HomeMy WebLinkAbout08-05-1996 Planning Commission MinutesThe Planning 8, Zoning Commission of the City of Fairhope met Monday, August 5, 1996 at 5:00 PM at the City Administration Building, 161 N. Section Street Present: Acting Chairman Debbie Quinn; members James P. Nix, William Richmond, Larry Green, Jeanette Puckett, Tim Kant. Zoning Officer Robert Lunsford and Secretary Betty Rivenbark The minutes of the July 1, 1996 meeting were duly approved as written on motion by Larry Green, seconded by William Richmond and unanimously carried. The chairman mentioned that the public hearings scheduled for tonight for Mary Ann Lapeze and Norm Wachtl for re -zoning had been continued until the September meeting at the applicants' request. Glen Hardie Farms Final plat approval 16 lots R-1 property located on the south side of Volanta Ave. Bob was asked to read his comments and said that streets, drainage and utilities are being done under the 95-96 Special Assessments Program and installation is assured and payment is secured by a special assessments lien, no performance bond is necessary for final approval. He did note that no building permits can be issued until after the streets and utilities are installed and the project is accepted by the City Council for maintenance. Bob had asked that homeowners documents providing for maintenance of the retention pond be submitted and that such maintenance provisions require that the top of the retention pond dike and the outer slopes on the south and east sides shall not be mowed, stay in a natural state but that this in no way be construed as diminishing the responsibility of the developer or the maintenance entity to protect the drainage control structure against erosion or failure. Also that maintenance provisions require that the riprap shall be safeguarded and replaced as may be required . That an 8 ft. fence be erected to provide a solid visual screen of the dike from adjacent properties to the south. Bob commented that the homeowner's document had been provided and the fence is being constructed(all but 20 ft. complete) that he recommends final approval. Mr. Bachtell spoke saying he understood a drainage ditch would be installed in back of the property owners but this is not being done, something has to be done to protect their property. Ack said that pond was raised a foot and he took the outfall to the north for these 3 lots. That plantings or terrace berms would help control runoff. Jeanette asked if this wasn't a condition of preliminary approval. Bob said by raising the pond they have lessened the runoff, helped the situation, but he would amend his recommendation to make a condition of final approval the installation of terrace berms or plantings. That approval tonight is only allowing plat to be recorded but prior to issuing building permits the city has to accept this for maintenance. James P. Nix moved final approval be given subject to the fence being completed and the berms or plantings being put in. Jeanette Puckett seconded, motion carried unanimously. Planning & Zoning Commission August 5, 1996 - page two The Villas(Quail Creek Estates) Phase 2 Part B Final plat approval was being sought for 16 lots and Bob commented that this would complete phase 2. That plans and installed improvements appear to be in good order and he recommends final approval. James P. Nix moved for final approval, Larry Green seconded and motion carried unanimously. Fairhope Professional Park - Unit 2 This was an informal review of 2 lots at the northeast corner of Greeno Rd and Nichols Ave. Bob had pointed out that in planning access to Greeno Rd for Lot 2 will be limited by the provisions of the Zoning Ordinance for curb cuts and that no direct access to Greeno Rd will be permitted for Lot 1 due to the proximity to the intersection and the safety consideration. That access off of Nichols Street will be allowed commensurate with ordinance requirements. No action was required. Lincoln's Manor Informal review of 7 lots lying south of Gayfer Avenue between Wesley Street and Greeno Rd. This being some 4 acres zoned R-1 and all front on public streets. Bob did note that access to lot 7 will be restricted to the NW corner and no direct access to Greeno Rd will be allowed and access to lot 3 will be restricted tc near the SW corner and no direct access to Gayfer Avenue will be allowed. No action was required. Pelican Pointe Two lots located on the south side of Baldwin County Hwy 1. Bob commented that this first came up at the April meeting and they had 60 days to seek final approval. That the time lapsed and there was some confusion in survey and dates on plat but in order to get the dates running in order he suggested that this come back at this meeting and he is recommending it for final approval. James P. Nix moved to approve, Larry Green seconded and motion carried unanimously. There being no further business meeting was duly adjourned.
