HomeMy WebLinkAbout06-05-1995 Planning Commission MinutesThe Planning & Zoning Commission meeting of the City of Fairhope was held Monday, June 5, 1995 at 5:00 PM at the City Administration Building, 161 N. Section Street Present: Maxwell Killoch, Tim Kant, Debbie Quinn, Cecil Pitman, James P. Nix, Layton Overstreet, William Richmond. Betty Rivenbark, Secretary, and Bob Lunsford, Zoning Officer The minutes of the May 1 1995 meeting were duly approved as written. Don Brady of South Alabama Regional Planning Commission presented the first - draft of the proposed update on the comprehensive plan for the city. He commented that no one on the commission has had time to review it. James P. Nix moved to accept it and take it under advisement. Layton Overstreet seconded and motion carried unanimously. A public hearing was held on a request for zoning as R-5 High Density Multi- family Residential concurrent with annexation for the lands of Virginia & Paul Cumbie, 4 acres located off of Highway 27 just past Quail Creek Drive. Jerry Boyington was present representing Mrs. Cumbie who he remarked had to leave town due to a death in the family. He passed out a drawing and remarked that a Jim Fletcher had made an offer on the property contingent upon the outcome of the public hearing and annexation request. It was pointed out that from the drawing he had presented he was really requesting R-3TH not the R-5 that was advertised. Jerry said with this plan they-- were trying to reach the young people, that there is not a market for homes in the mid -price range that would be for young couples. It was also pointed out that this being in the county could be developed this way without coming into the city. They showed on the plans the only access road being on Quail Creek Drive. Debbie Quinn questioned if there was not other acreage around that he could buy and put these on. Jerry pointed out that there was now situations where families in the area had put 2 or more homes on -their acreage. Tim Kant questioned whether or not he had the city's permission to tie into their road. Jerry said this was a technical error. Bob had commented that this exists outside the city and there are no zoning constraints upon its use nor any limit imposed on the number of structures which may be constructed thereon. Being Lots 5 and 6 of Fairhope Acres, a residential subdivision. The surround ing neighborhood being used as agricultural/single family residential. He said further that he recommended denial of this request. Bob said he had revie e< this as R-5 request and that if he is requesting R-3TH that it may have to be re -advertised or put off until another meeting. Maxwell Killoch asked Bob if he was saying hold it over and Bob said yes. Mr. Killoch said this could be annexed as R-1 and then a re -zoning request could be presented at a later date. Comments from the audience were requested. A Maxine Gressler spoke saying that as a resident from Quail Creek Estates they were concerned about the access, already too crowded now. She presented a petition signed by 104 residents that said they were opposed to the re -zoning request and they felt the impact on their subdivision would be negative, that a jump from rural to R-5 is hardly ever in the best interests of the adjacent properties. A gentle- man from the audience spoke saying that the fact that he could be zoned as R-1 now and come back later with a re -zoning request did not seem quite right. Jerry spoke again saying that before they go any further he wished to consult with the owner and contractor and Bob Lunsford. He asked that it be postponed at this time. Another gentlernan , spoke saying that there is no multi -family in the area that he would go along with 4-5 lots but did not like multi family. This was postponed for re -advertisement when decided what they wish to apply or A public hearing on a re -zoning request from R-A Rural Agriculture to R-2 Low Density Single Family Residential for the property of Sara Klumpp(FSTC) some 16.62 acres located at -the 'intersection of Fairhope Avenue and Thompson Hall Road was considered. Bob commented that his key consideration was a matter of density. That this is a relatively small area considering the amount of property that the Klumpp's have leased. He said we need to take a look at this along with the comprehensive plan presented and see if we have all the development we need for the next 5-10 years. Geoff Kennedy said he is working with Mrs. Klumpp, that she looked at Pecan Trace and wished to patter something like that, each lot would have 15,000 sq. ft. Further discussion led to a motion by James P. Nix to recommend approval of this re -zone request to the City Council from R-A to R-2, Layton Overstreet 2nd and motion carried unanimously. Page two - June 5, 1995 Planning & Zoning Commission Eastgate - Unit 5. Final plat approval was being sought for 9 lots on Troyer Court. Seth Moore represented Mr. Roberds and said that this had been granted preliminary approval in September 1994. Bob said that the plat and plans appear to be in order and he recommended final approval. Cecil Pitman moved for final approval. William Richmond 2nd and motion carried unanimously. Scarborough Fair - An application of Charles Earle, Jr. for preliminary approva on 23 lots east of Spring Run and Cottage Drive. Proposing on Lots 6-23 Patio Garden Homes and Lots 1-4 Professional offices with Lot 5 being reserved for low density multi -family. Bob had commented that lots 1-4 are zoned B-4 and the remaining lots are in the R-4 district. That single family is a use per- mitted of right in the R-4 zone and the ordinance provides that patio garden homes may be intermingled with other types of housing. Further that the plat and plans appeared to be in order and he recommended preliminary approvE subject to a preconstruction conference. Cecil Miller of the VFW spoke saying they are not against progress but that he is concerned as behind the VFW is marshland. Ack Moore spoke for Mr. Earle saying they had planned to have a holding pond and drain this low area and have stormwater runoff. That they plan to clear it out and deepen, drain into pond and run 'down to Bishop Road. Mr. Miller was told that before this is accepted the engineer had to prove that he is not putting anymore runoff than what is there now. That B-4 would be good transformation. Charlie Earle spoke saying that Lot 5 would be an assisted living nursing home and showed pictures of what he hoped to build. Further discussion led to a motion by Cecil Pitman that based on Mr.