PUBLIC HEARING for Zoning concurrent with Annexation:
Application/Petition of Virginia and Paul Cumbie to
establish zoning as R-5, multi -Family Residential for
four acres at County HIghway 27 and Quail Creek Drive:
Cumbie proposes to build a 44-unit multi -family complex
on the property. Although not accessible to the complex,
the property does have frontage on Quail Creek Drive,
which could, using allowable areas from R-5, permit as
many as 70 units on the property.
As the property exists outside the City, there are no
zoning constraints upon its use, nor is there any limit
imposed on the number of structures or units which may
be constructed thereon.
The subject property is Lots 5 and 6 of Fairhope Acres,
a residential subdivision. The property in the
surrounding neighborhood is in use as agricultural/single
family residential. There are no existing multi -family
uses and to establish such would run counter to the
existing land use pattern and, ultimately, to the City's
comprehensive plan which is based in part on existing
and projected land use.
I would suggest that the Commission forward its report on
this item to the City Council, recommending that the
Council continue its policy of accepting unsolicited
petitions for annexations with automatic zoning applying
as provided in Section 8.8 of the Zoning Ordinance, but
that the zoning requested concurrent with petition in this
case be denied.
