HomeMy WebLinkAbout02-01-1999 Planning Commission MinutesThe Planning & Zoning Commission of the City of Fairhope met Monday, February 1, 1999 at the City Municipal Complex, 161 N. Section Street at 5:OOPM In the Council Chambers Present: Chairman Larry Green; members Cecil Pitman, Tim Kant, Bill Jones, James P. Nix, Dick Charles, Trisha LoPorto, William Richmond At this time Larry Green presented the Resolution that was passed at the last meeting to Bob Lunsford who was unable to attend the meeting due to illness. The minutes of the January 4, 1999 meeting were duly approved as written on motion by Tim Kant, seconded by Bill Jones and unanimously carried. Spring Lake - Final Plat Approval, 64 lots Located on the east side of Greeno Road, south of the Autumn Drive intersection, land of Charles Breland. Bob Lunsford was asked to give his comments and he said lots 1-63 are zoned for R3pgh development while lot 64 is to remain not subdivided for use under a condominium plan. That they have provided the loop street arrangement for improved traffic and additional 15 ft. easement width on each side for private maintenance. That their maintenance documents have been approved by the City Attorney and preliminary conditions met except that the right of way deed granted in RPB 842 at Page 1360 needs to be graphically shown on the plat. He had reported at the time of writing that construction of all improvements were not complete which consisted mostly of streets, principally the asphalt. The engineer indicated that it would be ready before the February meeting but he suggested that all available test reports be submitted with the application including bacteriological water reports and call for a final inspection in advance of today's meeting. . Mr. Breland is prepared to post an irrevocable letter of credit to guarantee the remaining construction on the streets and is requesting Conditional Final Approval with the condition precedent that the City Council approve the letter of credit in the amount of $110,000. Mr. Green called for any questions, there were none. Seth Moore was present and said he would be glad to answer any questions. JP Nix moved subject to the 2 conditions Bob outlined and council approval of letter of credit that conditional approval be given. Dick Charles seconded and motion carried unanimously. Colony Place - Phase I - Preliminary Plat Approval - 16 lots Application of Fairhope Single Tax Corporation, land located on the south side of Cty Rd 44 adjacent to Fairhope Founders Recreation Park. There was some question on the legal description but that has been corrected, and Larry Green questioned jag in road but has been informed that road will line up with Bishop Road across from the subdivision. Colony Drive is to be dedicated to the city and will be used to access the park and subdivision. It was noted that the city may construct the improvements within Colony Drive to the extent required to provide access to the park and the FSTC may by donation or by furnishing in- kind services participate in the cost of those improvements. Beyond that improvements necessary to serve the subdivision must be Planning & Zoning Commission - Page 2 February 1, 1999 at the sole expense of the single tax corporation. Bob reported that he had met with the representatives of Volkert and FSTC on January 31,1999 and that the stormwater design is based on the entire tributary area for the northern drainage area of the subject property and the city park. That roughly one third of the total project lies within the southern drainage area and will be the subject of design for future phases of the project. His plan conforms to the requirements of Section 804 of the subdivision regulations. Before the meeting Bob had questioned where the stormwater retention was shown and said that the plat indicated area to be constructed by Fairhope. He quoted Section 94 Alabama Constitution of 1901 and said this is not allowed. That the subdivision regulations do not permit stormwater retention upon public property and require that retention areas be maintained by private entity established by developer for the entire project area regardless of phased construction. He said further that the city attorney is in the process of preparing a deed of exchange whereby the city will exchange an area large enough to encompass the proposed drainage pond at the southwest corner of Colony Drive and Cty Road 44 for that part of Colony Drive required for access to the city's park. He recommended preliminary approval with the following conditions: 1. Filing for record of the exchange deed 2. A construction conference with engineer, contractors and city representatives. It was noted further, the R-2 request for zoning on a conditional annexation petition had been withdrawn, instead they are presenting a straight petition with zoning automatic as R-1. Dick Charles questioned if drawing was current and Bob responded yes. Robin Gregory was present to answer questions for Volkert & Assoc. Dick Charles moved to grant preliminary plat approval subject to Bob's two conditions. William Richmond 2"d and motion carried unanimously. James P. Nix noted that the Founders Park land was adjacent and part of development and provided greenspace requirement. There being no further business, meeting was duly adjourned.
