March 3, 1997 at the City Administration Building, 161 N. Section Street at 5:00
PM
Present: Chairman Larry Green; members Debbie Quinn, Cindy McBrearty,
William Richmond, Cecil Pitman, Richard Sanderson, Tim Kant. Robert
Lunsford, Zoning Official and Betty Rivenbark, Secretary
The minutes of the February 3, 1997 meeting were considered and duly
approved as written on motion by Richard Sanderson, seconded by Cindy
McBrearty and unanimously carried.
A public hearing was held on Dennis Frodsham's request for zoning as R-2
and R-3 concurrent with annexation for his property located at 730 S. Mobile
Street. Bob was asked to give his comments and he said that this is one lot that
the Frodsham's divided into two parcels A and B and that they lived on Parcel A
but parcel B contains some 15220 square feet of area. The land is currently in
the county but based on the legal description for the zoning district it does not
appear to be subject to any zoning control by the county. Further, in any event
the annexation and concurrent zoning will not alter the character of the
neighborhood from single family residential and is not in conflict with the city's
comprehensive plan. He recommended approving the request. Mr. Frodsham
spoke saying that there was not much to add to what Bob said, he will sell the
front parcel to a friend and the plans are to build a 2000 sq. ft. house there and
live in it. Mr. Green asked for any questions there were none. Cindy McBrearty
moved, Dick Sanderson seconded to pass on to city council with our approval on
this request.
Cheval An application of James C. Tanner for preliminary plat approval of nine
lots on Cheval Lane located at the southeast corner of County Rd 3(So. Section
St) and Cty Rd 32 (Marlow Rd). Bob read his comments and said that the lots
vary in size from 3.9 acres to 7.4 acres and will depend upon underground
sewage disposal. That stormwater management is required by Section 804 and
has been certified by the engineer. That this will be a privately maintained street
and no sidewalk plan is required. Bob said the proposal lies within the extra-
territorial jurisdiction of the commission and the county engineer must approve
the plat and plans. That we have been provided acknowledgement of receipt of
plans from the appropriate county agencies. Bob had commented further that
the street must be constructed to specifications and city water mains will be
installed but the county engineer will most likely monitor erosion control. He
recommended a pre -construction conference with the engineer, city and county
officials being a precedent to the granting of preliminary approval to this project
and if recommendations followed, granting approval. Tim asked if Bob reviewed
the County's letter(in file) Bob said no. Seth Moore was present representing
Mr. Tanner and said he was working with the county in reference to the letter.
Cecil asked about possibility of widening the road since they are trying to keep
large estate lots. Seth said he did not know, trying to get a meeting with Kevin
Cowper to go look at it but there are some trees involved that they don't wish to
cut down. Tim Kant moved to grant preliminary approval subject to Bob's
comments and the County's approval. William Richmond seconded and motion
carried unanimously.
Under new business Seth Moore gave out a plat regarding Point Clear Estates
on Highway 98 just south of Bailey's Creek on the East side, one mile south of
County Rd 32. He had a correction plat and said that the property had been
originally surveyed wrong and recorded wrong; that he is trying to straighten out
a title, correct this mistake on paper. He said all the property owners involved
agreed to proposed changes in property lines. Mr. Green asked for any
comments. Further discussion led to a motion by Dick Sanderson for planning
commission to endorse revised plat, Cecil Pitman seconded and motion carried
unanimously
