November 4, 1996 at 5:00 PM at the City Administration Building, 161 N. Section
Street in the Council Chambers.
Present: Chairman Larry Green; members Cindy McBrearty, Debbie Quinn,
Richard Sanderson, David E. Bishop, Tim Kant, Cecil Pitman, William
Richmond. Zoning Official Bob Lunsford and Secretary Betty Rivenbark
A public hearing was held on changes to the zoning ordinance (copy attached
with changes outlined). Hop Allen asked to speak and asked for a definition
from the commission on the word "incompatible" in this case used in Section
5.462. Bob offered that it would mean that uses could not coexist together.
Larry Green offered that the Board of Adjustments & Appeals was an avenue to
explore if one had a problem with an issuance of a permit by Mr. Lunsford.Mr.
Lunsford went a step further in explaining the process to Mr. Allen. In this case
Mr. Allen is speaking of the laundry business that was put in his neighborhood
but was zoned for this. Mr. Green called for any further comments from the
commission or audience, there were none. William Richmond moved to adopt
changes and pass on to City Council for their approval, Cindy McBrearty
seconded and motion carried unanimously.
Valentine Bay Estates E. L. Valentine subdivision, 7 lots bounded by Greeno
Road, Gayfer Avenue and Westley Street preliminary and final approval
requested. Bob remarked that there are no new streets required or proposed for
this development. Further that lots 1 and 2 are marginally deficient in frontage
but contain more than the minimum required area of 15000 sq. ft. He
recommended we grant a variance of 0.39 ft(4") for these under Section 601.1.
He recommended preliminary and final approval subject to: 1. street access be
limited in that lot 3 - limited to near the southwest corner thereof, no direct
access to Gayfer Ave. and Lot 7, access limited to near the northwest corner
thereof, no direct access to Greeno Rd. 2. That site grading be such that no
increase in stormwater shall be directed to property abutting development on the
south side. 3. Erosion/siltation control measures must be in place before
beginning site grading operations and 4. Construction materials and operations,
including vehicle parking, shall not impact the public street rights of way.
Betty Barnhill spoke saying she was concerned about any plans that had
egress/ingress on Gayfer Ave. It was pointed out that Bob had put restrictions
on egress/ingress. Richard Sanderson said he would like to commend the
owner for the way he is developing this property. Mr. Green called for any
further comments. There were none. Richard Sanderson moved to approve this
with Bob's recommendations. Debbie Quinn 2nd, motion carried unanimously.
There being no further business, meeting was duly adjourned.