-Moore's engineering reputation and Bob's comments that we grant preliminar approval subject to the preconstruction conference. Debbie Quinn seconded and motion carried unanimously. Meriwood S/D - 14 lots on County Roads 24 & 27 - Preliminary and final plat approval was being sought. Bob said that the lots abut:. existing county roads and the project engineer has certified the impact of drainage. He recommended approval subject to County Engineer's approval for recording. William Richmonc recommended approval, Cecil Pitman seconded and motion carried unanimously. Old Orchard Estates - Preliminary Plat Approval 12 lots, Wayne Feenker on the east side of US 98 north of Cty Rd 32. Bob had commented the plat and plans generally in order, he questioned the 50 ft. right of way shown. Geoff Kennedy spoke saying he had changed that to 60 ft. A motion for preliminary approval subject to plans being submitted to the county engineer for review and a preconstruction conference being held was made by Tim Kant, seconded by William Richmond and unanimously carried. Southside Business Park -Application of Charles Breland for preliminary plat approval of 10 commercial lots on Greeno Rd. Bob had commented that this proposal is for commercial development and will likely result in a considerable number of traffic movements per day per lot. That the relatively narrow frontage of the lots is not conducive to allowing ten different access points to Greeno Road and is not compatible with public safety. Therefore, the developer must either provide for private service drives along the lot fronts from one central point of access to Greeno or must provide alleys along the rear with rear parking from a central access point. He recommended that this be continued until the developer resubmits a plan showing acceptable access to Greeno Road and how off-street loading and unloading requirements will be accomplished. Maxwell Killoch said he would like to see how it fits into the masterplan. Cecil Pitman said he is opposed to all cuts on Greeno Rd. Tim Kant agreed. Debbie Quinn said she would like to see the masterplan. Seth Moore spoke and said that lots 1-2, 3-41-r 5-6 would have joint egress/ingre and the south 3 lots were one owner, have a planned boulevard, planned retention with a lake. Further discussion led to a motion by James P. Nix. to continue this until it conforms to Bob's recommendations. William Richmond seconded and motion carried unanimously. ;s Page three - June 5, 1995 Planning & Zoning Commission— South Bayou Circle - Application of JMR, Inc for preliminary and final approval of 13 lots abutting existing Bayou Circle. Bob had commented that no paving plans had been submitted and to approve this would be contrary to the purpose and intent of the regulations both city and county even though this is in the county and would be county maintained. Craig Dyas asked if they got a letter from the county saying they will maintain it would we accept it and override Bob. Bob said he had talked to Wendy Allen and that she seemed to think an assessment program could be done the county had that perogative. Tim Kant said he would like to see something in writing. Craig said would we accept something saying they would waive the paving requirements and accept maintenalice. Art Thomas asked to speak and said that there exists on the north side of the road a 20 ft. buffer zone and he would like to see the paperwork and further how did he go around District 26 zoning regulations that require 40,000 sq ft. Craig said 20 ft. strip is of no consequence to this commission and if this is District 26 the county would address that. Bob said he did not expect we would approve if we had notice that this is in District 26 as it is entirely county authority and county issue. Further discussion led to a motion by Tim Kant to give preliminary approval if he has in writing something waiving the county road requirement and if it meets approval of district 26 requirements. Debbie Quinn seconded and motion carried unanimously. Destrehan subdivision - informal plan review some 66 lots for residential development . Bob had commented this land was formerly a part of the masterp an of River Oaks subdivision but not a part of the preliminary plat. He had a problem with the circulation as shown on the plan presented for streets. Further that drainage to Booth Road an important issue. He recommended that the dev- elopment be phased so that drainage not impact others. Ack Moore presented a map that had countours that showed the water flow and said the county has replaced the culverts on Booth Road. He said they would run the water 2000 ft to those. James P. Nix questioned if the watershed a part of this and Ack said no, goes to the watershed. Bob said again relative to good planning the circulation pattern was not good. Debbie Quinn asked about having some greenspace, Mr. Destrehan said they would be large lots. Cecil Pitman suggest d shorter streets also. There was no formal action taken on this at this time. Seth Moore asked if under old business what about the Breland re -zoning. Maxwell Killoch said we are holding it until we had time to look at the compreh sive plan. Mr. Breland addressed the commission and tried to explain that these proposed units would be set on fixed foundation 14-16,000 sq feet, factory built and shipped in. They were asked to come in next month and see what they propose. There being no further business meeting was duly adjourned.
