HomeMy WebLinkAbout12-04-1995 Planning Commission MinutesThe Planning & Zoning Commission met Monday, December 4, 1995 at 5:00 PM at the City Administration Building, 161 N. Section Street Present: Chairman Richard Sanderson; members Maxwell Killoch, Cecil Pitman, Tim Kant, Cindy McBrearty, Debbie Quinn, William Richmond, James Nix and Layton Overstreet. Zoning Enforcement Officer Bob Lunsford and Secretary Betty Rivenbark The minutes of the November 6, 1995 meeting were duly approved as written on motion by Maxwell Killoch, seconded by Debbie Quinn and unanimou ly carried. At this time the chairman read a Resolution in recognition of Maxwell Killoch's service on the Planning & Zoning Commission as follows: RESOLUTION WHEREAS, Maxwell G. (Gibby) Killoch has served the City with distinction as a member of the Fairhope Planning Commission for more than ten years since his initial appointment 12 August 1985, and: WHEREAS, Gibby is past Chairman and is currently serving as Vice -Chairman of the Commission, and: WHEREAS, his unflagging enthusiasm and tireless dedication to the welfare and interests of the City has been an inspiration to all who worked with him; NOW THEREFORE, BE IT RESOLVED that the Fairhope Planning Commission recognize the meritorious service of Maxwell G. Killoch and that the Commission Members do hereby wish him well in his retirement and every success in his future endeavors. ADOPTED this the 4th day of December, 1995. Richard L. Sanderson, Chairman ATTEST: Cindy McBrearty, Secretary Cindy McBrearty moved to adopt this resolution and incorporate in the minutes, James P. Nix seconded and motion carried unanimously. A public hearing was to be held on the amendments to the text of the Zoning Ordinance, this carried over from the last meeting. Mayor Nix spoke saying that there is now a parking problem and they will not consider these changes until they get with all parties concerned and come up with a solution and he moved to continue again, Tim Kant seconded and motion carried unanimously. A public hearing on zoning concurrent with annexation on the property of Craig Dyas some 4.5 acres located south of Montrose Woods Drive, north of commercial Lot 177 in Rock Creek was held. Mr. Dyas wished to develop this as R-3 PGH. This was carried over from the last meeting as there were some residents that had questions about the project. Craig said he had met with these people and they are satisfied. Bob said he did not have anything else to offer. Mrs. McClintoc spoke and asked about density. Craig answered that he plans 20 units on 40 x 230 ft lots. It was asked if anyone else present wish to address this. There was no one. Cindy McBrearty moved to recommend approval to the Fairhope City Council, Cecil Pitman seconded and motion carried unanimously. A public hearing was held on a request from Bestor Ward to rezone his propert from B-2 General Business to R-3 PGH High Density Single Family Patio Garden Homes. Bob commented that we suggested the change in zoning before he start his project that he could have developed as B-2 but problems could arise if stayed B-2. Further discussion led to a motion by James P. Nix to recommend approval of R-3 PGH zoning to the City Council on this parcel Debbie Quinn seconded and motion carried unanimously. This property located between Spring Run Drive and Nichols Street off of Greeno Rd. va Planning & Zoning Commission Page two - December 4, 1995 A public hearing was held on a request by Charles Breland for zoning concurr with annexation as R-3 TH and R-3 PGH for some 20.1 acres located off -of Greeno Rd. near Olde Tyme Feed and Fairhope Memory Gardens. Seth Moore spoke for Mr. Breland saying they had provided drawings for the members and he had a video he wished to show on a similar project he had done down at Gulf Shores. He wished to build as pods. A maximum of 147 townhoml was planned. He said they would have 1 entrance into the development with a divided boulevard and landscaped area. He said that they would have 20 acres here so their coverage would not be as much as the other project. Would have a 3 acre lake with the homes surrounding the lake. That the townhomes would be on the south and the patio garden homes on the north side. When he finished Cindy said that she thinks that we already have a lot of patio garden homes in that area now, that this will bring a lot more traffic and problems in this area, that she would like to study more before making a decision on this and moved to hold this over until the next meeting to consider the problems, impact on Greeno Road and look at the number of units we have in that area now. Maxwell Killoch seconded and motion carried unanimously. Pioneer Trace An application of Emily King for Preliminary and Final Plat approval of 6 lots on the west side of Cty Rd 24, approximately 3/4 mile east of Cty Rd 27. Bob had comments that the lots lie outside the city on existing county road and contain about 30,000 sq ft. each. That the engineer has certified that the design meets the county's regulations for maintenance and he recommended preliminary , and final plat approval subject to the County Engineer's approval before recording. Cecil Pitman moved to approve subject to Bob's recommendations, Maxwell Killoch 2nd and motion carried unanir Little Pine Run An application of Dale and Mary Younce for a two lot resub- Jivision of part of Lot 3 of Pine Run lying along south side of Cty Rd 24 ust east of Cty Rd 3 outside the city limits. Bob recommended Preliminary and =final Plat approval subject to Cty En(jineer's approval before recording. :onnie Murphy King and Joseph Harrison adjoining property owners asked iow this would affect their property and it was explained they were dividing )ne lot into two and would not affect them. Debbie Quinn moved to approve subject to Bob's recommendations, Maxwell Killoch 2nd and motion carried unani- nously. in informal review was held on Greystone 91 lots of about 21000 sq ft each sought up by Tipper Williams property outside the city west of Cty Rd 3 nd south of Lakewood Club Estates Unit 6. Bob had commented that the evelopment is subject to the stormwater management provisions of the ubdivision regulations and county engineer, that the developer should expect :) meet all requirements of the regulations and provide minimum 60 foot ights of way unless waived by the county. A sketch plan had been presented nd Seth Moore explained that 2500 sq ft homes were planned for first phase 000 sq ft homes planned for 2nd phase, some wetlands but they will try to esign around them. No action was needed and planned looked all right to ommission. 'oint Clear Tennis Club This was an informal review of property north side if Cty Rd 32 about 600 ft west of Cty Rd 3 Arendall Estate. Bob had said his lies outside the city but developers propose to connect to city sewer by â–ºumping arrangement. Bob had said although privately maintained the streets lust be designed to conform to the subdivision regulations and this noted on he plat. That the development is subject to the stormwater management provisio end county requirements. Upon looking further at what presented there was lore to the development than the 13 lots thought. No action was needed and he developer was told they could bring in preliminary plans next time. uthside PUD this was Charles Breland's and was part of zoning request that held over for 30 days. usl Planning & Zoning Commission page three - December 4, 1995 A discussion was held on Thomas Hospital's plans to allow a tenant to construct a new building on the west side of the hospital connected to the hospital and used as medical offices. The building is planned to be as much as four stories high. Bob said this for information purposes, no action needed, that the plans will have to conform to all requirements of the building and fire codes and state regulations. Destrehan - Development by Mr. Avant. Bob had informed the commission that he wishes to post a performance bond and have his plat finalized so he can convey lots. He said that the amount of the bond must be equal to 100 percent of the engineers estimate cost of streets, utilities and drainage improvements. He said further that on showing of proper bond he recommended that final plat be executed for recording with the developer understanding that lots can be sold but no building permits issued until actual completion of streets and utilities and acceptance by the city council. There being no further business, meeting was duly adjourned.
