at the City Administration Building, 161 N. Section Street at 5:OOPM.
Present: Vice Chairman Thad Ingram; members James P. Nix, Tim Kant, Cecil Pitman,
William Richmond, Dick Charles
Mr. Ingram made an announcement that the Judy Barrie/Brite Construction would not
be heard tonight as they have again asked for a continuance.
The minutes of the May 4, 1998 meeting were approved as written on motion by
William Richmond, seconded by Tim Kant and unanimously carried.
Re -zone request from R-A Residential/Agricultural to R-2 Medium Density Single
Family Residential land of Alvin C. Chambers 18.5 acres located on the north side of
Fairhope Avenue 1/4 mile west of Highway 27. Mr. Lunsford was asked to give his
comments and said there were two questions that needed to be answered with this
application 1. Does it conform to the City's comprehensive plan, and 2. Is it in the
best interest of the city as a whole. He went on to say that a 1996 restudy of the plan
indicated an adequate inventory of residentially zoned and developed property existing
for the next several years. Further, the land use density will be considerably altered
and the land is topographically similar to the land found in White Grove and would
therefore share some of the same inherent drainage problems. He suggested a
continuance for further study of the proposed development which is the basis for
request for rezoning. Thereby the applicant will need to provide adequate information
to determine the nature and extent of stormwater management to be applied to future
development and such other information as the commission may require. A Charles
Rigdon spoke saying he is the one wanting to purchase the land from Mr. Chambers.
That they are proposing 37 lots and there is a 4 acre lake on the north side of the
property. That they will hire an engineer, have gotten cost from Moore Engineering but
did not wish to incur the expense if it is not going to be zoned. Thad asked him at what
point in time would they have drawings showing stormwater/drainage plans. He said
any drawings they might have would meet and surpass any requirements. Mr. Ingram
call for any comments and several from the audience spoke: A Charles Hamm spoke
saying he represented Mr. Klumpp who was opposed to this, would suffer a strong loss
in the value of Klumpp's land, increase Mr. Klumpp's liability as he might use some
chemicals and he questioned is this best use for area, that we needed to save some
agricultural land. Bobby Havranek spoke saying he now gets more water than the
pipes can hold on Fairhope Avenue now. Nadine Fowler of Lowry Drive in White
Grove said the water in the drainage ditch has overflowed 3 times since she moved in
a year and a half ago. Judy Carlberg lives on the south side of White Grove and has
drainage problems now. Also requested that the beautiful wooded area at the north
end not be disturbed. The commission members spoke and Dick Charles said it is very
difficult to make a decision based on the absence of any degree of storm management
information . Tim Kant questioned the R-2 and said possible R-1 might be better. Cecil
Pitman said he personally worried about density and he hated to see him spend money

on something so controversial, that it could be developed much less expensively and
with less density and do something charming for the community. There were no further
comments from the commission members and a vote was called for. Cecil Pitman
moved that the request be denied, remain RA as it is. Tim Kant seconded the motion
and the vote was unanimous to deny.
There being no further business, meeting was duly adjourned.
