1995 at 5:00 PM at the City Administration Building, 161 N. Section Street
Present: Vice -Chairman Maxwell Killoch; members Tim Kant, Cindy McBrearty
James P. Nix, Layton Overstreet, Debbie Quinn. Betty Rivenbark
Secretary and Bob Lunsford, Zoning Officer
The minutes of the June 5, 1995 meeting were duly approved on motion by
Debbie Quinn seconded by Cindy McBrearty
Southside Business Park - Con'd from June 5 - Application of Charles Breland
for Preliminary Plat Approval-10 commercial lots on Greeno Rd. Seth Moore
represented Mr. Breland saying he had brought back again this and showed
3 turnouts and is asking for 1 additional curb cut for access to the develop-
ment for the service road. He said he has shown this to Bob Lunsford.
Mayor Nix asked if this is all that we are considering now, Seth said yes, he
plans to put modular homes to the rear of this development later. -Tim Kant sai
he would like to have Bob's opinion. Bob said 4 is not unreasonable and
he recommended approval subject to approval from the Alabama Department of
Transportation and the designation limitation of access being shown on the
final plat approved for recording as conditions precedent to such approval.
Also, that the developer is advised that off-street parking and loading/un-
loading requirements will be required prior to issuance of any building
permits. Mrs. McClantoc spoke from the audience saying that we should
not be considering anything on Greeno Road until the comprehensive plan
adopted, why are we approving this. It was explained that this is outside
the city limits. She was told that if he satisfies the subdivision regulations
there is no reason why he cannot do this, no zoning regulations in the county.
Bud Henson asked what can city do, the Mayor said just zone in the city limits.
That they had asked the state to give the cities the right to zone in the police
jurisdiction and they consistently refused to do so. A Judy Carlburg asked
what could the citizens do. They were told talk to their representatives.
James P. Nix moved to approve subject to Bob's recommendations. Cindy
McBrearty 2nd and motion carried with Tim Kant, Cindy McBrearty, James Nix,
Layton Overstreet for the motion and Maxwell Killoch and Debbie Quinn against.
Destrehan S/D - Preliminary Plat approval 67 lots, Harold Avant. Ack Moore
spoke representing this. Mr. Moore said that this is in the city limits, they
are going to have curb and gutter and is zoned R-2 and will have a holding
pond. The big question is how does it impact Booth/Bishop Road. Ack
showed the commission contour maps that showed the natural waterflow and
said they have to design where no more water be on the land than what there
now. A gentleman who owns land near this asked about the pond - Ack said
it is going to be a dry pond, not hold water. Bob had withheld comment until
further information provided. He had commented that he needed a general
drainage plan showing all facilities and how they interrelate and a delineation
of the drainage areas on the contour mapping(this is what he provided tonight)
He also commented that to do anything which would increase the hazards
associated with Booth/Bishop Road and its drainage was not in the interests
of the Commission or the City at this time. Ack further said that they have de
signed greater than pond capacity so no water would stand on the property.
An Arston Grant spoke saying he is on the south property line and the way
the waterflow is now there is a dry creek bed, his concern is whether or not
this will be marsh all the time. James Nix asked Ack how long would it take
to empty the pond, Ack responded at peak runoff 21 minutes.. Tim asked
about the planned planted area at the entrance,would they plant & maintain, yes
It was asked what planned about sidewalks and the developer said he is putting
them in. Bob said he saw no residual problems. Tim Kant moved to give
preliminary approval, Cindy McBrearty seconded and motion carried unanimously
Idlewild-Unit 1 Application of FSTC/Sara Klumpp for 8 lots along Thompson
Hall Road at Cty Rd 48(pending zoning change) Bob had commented that plat
and plans appear to be generally in order. Jeff Kennedy addressed the
commission and said he represented ABK Development/Mrs. Klumpp and is here
to answer questions. Tim Kant suggested preliminary approval subject to zonii
change. Debbie Quinn 2nd and motion carried unanimously.

Campbell Estates Preliminary and final approval was being sought for this 3 lot
subdivision located on the south side of Fairhope Avenue some 200 ft. east
of Clay City Road outside the city limits. Bob recommended approval subject
to health department and county approval. Tim Kant moved for approval,
Maxwell Killoch seconded and motion carried unanimously.
