HomeMy WebLinkAbout04-03-1995 Planning Commission MInutesThe Planning 8 Zoning Commission met Monday, April 3, 1995 at 5:00 PM at the City Administration Building, 161 N. Section Street. Present: Chairman Richard Sanderson; members Maxwell Killoch, Cindy McBrearty, Debbie Quinn, Layton Overstreet, Cecil Pitman, William Richmond The minutes of the March 6, 1995 meeting were duly approved as written. The continuation of the public hearing on Charlie Earle's request for zoning concurrent with annexation was held. Mr. Earle had modified his application for zoning to show 27 acres zoned as R-4 Low Density Multi -Family and 2.5 acres to be zoned as B-4 Business and Professional Offices. He had deleted his earlier request of B-1 from the application. Mr. Sanderson commented that the commission had had a study session before this meeting and had a good understanding where they are. Mr. Sanderson called for comments. There were none. He called for a motion and Cecil Pitman moved to recommend approval of this request to the City Council for further action. Maxwell Killoch 2nd and motion carried unanimously. Windmill North Application of FSTC/Michael Wesley for 3 lots on north side of Windmill Road, E. of Cty Road 27. Bob had commented that the lots abut an existing county maintained road. That stormwater provisions do not apply and the plat appeared to be in good order therefore he recommended preliminar and final approval. Mr. Sanderson called for comments, there were none. Maxwell Killoch moved to approve request, Cindy McBrearty seconded and motion carried unanimously. Dominion Farms Unit One This was an application of Dominion Farm Partners for Preliminary Plat Approval of 47 lots south of US Highway 98 near Cty Rd 2, outside the corporate limits. Bob had commented that the plat appeared to be generally in order except of the surveyor's certificate owning to a change in surveyors. He said stormwater management had been addressed and certified by the engineer- and that they proposed to install ribbon curbs which he saw no problem with. He said the more restrictive regulations would apply, either city or county. He recommended preliminary plat approval subjec to the following: 1. Surveyors certificate executed; 2. Review of maintenance provisions by city attorney for off-street storm drainage; 3. A pre -con- struction conference on site with the developer, his engineer, the planning officer, county engineer and city's water superintendent William Richmond moved for preliminary approval subject to Bob's comments. Cecil Pitman 2nd- and -motion carried unanimously. The Villas(Quail Creek) Phase II Ack Moore spoke on this saying they were seekina partial final plat approval on 12 lots only. He said they had stopped in the middle of the project but that all utilities had been put in. Bob had commented that preliminary approval had been given on 28 lots in August of 1994 with provisions for storm water retention. That they are apparently seeking approval on a partially completed project in order to begin construction of houses but permits cannot be issued until the streets and utilities are accepted by the City Council. Further, if the commission elects to approve the partial plat for recording, the developer should post a financial bond for completion of the remaining street and utility construction and for the installation of all stormwater facilities. Bob said he would decline to give partial approval best to let it follow through. Dick Sanderson called for comments or a motion. Cindy McBrearty moved to deny until they come back with all the lots and everything completed. William Richmond seconded and motion carried unanimously. Under old business Bob had brought up the 7 lots that were given preliminary approval on Hartshorn Place and they are requesting final, that final could be granted but it should be subject to the completion of the documents for stormwater maintenance and maintenance of the development. Cindy McBrearty moved to give final approval on these 7 lots subject to presenting the stormwater maintenance plans and required papers on the maintenance of the development. Maxwell Killoch 2nd and motion carried unanimously. There being no further business, meeting was duly adjourned. r - A special meeting of the Planning & Zoning Commission was held Monday, April 10, 1995 at 5:00 PM at the City Administration Building, 161 N. Section Street Present: Chairman Richard Sanderson; members James P. Nix, Maxwell Killoch, Cecil Pitman, Layton Overstreet, Cindy McBrearty, Debbie Quinn, Tim Kant. Betty Rivenbark & Bob Lunsford Mr. Sanderson spoke saying the sole purpose of the meeting tonight was to re -consider the Villas - Quail Creek Phase II which had been denied at the regular meeting held Monday, April 3, 1995. Seth Moore of Moore Engineering was present to represent Doleen Corporation. Mr. Sanderson asked Bob about his comments. Bob said that he had suggested to the developer that he bring to the Planning Commission a plat of 12 lots for restatement of preliminary approval of Part 1, Phase II of the The Villas at Quail Creek, and recommended preliminary approval of same. Further, he suggested that the developer present for the May meeting a Final Plat of the 12 lots in Part I of Phase II with evidence of all streets and utilities therein complete and ask for final approval at that time presenting a Preliminary Approval of the next 16 lots as Part 2 of Phase 11, seeking license to construct the remaining streets. The developer has the option of posting a letter of credit and requesting final approval of Part 2 Phase II for the June meeting if he so desires. If the developer does as suggested he should be able to obtain building permits for Part I Phase II about mid May, assuming all requirements for council's acceptance of improvements are met. Seth said the plat will be separated, they are trying to correct the issue thi quickest way they can. There being no further comments, James P. Nix moved to grant preliminary approval based on Bob's comments and their agreement thereto. Layton Overstreet 2nd and motion carried unanimously. There being no further business, meeting was duly adjourned.
