HomeMy WebLinkAbout08-07-1995 Planning Commission MInutesThe Planning & Zoning Commission of the City of Fairhope met Monday August 7, 1995 at 5:00 at the City Administration Building, 161 N. Section Street Present: Chairman Richard Sanderson; members Maxwell Killoch, Tim Kant, Layton Overstreet, Cindy McBrearty, Debbie Quinn, Cecil Pitman, James P. Nix Zoning Enforcement Officer Bob Lunsford and Secretary Betty Rivenbark The minutes of the July 3, 1995 meeting were duly approved as written on motion by Maxwell Killoch, seconded by Debbie Quinn and unanimously carried A public hearing was held on the revised Comprehensive Plan that had been presented for consideration. Mr. Sanderson recognized Don Brady, Director of South Alabama Regional Planning Commission who showed a slide presentatio that explained how South Alabama had arrived at their recommendations. He said this was developed with the intent of preserving the uniqueness and quality of life that Fairhope now has. When he was finished with his presenta- tion he commented that there is adequate zoned land in the City now(residen. comm) to last until the year 2010. He said that we need to recognize that development will occur - not be able to stop growth, the key is to develop a plan to control the growth. Mr. Sanderson thanked Mr. Brady, and re- marked that in the comprehensive plan the 1st hundred pages explains how they got the results and page 101 deals with land use and he thinks that is what most present tonight are interested in. He called for comments from the audience. Several spoke - Mr. Henson asked how we plan to use the document, how much it cost the tax payers and will we deviate from it. Mr. Sanderson answered it is a guideline, the cost was $16,000 and it is not cast in stone, just a guideline, every proposal will be considered on its own merits. Ms. McClintoc spoke and gave the commission results of FIG group sessions. She also handed out new letter with 10 new recommendations for the commission to consider(in file) . She mentioned the 7 items she had previously recommended (letter in file) that the city bounderies be straightened, that the proponent of a public hearing be present, when an application present- ed for consideration that a site plan for use be presented, that a zoning change be rescinded after 1 year if work not started, that a sign be posted on land where zoning proposed, that the agenda be published and nameplates for mem er Mr. Sanderson thanked her for her hard work and her interest in these matte s. Judy Carlburg asked if there had been changes made on the comprehensive plan or map - the answer being none. Vernon Bodden questioned where we ' draw the line when we say south of Edwards Avenue. Mr. Stipes asked will controlled growth hurt the City of Fairhope(no) and also asked if the plan adopted will there be any changes. Richard Sanderson responded that this is a guideline, not cast in stone. Mr. Sanderson asked again if any questions from the audience. There were none. Mr. Sanderson said he would entertain a motion. Maxwell Killoch moved to adopt the comprehensive plan as submitted. Debbie Quinn seconded motion and it passed unanimously. Tim Kant said he would like to say that he thinks the commission needs to address the issues that have been brought up. Dick Sanderson said that there are committees working on some of them now. Mr. Sam Crosby and Troop #47 Boy Scouts were recognized. They were pres working on their merit badge. Point Clear Court Bob commented that this is 16 lots located off of Old Battles Road outside the city. That preliminary approval had been given in October of 1994, they were seeking final approval. He recommended approval subject to acceptance by the County Engineer. A Lee Maloney spoke saying a tree on her property, which is next to the subdivision; had been cut. She was referred to Mr. Rester, the engineer who was present tonight. He said he would look into it. Tim Kant moved to approve subject to County Engineer approval, the material on this lady's lot being cleaned up and getting with the lady on her tree. Maxwell Killoch 2nd and motion carried unanimously. Is Planning & Zoning Commission - August 7, 1995 Page two Dominion Farms Unit One - Final plat approval of 47 lots south of US Hwy 98 near Cty Rd 27. Bob commented that they received preliminary approval April 3, 1995. The plat appears in order but streets are subject to acceptance by the County Engineer and he recommends approval subject to that. A Mike Hollis spoke saying he is an adjacent property owner and expressed his concerns about what they are proposing and how it relates to adjacent property owners. Mr. Sanderson explained that we have planning jurisdiction and he has to meet subdivision regulations but we have no control over zoning. He suggested Mr. Hollis talk with the developer and county commissioners. We agree it would be a good practice for them to get in touch with their neighbors Cecil Pitman moved to give final plat approval subject to the County Engineer's approval. Maxwell Killoch 2nd and motion carried unanimously. (improvements Performance Bond on File) A sketch plan of Bestor Ward for informal review of 35 residential lots off of Spring Run Drive in the city east of Greeno Road was considered. The land currently is zoned B-2 and has been since 1972 and is surrounded by B-2-M1 district. Bob said there is no overriding need to develop this as residential property and if zoned changed we would have to just seek B-2 zoning in anothe area. Charlie Ingersoll spoke saying that he has M-1 property next to this and he can envision houses being built here and then receiving complaints abou the noise the M-1 business makes that B-2 is an excellent buffer between M1 and residential. No formal action was taken on this but it was expressed that the consensus of the commission was they would not look favorably on this to proceed at own risk. There being no further business to come before the commission meeting was duly adjourned.
