Beecher Street(between
Morphy Avenue and Fairhope Avenue). Christopher had commented that Mr Callies is
dividing his land for his children and that proper zoning is required for building permits.
Mr. Green called for comments from the commission or audience. There were none.
James P. Nix moved to recommend approval to the City Council, Dick Charles 2"d and
motion carried unanimously.
SD99-18 Preliminary Plat Approval - Miller's Crossing Phase 1 (16 acres) & Phase
2(20 acres) located on Cty Rd 32 west of Cty Rd 27, lands of William Street.
(Immediately west of Larry Newton School). Christopher had commented this is outside
the limits of the comprehensive plan, but all of the property in the general area is
indicated to remain agricultural, thereby making it not comply with comprehensive plan.
He indicated that Magellan Blvd runs the length of Phases 1 and 2 and is shown 1640
feet long, our subdivision regulations say 1200 ft. and the developer is requesting a
waiver of this requirement. Also in lot design we require minimum of 75 ft. front footage
and 10,500 sq ft area and corner lots have a minimum width of 90 feet. They do not
meet this requirement. He stated they have applied for an experimental subdivision
and a waiver from our requirements. That all certifications have been supplied. He
mentioned that Czar Ct. has a 20 ft. pedestrian easement at the end to allow access to
Larry Newton School which is adjacent to this property. Greenspace requirements have
been met in design and the county has reviewed the plat and plans and recommended
a deceleration lane on Highway 32. Jeff Kennedy was representing the land owner.
After he had made his presentation Thad asked about the length of Magellan Blvd and
putting up 3 way stop sign. Traffic tables or islands were talked about as a means to
slow traffic down. James P. Nix moved to grant preliminary approval subject to
construction of traffic table or roundabout. Further discussion led to mentioning that
they had substandard lots and concern for density. Mr. Nix withdrew his motion.
Discussion followed on why they did not meet lot requirements and they said they
wished to have experimental subdivision and it was suggested this could just be a
means of not meeting requirements. William Richmond moved to deny request for both
phases as presented. Dick Charles 2"d and motion carried unanimously.
Christopher had drawn up a draft ordinance on fencing for review and asked that each
member review it and return it to him with comments so he can work up a final draft, no
action required tonight.
The public hearing on the greenspace requirements was carried over again as there
were computer problems.

Christopher reported on River Mill Phase 1 that had been discussed at last meeting
and still has not been approved for maintenance by the city. He said in his inquiries he
was told that new pipe had been installed to handle the drainage problems. Lang
Green asked what needed to be done and he was told that the developer just needed
to get approved by city personnel that drainage will handle water and post bond if
indeed this has been taken care of . Christopher was asked to contact them.
There being no further business, meeting was duly adjourned.
