HomeMy WebLinkAbout08-03-1998 Planning Commission MinutesThe Planning & Zoning Commission of the City of Fairhope met Monday, August 3, 1998 at 5:00 PM at the City Administration Building, 161 N. Section Street. Present: Chairman Larry Green; members Cecil Pitman, Thad Ingram, Debbie Quinn, Dick Charles, Trisha LoPorto, William Richmond. Robert Lunsford, Zoning Enforcement Officer and Betty Rivenbark, Secretary Mr. Green welcomed Trisha LoPorto as a new member on the Commission. The minutes of the July 6, 1998 meeting were duly approved as written on motion by Dick Charles seconded by Debbie Quinn and unanimously carried. A public hearing was held on amending Ordinance #557 to add a new section 70.151 Special Greenspace Reservations and Tree Protection Zones. Mr. Green called for comments from the audience and then from the commission. Debbie Quinn spoke saying she had several unanswered questions regarding this -she wondered how this would be handled with no vegetation on a lot and also with a sloped lot where fill had to be added. She commented that she knows we are real close to finalizing a tree ordinance and she would like to see how the two would work together, impact each other. Dick Charles said he had the same concerns and would like to move to table this until this and the tree ordinance could be reviewed together. Cecil Pitman seconded motion and it carried unanimously. Mr. Green asked Ms. Quinn to chair a subcommittee with Thad Ingram and Cecil Pitman and bring this to a closure as soon as possible. Final Plat Approval of Kensington, 25 lots being developed by Melissa Mahan Homes was being sought. Bob had commented that there were four concerns that needed to be addressed before the plat was signed and recorded: 1. Installation of 1' wide strip of solid sod behind curblines; 2. Receipt of all test reports with satisfactory results indicated therein; 3. Thorough cleaning of streets and curbs; 4. Approval of legal provisions for maintenance of common areas and off street drainage facilities by city attorney. He said these had all been accomplished but that he and Phil Rutherford had met with Ms. Mahan's representative regarding some drainage concerns last week and that they were suppose to be addressed. That he had recommended that a representative be present tonight but no one was here. Mr. Green called for comments from the audience and Mr. Watkins spoke saying he is an adjacent property owner and he does have concerns about the runoff from the east alleyway. Bob said that when he met with Ms. Mahan's representative he was told they would do whatever necessary to correct the situation. Mr. Watkins said they were in fact out there working today but that there has been no rain since this work done so there is no guarantee at this time of this working. Further discussion led to a motion by Trisha LoPorto to withhold final approval until they resolve the drainage issue. Dick Charles seconded the motion and it carried unanimously. Planning & Zoning Commission August 3, 1998 - page two Final Plat Approval of Taylor Oaks, 12 lots located on Taylor Street in Montrose was discussed. Bob had commented that a letter of credit had been posted as a performance bond guarantee on completion of streets and utilities and an annexation petition had passed the City Council at their meeting on July 27, 1998. He recommended final approval subject to the approval of the City Attorney for maintenance provisions for the private street and common areas in the subdivision. Mr. Green called for any comments. Mr. Frodsham spoke saying he was here to answer any questions if needed. Dick Charles moved to approve as recommended, William Richmond seconded and motion carried unanimously. Under old business, Mr. Lunsford said the council had sent back the Chambers re- zone request for further consideration with R-1 as zoning requested. That his comments from the June 1998 meeting still stood(in file) that they should submit drainage calculations for study which not have been forthcoming and that his recommendation was no different. That this R-1 change would mean 8 units rather than 12 under original R-2 rezone request. That the drainage problems still need to be addressed. Ms. Quinn commented that the council looked real hard at this when it came before them and told Mr. Chambers he needed to present drainage plans to the Planning Commission and appear at this meeting, Mr. Lunsford commented he had received no plans nor is he present tonight as requested. Larry Green commented that there are two ponds on the property now, one by White Grove and there is no positive flow from that area, all flat, can't go west and if go east worsen River Mills problems, that best solution was allow what allowable now under R-A. Cecil Pitman commented that he was satisfied with former decision that there are some very nice areas with 3 acre lots and thereby moved to recommend denial of rezone request to R-1 to City Council, stay as is now, R-A. Debbie Quinn seconded and motion carried unanimously. There being no further business, meeting was duly adjourned.
