I. HTD -Highway Transitional District
1. Intent -The specia l stand ards listed in this sec tion for th e highway tran s ition a l di strict are intended to:
• Provide an alternative to properties a lo ng sta te hi ghways within the City of Fairhope th at are beyond the area
of influence of th e Village Nodes a nd Co mm erc ial Nodes as co nt empl ated by the C ity of Fairhope

• Provide deve lopm ent opportun iti es co ns iste nt w ith th e City's v isio n for co mm erc ia l corridors to bett er se rve
co mmuni ty nee ds .
• U nlik e other di stricts w ithin this sec ti o n, th e HTD is not an overlay di stri ct and do es not affect any prop erty
owners, oth er than th ose who vo luntaril y apply for rezon in g to this district.
2 . Size -Lots sha ll be a minimu m of 20 ,000 s. f. and under 3 acres.
3. Use -Uses fo r the HTD are listed in Table 3-1: Use Ta bl e. Rezoning to HTD may be conditioned so that uses
permitted on appeal require a si te p lan.
4. Location -E li g ibl e lot s must have minimum of I 00 feet on one side fronting th e ri ght s-of-way ofU.S H ighway
98, Alabama Hi ghway I 04, or A laba ma Hi ghway 18 1 and lie within th e Co rporate Juri sdiction of the C ity of

seco nd and/or third floor , and reta il or office space must make up at leas t 50% of the total area of the
building and be located o n ground and/or second floor.

e . A ny freestanding s in gle-use or tenant retail building s ha ll not have a bui ld ing footprint larger than 8,000
square feet.
f. A ll land s w ithin twenty (20) feet of th e boundari es of U.S. Highway 98 , A labama Hi ghway l 04 , and
Alabama Hi ghway 181 with in the corporate limits of th e City of Fairhope are required to be reserved by
owners or de ve lopers of suc h lands as greenspace and tree protection zo nes. Th e required gree nspace ma y
include land as required by the front se tba ck.
1. Wh ere no vegetation, oth er than grass ex ists, new land scap ing and pla ntings shall be in sta ll ed at tim e
of deve lopm ent wit hin th e 20-foot strip th at meet the requ ir ements of th e City of Fairhope Tree
Ord in anc e and receives approva l by th e C ity H orti c ulturi st; otherwise the land may be left in it s natura l
state and enhanced with the addition of tree s and shrub s .
g. Any future rezoning to HTD may be co nd ition ed so that th e goa ls and intent of th e Comprehensive Plan and
Article V ., Section I. I . of the Zon in g Ordinance are achieved.
h . For th e purposes of Article TV , Section B.2.b. and the screeni ng requirements of th e C ity of Fairhop e Tree
Ordinance, th e Hi g hw ay Transitional Di stri ct shall be co ns id ered commercial/business regard less of u se.
