HomeMy WebLinkAbout03-06-1995 Planning Commission MinutesThe Planning & Zoning Commission of the City of Fairhope met Monday, March 6, 1995 at 5:00 PM at the City Administration Building, 161 N. Section Street Present: Chairman Richard Sanderson; members Maxwell Killoch, John Duck James P. Nix, Cindy McBrearty, Tim Kant, Cecil Pitman, Debbie Quinn The minutes of the February 6, 1995 meeting were duly approved as written. A public hearing was held on the property of Charlie Earle some 30 acres who desires zoning concurrent with annexation as B-4; R-3, PGH; R-3 TH; and B-1. Property located from Nichols Avenue 4 miles south, and from 'Booth (Bishop) Rd 4 mile west to Greeno Park S/D(Cottage Drive). Mr. Earle spoke saying that they wish to use the property for the purposes described. He said that they were the developers of the cottages on Cottage Drive and the Birches which had a 0-lot line concept. He said he has talked to Thomas Hospital and Mercy Medical about a 140 bed joint venture like The Birches.. In the '13-1 area possibly doctor's offices; in the R3 PGH area additional development of Patio Garden Homes 0-lot line, - and the R-3 TH without the patio He said this is essentially the development plan, that they plan to extend Sprir Run Dr. he will be consulting as to how to run street. He went on to 'say tha he has heard that the money has been frozen by the government.. - Cindy said her concern is once we grant the zoning what if it cannot be used for this? Charlie said if not this can be turned into patio garden homes. Richard Sanderson said that the cottages have been a success, that since the public hearing was advertised that we will hear comments but that the Commission would continue it until the next meeting to vote on it. Debbie Quinn asked him if he had talked to the County about the roads and he said he had talked to Wendy Allen. Mr: Sanderson called for other comments. A Cecil Miller spoke saying he was representing the VFW property and that he wished to state that all this area is lowlands and that this floods the property to the west of the VFW, his concern is drainage what will the environmental impact be on the area. Richard Sanderson said that the develop- ment is not anywhere near that at this time, he explained the procedures that needed to be taken. Mr. Miller said he is against this being annexed and zoned together: A Dave Pliska, property owner to the east of the development spoke saying he had donated an easement to the County and his conern is who will get Booth -Road city or County. Dick Sanderson said this is still a county road and will be maintained by the county. Mayor Nix said the only way that the city would take over is for the City Council to vote to accept the raod and maintain it and he doesn't see this happening. Bob Thompson, a resident at the cottages on Cottage Drive, spoke saying that Mr. Earle had talked to them and that he thinks it is a good idea, no objection Sam Robberson spoke, saying he owned property on the north boundary and explained he has flooding problems now, and he has talked to everybody he knows to talk to and that he has been told there are no plans to relieve his situation. There was no one else to speak at this time. Mr. Sanderson said that we will have a study session 1 hour before the next meeting to discuss this further. Plantation Pines - Unit 2 Application of Neil Leichty for preliminary plat appro 20 lots as R-1 development east of US highway 98 and north of Ala. Hwy 104. Bob had commented that the land in this devopment contains excessive slopes subject to extreme erosion and is traversed by a major floodway. He further mentioned that he cautioned the- developer and his engineer that the Flood Damage Prevention Ordinance prohibits raising the flood levels within the floodway by more than one foot. Measures for prevention and mitigation of erosion should be taken during construction and to the extent practicable energy dispersing devices should be incorporated in the drainage additions. That lot 29 appeared to be unusable because of the floodway and the topograpl combined and lot 23 is at best marginally usable. He cited other problems but recommended preliminary plat approval subject to conditions. Seth Moore spoke representing Mr. Leichty he said that they plan to redesign the lots in questic to where they would be usable, that the same entity/association would be as in Phase I. Further discussion led to a motion by Mayor Nix to recommend preliminary approval subject to all the conditions Bob had outlined(in comments and work out the erosion, siltation, grade problems Cindy McBrearty 2nd and motion carried with one vote opposed, Mr. Killoch. It was pointed out that a lot of this could be worked out at the pre -construction conference. �7 ,al Planning & Zoning - page two March S, 1995 Carya Point - Unit 2 Application of Vince Booth for Preliminary Plat Approval - 35 lots near the NE corner of Gayfer Ave. Ext & Oberg Rd. Bob commented that there is a petition for annexation pending on this. And for the purposes of this application the development is considered as wit the city and a part of the R-1 Single Family Zoning District. That he will it sanitary sewer to serve these lots. He cited some problems but said they can be discussed at preconstruction conference. There were 4 conditions pointed out that needed to be addressed before final approval sought. Cecil Pitman moved to grant preliminary approval subject to the conditions as outlined. Maxwell Killoch 2nd this motion. Motion carried unanimously. Bill Roden a resident adjacent to the north corner of this property spoke saying that he has watched the development of this area and it has led to a point now that his ditch gets flooded when it rains so he is very interested to see what the plans are for this development. Cindy commented that this has to be developed so that it will not impact other property but the water will be contained. Bay Meadows West - Unit 2 Application of Rudy Khrut and Fairhope Single Tax for Preliminary Plat Approval, 22 lots off Thompson -Hall Road near Bay Meadows Avenue in the city. Bob had commented that the plat and plans appear to be generally in order. That stormwater management design and draii calculations had been provided. He had listed conditions(in comments) that needed to be addressed at pre -construction conference. John Duck moved for preliminary approval with the conditions as outlined. Tim Kant 2nd and motion carried unanimously. Tillman's Corner - Application of G.L.D., Inc and FSTC for a 3 lot subdivisioi preliminary and final approval at the southeast corner of Cty Rd 27 and Cty Rd 48. Bob had commented there is no new road construction involved and stormwater runoff depending on use could be addressed at time of issuance of building permit. Cecil Pitman moved to give preliminary and final approval, Tim Kant 2nd and motion carried unanimously. Vieux Carre - Site plan review of the Corte property, Church Street at St. James Avenue. He said this is zoned B-2 He had commented that the developers propose to construct porte-cochere townhouses around the exist ing Corte family home and will provide off-street parking as shown on their drawing. He said the building will be set back so as to provide angular parking. They are also asking the commission to waive the 20 ft front yard setback since all the buildings in the block about the property line on Churchl' Street. Discussion was held on the project and a question was raised about the sidewalk. It was decided to make the sidewalk part of approval and a motion was made to approve the sie plan by James P. Nix to include providing the necessary sidewalks and screening. Maxwell Killoch 2nd and motion carrie unanimously. Hartshorn Place Bob had commented that he did not have all the information necessary but if the Commission would allow, Mr. Hartshorn would like to address the Commission and is asking for a 7 lot subdivision on Cty Rd 27 with 52 lots being proposed at some future date as Unit 2. Mr. Hartshorn spoke and said this is family land and that he is just wishing to develop the 7 lots now. --Bob had pointed out that he would need a stormwater design plan now to show how would be impacted when developed at later date, got to get whole picture even though just developing highway property. He had commented that this is informal review but had quoted Section 804 governing stormwater management must be adhered to in total development. He also said that a designated entity has not been named for maintenance. Tommy asked for preliminary approval on the 7 lots only subject to completion of his plans by the engineer. After discussion Cecil Pitman moved to give preliminar approval on the 7 lots subject to all of Bob's recommendations and completion of the plans by the engineer.
