HomeMy WebLinkAbout05-01-1995 Planning Commission MinutesThe Planning & Zoning Commission of the City of Fairhope met Monday, May 1, 1995 at 5:00 PM at the City Administration Center 161 N. Section Present: Chairman Richard Sanderson; members Tim Kant, Cindy McBrearty, Debbie Quinn, Maxwell Killoch, Cecil Pitman, William Richmond, Layton Overstreet, Bob Lunsford ZEO and Betty Rivenbark, Sec. The minutes of the April 3 and April 10 meeting were approved on motion by Maxwell Killoch seconded by Debbie Quinn and unanimously carried. A public hearing was held on a request for zoning concurrent with annexation on the property of Charles K.(Buddy) Breland, Jr. some 24 acres fronting on Greeno Road located between Old Tyme Feed and Fairhope Memory Gardens 4.1 acres as B-2 General Business and 20.1 acres as R-6 Mobile Home Park District. Mr. Sanderson asked Bob to relay his comments. He remarked that the developer is made aware that site drainage plans will be required to demonstrate to the City's complete satisfaction that differential storm - water runoff from the site will be zero or less. Further, that the access to Greeno Road will be restricted and he may have to install service drives. He said the proposed zoning is a logical progression of zoning existing to the north and is not in conflict with the city's present comprehensive plan. Mr. Sanderson called for comments and Harold Avant spoke saying he had just bought some 30 acres to the rear of this land and that he plans a medium housing project and that he is opposed to trailer park going here. Mrs. McClantoc spoke saying that there is no one present to speak to this. (Mr. Sanderson had asked if anyone was here to represent this and there was no one) That it would do no good to voice concerns if there was no one here, further, that the other re -zoning applicants on Greeno Road were told to wait on the comprehensive plan and she thinks we should do the same on this. Cindy spoke saying that as stated we are waiting on the compre- hensive plan, that this was recommended use 5 years ago but we need to take a look and see if there is a need for this now. Richard Sanderson spoke saying due to the fact that no one is present to represent this that he rules that this be held in abeyance until the plan is presented and we have a chance to review it. Gene Tillman spoke saying he has the mobile - home park next to this and he continues to vacancies from time to time does not see a need for this, it would be an eyesore. A Booker Waters spoke saying he has the land directly across the street and he has been offered money for it but if a mobilehome park goes i-n he feels the value of his property will definitely go down. Tim Kant pointed out that this land is not zoned now and that if Mr. Breland wanted to he could start his project tomorrow as there are no restrictions on it from the County. Mrs McClantoc spoke again asking why we could not straighten out the boundaries of the city limits. Mr. Sanderson asked her if she had concerns would she please put them in writing to the commission and they would be addressed. A Mr. Henson said that a lot of things are being put off would the public be informed when these come up. Mr. Sanderson said once the comprehensive plan is received we would have study sessions and then a public hearing and also the city council would have a public hearing so there would be time for public input when these meetings are held. The Villas(Quail Creek Estates) Phase 2, Part A and The Villas(Quail Creek Estates) Phase 2 Part B was considered. - Phase 2, Part A Bob read his comments in which final approval for 12 lots is being sought. He said preliminary approval was granted at a special meeting of April 10 and test reports for improvements have been received. He recommende< final plat approval subject to the Gen. Supt's inspection and approval of installed improvements and the developer has been informed that a maintenance bond for 30% of the improvement cost is required in order for the city council to accept improvements for maintenance. Tim Kant moved for approval subject to Bob's comments. Maxwell Killoch' seconded and carried unanaimously. Phas 2, Part B - Preliminary Approval - Bob said stormwater provisions apply and retention is to be provided and certified by project engineer. He recommen ded Preliminary approval subject to pre -construction conference on site. Maxwel Killoch moved for approval subject to Bob's comment. Tim Kant seconded and motion carried unanimously. There being no further business, meeting was duly adjourned.
