City Administration Building, 161 N. Section Street, Fairhope, Alabama
Present: Chairman Richard Sanderson; members Debbie Quinn, Cindy
McBrearty, Tim Kant, James P. Nix, Cecil Pitman, Larry Green, Jeanette Puckett,
William Richmond. Bob Lunsford, Zoning Enforcement Officer and Betty
Rivenbark, Secretary
The minutes of the April 1, 1996 meeting were duly approved on motion by
James P. Nix, seconded by Debbie Quinn.
Mr. Sanderson recognized a group of residents who live on Greenwood and
were here tonight to talk about the water problems that they are now having.
Barney Barnett spoke saying he lives at 705 Cedar Avenue and that he has lived
there for 11 years and his property has flooded 3 times but none worse than the
4/14/96 rain. That he had 4 inches in his bedroom. He said he sees the city
having 2 problems - one the water coming from the park at Volanta, and the 2
drains that are at the foot of circle in Audubon Place. He showed a series of
pictures of the neighbors houses after the rain and went into the way the water
flowed on each house on his side of the street. He said he feels we need bigger
drains and a spillway so the water can get out. He cited the new subdivision,
Glen Hardie, going in off of Gayfer Street and said when he questioned this
before anything put in he was told the retention pond would be in before any
building in area done. He said he had copy of letter Bob Lunsford sent to Moore
Engineering and how everything Mr. Lunsford had written in letter was being
ignored. At this time Mayor Nix commented that he Mr. Lunsford, Tim Kant and
the engineer had been over to the new subdivision this afternoon and that they
have to get the sewer line in under the spillway pipe and that they are not to do
road construction work until retention pond is in. Further, they went to the
Volanta Park and plan to do something there. That a retention pond designed
for 100 year storm is being built and this should give them some relief. Mr.
Barnett asked where will this water go from retention pond. Mayor Nix
suggested he get with Mr. Moore and look and see where it is planned to go.
Mr. Barnett said this looks good for problem on the north but still has problem on
the south side. The Mayor told what planned for the water coming from the park
area. Elliott Lauderdale of 707 Cedar Street spoke showing a color coded map
which showed how the water flows now. Ack Moore spoke asking them to
visualize where the subdivision lies and that the retention pond will be at the
southeast corner of the subdivision. He told what required and said he had gone
one step further by designing for a 25 year storm and 2 1 /2 ft deep with a
discharge pipe 18" emptying to the north, then release to rubble in a swale ditch.
They planned grass ditches on south property line and grass on east property
line. He heard of the problems and tried to provide, go one step better. Mr.
Barnett asked when start doing work. Ack said they are working now, he went
through the stages that it takes. A man from 603 Cedar spoke saying that the

city should put another like what planned on the north side of Volanta and help
these guys. Mayor Nix spoke saying that these rules were not in effect in 1973
when the subdivision was put in. Mr. Lauderdale asked where the retention
would be from Volanta and was told in the low spot, that it should be a big help
to them. That we did experience a 10 1/4 inch rain in a short period of time, had
flooding all over town and still working on problems. Mr. Sanderson said that the
Mayor and Mr. Moore have explained what the plans are to help correct this
situation and hoped that they had some of the answers they were seeking. That
we would now continue with regular meeting.
Bay Meadows West Unit 2(Callaway Place) This was an application for final
approval on 22 lots on both sides of Callaway Drive at Thompson Hall Road.
Mr. Sanderson asked Bob for his comments and he said this had received
preliminary approval in March 1995 and the conditions of preliminary
construction have been met. He remarked that a name change had been
requested and said the recorded plat should contain sufficient information on its
face to make the facts evident to searchers of title and that the plat and plans
appear to be in order therefore he recommended final plat approval subject to
recording of the documents providing for maintenance of off street storm water
facilities. Mr. Sanderson asked if anyone had any questions or wished to speak
to this. There was no one. Larry Green moved to give final approval subject to
Bob's recommendation, Cecil Pitman seconded and motion carried unanimously.
Sherwood Acres This was an application of Sherri Lemon for Preliminary and
Final Approval on 5 lots on existing Sherwood Highlands Road, south of County
Road 24 east of County Road 27. Bob said this is a graded county road and is
not proposed to be improved. That the county engineer and health sanitarian
have acknowledged receipt of the plat. Further, that the plat appears to be in
good order and he recommends final approval subject to final endorsement by
the County Engineer as required. Cindy McBrearty moved to give preliminary
and final approval subject to final endorsement by county engineer. William
Richmond seconded and motion carried unanimously.
Summer Oaks This was a 14 lot application of Double C Investments for
preliminary plat approval located on the south side of County Road 44 about 1/2
mile west of Cty Rd 27, outside the city. Mr. Sanderson asked Bob to read his
comments. He said that a future unit two of this development would contain
some 12 additional lots. That stormwater calculations have been made for the
entire 26 lot area and would utilize an off site retention pond easement to
conform to requirements. That they would have underground sewage disposal
and that the health sanitarian and the county engineer have been provided plans
by the developer's engineer. Further, that the plat and plan appear to be in

order and he recommended preliminary approval subject to: a pre -construction
conference with developer, his engineer and city and county representatives
before any work begun; and waiver by commission of sidewalk plan requirement.
That the developer does not propose to install sidewalks and land is neither
within nor contiguous to the corporate limits of the city. That the County will
have maintenance. A John Mallory spoke saying he had the property to the west
and that there is an easement on his plat on the east property line. Mr. Calhoun
said he was not aware of easement and that he has not seen anything on the
maps he has researched. It was determined this was FSTC land but Steve from
Fairhope Title and Survey was not aware of this either. Further discussion led to
Mr. Sanderson suggesting that they look into this further and come back at the
next meeting with what they have found. This was agreeable with Mr. Calhoun.
Fairfield Place - Units 1 & 2 Application for preliminary approval of two units
12 and 45 lots respectively. Mr. Sanderson asked Bob to comment and he said
these were a part of the informal review of 195 lots as Creekside bounded by
Booth Road, Cty Road 44 and Cty Rd 13 at the April 1996 meeting. He said the
units proposed are outside the city and not subject to zoning. That the plats and
plans are generally in order including submissions for stormwater calculations
for retention and drainage facilities. Unit 1 will likely rely on underground
sewage disposal but unit 2 is designed for connection to city sewer system by
means of a lift station. He noted that if upgrading of the lift station required it
would be the developer's responsibility. He said that a sidewalk plan would be
in order before preconstruction conference held. He recommended preliminary
approval subject to: a pre -construction conference being held with project
engineer, county engineer and city personnel, sidewalk plan to be reviewed at
that conference; and submittal of legal document to establish a legal entity for
maintenance of off street drainage facilities including retention pond. Seth
Moore spoke asking if they could not get preliminary and final on the 12 lots
since the improvements were in. James P. Nix moved for preliminary and final
approval of the 12 lots and preliminary on the remaining 45 lots. Tim Kant
seconded and motion carried unanimously.
There being no further business meeting was duly adjourned.
