February 6, 1995 at 5:00 PM at the City Administration Building, 161 N.
Section Street
Present: Chairman Richard Sanderson; members John Duck, Cindy McBrearty,
William Richmond, Maxwell Killoch, Tim Kant, Debbie Quinn
The minutes of the January 5, 1995 meeting were duly approved as written
Plantation Pines - Unit 2 Mr. Sanderson asked Bob Lunsford for his recommen
dation and Bob read his comments saying that Lot 23 marginally- usable and Lot
29 appears to be unusable and he is suggesting eliminate 29 and divide -area
between 2 adjoining lots. He said he had talked to the engineer/owner about
this. He had commented that the land in this development contains excessive,
slopes, subject to extreme erosion and is traversed by a major floodway. That
the developer and his engineer are cautioned that the Flood Damage Prevention
Ordinance prohibits raising the flood levels within the floodway by more than
one foot. He further said measures for prevention and mitigation of erosion
should be taken during construction and energy, dispersing devices should
be incorporated in the drainage- additions. He had 4 provisions that needed
to be met before approval given. He said the technical errors had been
corrected and all- subject to a pre -construction meeting. After he had read
his comments Mr. Sanderson asked who was present to represent this
application. There was no one. At this time it was suggested carrying this
over until next month as no one was present to discuss it further.
Dominion Farms - This was informal plan review for some 54 lots in vicinity
of Cty Rd 27 and US highway 98 east near Fish River. Bob had commented
that storm water management requirements would apply and a large part

of this development will be preserved as lakes and pastureland. Steve Delgoto
spoke saying that they would prefer the 12" ribbon curb and he was told that
that would not be a problem. The County regulations will apply as will storm -
water regulations. Mr. Delgoto was asked how big the lots would be and he
said 7/10 to 2 acres. There was no problem with what presented but no action
was needed on this at this time.
The Pavilion - Site plan review of development of the vacant lot on South
Section Street immediately south of Masonic Drive. Bob had commented that tl
plan is to provide for 2 story buildings in condominium type ownership with
a mixed use of both commercial and residential, providing a landscaped
courtyard with covered seating and ten additional parking spaces. Bob said
the developers are requesting that the commission waive the required 20 foot
front yard setback as all the buildings in the block to the north abut the
property line on Section Street. A Mr. Bill Pulliam spoke saying he owns
the property and Brett Duch is the architect he said that there is 15,000 sq
ft in it and they will use 11,384': He said the building will be set back 10 ft.
Tim Kant moved to accept the site plan review as presented. Maxwill Killoch
seconded and motion carried unanimously.
Under old business the Greeno Road re -zoning requests were discussed. Aileer
Andrews came forward and read a three page letter to the Commission. Jack
Stipes spoke saying that we should grant their requests. Audie Waters spoke
saying it took him 5 minutes to get out of his driveway to come up here and
he is asking for relief. Ben Barnhill spoke saying it is a truck -route and he
sympathizes with these people. Slyvia Zahn spoke saying that she thinks we
should keep it as it is. Claudine McClantoc spoke saying that she is a member
of a citizens group and will be watching the commission's actions and wanting
answers. Tim spoke saying that the reason Greeno has not been beautified
is they are waiting for the 4-laning to be done before beautifying but it is
planned to be done. Cindy spoke saying that public hearings-. were held on
each masterplan and that every citizen had a chance to speak, not pulled out
of the hat. That the masterplan recommended apartments in the area where
they have been built. None of these decisions have been made without input
from the community. She feels we should hold this over indefinitely until we
have a recommendation from the So. Al. Reg. Plan. Com. unless the applicants
are asking us to bring it to a vote tonight. Mr. Sanderson asked Mr. Killoch
if he wished to make a statement. Mr. Killoch said sticking with the Masterplar
has saved the City of Fairhope from having an "Airport Boulevard" and he move
that the zoning requests be denied and this recommendation forwarded to the
City Council, continuing month after month was not his idea. Debbie Quinn
seconded and motion to deny carried with the following vote: For motion:
Killoch, Quinn, Sanderson, Kant, Richmond. Not for motion: McBrearty,
Duck.
There being no further business, meeting was adjourned.
