HomeMy WebLinkAbout01-06-1997 Planning Commission MinutesThe Planning & Zoning Commission of the City of Fairhope met Monday,
January 6, 1997 at the City Administration Building, 161 N. Section Street at
5:00 PM.
Present: Chairman Larry Green; members Cecil Pitman, Cindy McBrearty,
Debbie Quinn, William Richmond, Richard Sanderson, David Bishop. Zoning
Enforcement Officer Robert Lunsford and Secretary Betty Rivenbark.
The minutes of the December 2, 1996 meeting were duly approved on motion by
David Bishop, seconded by Richard Sanderson and unanimously carried.
A public hearing was held on a re -zone request of Charles Earle from R-4 Low
Density Multi -family to B-2 General Business on a 60 foot parcel on the
south side of Nichols Avenue some 270 feet east of the VFW Post. Bob
Lunsford was asked for his comments and he explained that this parcel is a
small part of some 30 acres zoned R-4 when annexed into the city. He had said
most of the property to the west along the south side of Nichols is zoned and
being used as M-1. He said further that land across the street is zoned for single
family patio -garden homes but is presently not developed. That considering the
businesses to the west this parcel is not well suited for single family use, the use
proposed, storage warehouse units is relatively low in its impact on property to
the north and screening may be required as a condition of the building permit to
protect nearby non-commercial areas. Sam Robberson an adjacent resident,
spoke to the commission, asking questions about this proposed project and how
it would affect his property which is outside the city limits. Also about required
fill and could they come to property line, screening requirement, and setback
requirements. After all questions answered satisfactorily, Mr. Robberson said he
was not necessarily against the project. No one was present to represent, it.
Bob said he wanted to be clear that when the zoning change recommended to
the city council and the zoning changed he can do anything he wants to under
B-2. Debbie Quinn said she would not be in favor of this. Mr. Green called for a
motion, there was none forthcoming so this will go forward to the city council with
no recommendation.
Stillwood and Fairfield Place -Unit One Bob commented that both these
parcels had received final plat approval but applicant failed to record the plats
within the sixty days allowed and this was merely to reconfirm previous action.
Cecil Pitman moved seconded by David Bishop to reconfirm commission's
previous action on these two plats. Motion carried unanimously.
Danne Lea Subdivision -Preliminary and final plat approval was being sought
for Newberry Realty, 6 lots on the west side of Danne Road. Some 13.8 acres
lying some 1500 feet south of the intersection of Danne Road and Champion
Road east of Cty Rd 27 and north of Cty Rd 24 outside the City. Bob had
recommended preliminary and final approval subject to 1. certificate for

approval of water system be removed from plat; 2. that there be a note on the
face of the plat to indicate that on site retention of stormwater will be on a lot by
lot basis during the permitting process by the county building department and
the county engineer; and 3. That there be a note on the face of the plat to the
effect that the area is partly in wetlands and that the corps of engineers may
restrict filling and/or building in wetland areas. Bob said he understood from Mr.
Niemeyer that all these notes had been placed on the plat. David Bishop moved
seconded by Cindy McBrearty to approve subject to all Bob's recommendations
being met. Motion carried unanimously.
Bob cited problems in the past in procedures where health department approval
needed so he is now recommending that in the future a release from the Health
Department for issuance of Building permits is sufficient. Cindy McBrearty
moved to approved this recommendation, Richard Sanderson seconded and
motion carried unanimously.
Bob also had presented to the commission a new form that traces the public
hearings from commission to city council, makes a clear paper trail. Richard
Sanderson moved to approve form, Debbie Quinn seconded and motion carried
unanimously.
There being no further business, meeting was duly adjourned.