Havel Estates A 3 lot subdivision on the south side of Fairhope Avenue some
900 ft east of Clay City Road outside the city limits was considered. Bob
recommended approval subject to health department and county approval. Max-
well Killoch moved to approve subject to Bob's recommendations, William Rich-
mond seconded and motion carried unanimously.
Crescent Point 13 lots on the north side of County Road 1 at Fish River
Point. Final plat approval was recommended by Bob subject to
1. health department and county approval; 2. A prominent note on the plat
to the effect that all buildings must conform to the flood damage prevention
ordinance/s; 3. that the wetlands area be prominently shaded and a note
affixed to the effect that no fill may be placed therein without written
approval of the Corps of Engineers; 4. a certificate of lienholder(if any)
appearing on the plat. Bob's comments were noted(attached) and William
Richmond moved to approve subject to 4 things outlined. Maxwell Killoch
seconded and motion carried unanimously.
Gainswood Unit 1 This is a 45 lot subdivision of Kimmer Development Co.
Preliminary approval was being sought. This is outside the city limits. Bob
had commented that the plat was in good order but the engineering plans
relative to stormwater retention were not complete at the time of his writing.
He recommended that the county stormwater management could apply. Possibly
hold over until next meeting. Frank Crawford of McCrory & Williams spoke
asking for preliminary approval subject to County Engineer's approval. Tim
Kant moved to grant preliminary approval subject to county engineer's approval
on stormwater. Maxwell Killoch seconded and motion carried unanimously.
Green Island Estates An informal review of proposed 26 lots on the south side
of Fairhope Avenue submitted by Lee Stahl for use as patio garden homes.
Tommy Harris spoke for the Stahls. He said they are doing a feasibility study
and that these homes would contain some 12-1400 square feet. He said they
are looking real close at the stormwater detention and that this will determine
whether they will go forward with the project. No action was needed but
they were encouraged to proceed.
Bay Meadows West - 12 lot subdivision of Rudolph Khrut for preliminary and
final approval on the north side of existing Bay Meadows Avenue. Bob had
commended that the plat was in order and he recommended preliminary and
final approval. James P. Nix moved for approval, Maxwell Killoch seconded
and motion carried unanimously. Mrs. Stanfield spoke saying she objected
to what proposed, that they have 12 houses now on 1-2 acre lots and what
proposed is not in keeping with the neighborhood, since this has been paved
it has become a thoroughfare. Bob pointed out that it meets the subdivision
requirements and we cannot turn it down because of complaints, we cannot
dictate how they develop the property. They asked what they could do to
protest further and they were advised to see a lawyer. Mrs. Stanfield said
she wished they would have 1 street and all lots exit on this street and
then go to main thoroughfare. She was told we had no control over this.
It was brought out that they meet R-1 requirements and plan homes with 1500
square feet of living area.
The Homestead Bob had commented that the owners propose a change in the
preliminary plan to increase the density and change the use proposed as set
out by relocating the CALF buildings from the northeastern part to the
eastward portion and nine condominium single family structures be incorporated
in the site. Further that the architect has certified that the total site
density allowable will not be exceeded by the inclusion of those units. He
recommended approval with final plan submission by September meeting.
Tim Kant moved to revise preliminary plan, Maxwell Killoch seconded and
motion carried unanimously.

Idlewild - Unit 2 Application of FSTC/Sara Klumpp for 34 lots along the sout
side of Cty Rd 48 near Thompson Hall Rcl(area pending zoning change)
Bob had commented plat and plans appeared in order and recommended
preliminary approval with the establishment of legal entity for maintenance of
off street stormwater facilities and pre -construction conference. James P. Nix
asked why 2 presented now, Jeff said in Unit 1 all utilities in place except
sewer and they can work very quickly, also they will require sidewalks.
There was some question as to R-1 or R-2 being asked for in Phase 2 but
Bob said there was little difference - R-1 being the more restrictive with
40 ft. front yard and R-2 with 35 ft. front yard. James P. Nix moved
Layton Overstreet 2nd approval subject to Bob's recommendations.
Under old business - Bob had attached 2 letters(in file) regarding Old Orchar
Estates- the County Engineer has approved 50 ft. street rights of way and
regarding South Bayou Circle - County Engineer said subdivision lies in
zoning district 26 and that the county will not allow plat to be filed or con-
struction to begin until the plat conforms to zoning district requirements of
county.
