December 5, 1994 at 5:00 PM at the City Administration Building, 161 N.

Present: Chairman Richard Sanderson; members Maxwell Killoch,
William Richmond, Cindy McBrearty, Tim Kant, Debbie Quinn
Cecil Pitman, John Duck
The minutes of the November 7, meeting were duly approved as written.
Re -zone request from R-1 Low Density Single Family Residential to B-4
Business and Professional for 7 applicants on Greeno Road:
James W. /Mitzi Morgan; Aileen Andrews; Claude Andrews; Audie &
Margaret Waters; Edward Carter, Sr. Executor Marcelline B. Carter Estate,
D.U. Maddox; Hilda S. Jones;for property 206 N. Greeno Rd, 208 N. Green
Rd, 210 N. Greeno Rd, 212 N. Greeno Rd, 304 N. Greeno Rd, Lot 1,
Britton S/D Map Bk 10, pg 116; Lot 2, Britton S/D Map Bk 10, pg. 116.
Bob commented that all the parcels have been subject of previous zoning
amendment applications as recently as 1986. All had suffered the taking
of 40 ft. with the widening of Greeno Rd. All parcels are in use as single
family residentials. That none of the parties indicate there is an immediate
specific use of their property, He questioned whether or not if this granted
wouldn't the owners on the west side of Greeno be entitled to the same thing.
He cited increased traffic accessing Greeno Rd, unless some provision made
for a service road, and numerouse sign requests if granted as some problems.
He recommended denial of these requests.
Tommy Harris spoke representing the applicants. He cited no new houses
had been built since 1977 in that area. That the applicants are sensitive
to Rosa Acres residents that's why they requested B-4 zoning. Basically
businesses be open 8-5 and not on weekends. He passed out a map showinc
where B-4 parcels are in Fairhope now and said he sees a need for more.
He said 300 ft. to the south of these parcels there is B-4 zoning and
to the north lies the 185 apartments. He said that these parcels are
not residential in character anymore, they have not been able to sell: them,
and that B-4 would not lower anybody's quality of life. Many people in
the audience spoke: Aileen Andrews (applicant) read a letter saying she
built her house 18 years ago, now, her property edge is now 12 ft. from he
front door, cannot sell her house, has had several people inquire about
commercial, she wants out. Bob Mannich spoke representing the Carter
Estate, said he has handled this for 22 yrs. that he has had several
inquiries about commercial, that this is the best/highest use, that B-4
is adequate buffer to Rosa Acres. Sylvia Zahn spoke saying she is behind
Carter's residence, not want business there. Betty Barnhill spoke not
opposed to re -zoning but wants City supervise and impose restrictions.
Vernon Bodden spoke went over past history of re -zoning. Cecil Christen -
berry spoke, said it couldn't hurt if it is controlled. Verona Beiser spoke
asking about other side of road. Mr. Bodden spoke again saying a 6-8 ft.
fence should be provided at back of property line. Trisha Lo Porto spoke
saying not only fence but green zone of staggered plantings, no visibility
buffer. Vince Valentim spoke saying he wanted it 7 yrs ago, want to do it
now. Jack Stipes spoke saying this has been going on year after year;
f irst Food World, McDonald's and then the apartments with 1 outlet.
Carolyn Bishop, hopes they will re -zone. Ed Schneider of Rosa Acres
wanted guarantee that city would protect residents in back of this area,
has no objection. Darrell Morgan has no problem with it but needs buffer,
green zone. Tommy Harris spoke again saying he did not see buffer, greer
zone as problem. Maxwell Killoch spoke saying that he would like to see
several parcels with 1 developer. Clay Havard spoke saying that he knows
individual parking and landsacaping would be a requirement, would be
properly done. At this time Mr. Sanderson asked each member to share
their thoughts: Debbie-Q. asked if this group had considered R-3, R-4
residential? Tim K. said that w/R-4 parking should be at back, have
restrictions and require greenbelt. Cecil P. would like to explore -state,
not allowing . as many roadcuts, have buffer, have Bob oversee this.
Gibby K. said he was thinking about a PUD where several parcels would
have a service road, architectural control, with Williamsburg or New OrleanE
type buildings and parking in the back, w/1 road cut. John D. said he
knows they have a problem, re -zone it for them. Cindy said she did not

want anymore multi -family. She pointed out that B-4 could be a problem,
that if we could limit the traffic and hours. She said she thought a PUD
would be a better idea. Maybe table this and try to come back with some-
thing at January meeting. Hopefully we would have the comprehensive plan.
Buddy R. said that there are several things that could be put in B-4, he is
apprehensive. Tommy Harris said these people need some relief but that
speaking for the people they would be willing to wait until January to
try and reach a solution. Dick Sanderson said that these applications
contain 2 large parcels of land, that it would definitely increase traffic.
He explained the procedure and explained the setback requirements of B-4
He asked- what would -be the immediate evolution? think about the land value
there, that he gets the impression that the commission is thinking about
a PUD, that the city would have some control. Tommy Harris thanked the
commission for their input and said he would get with the property owners
and see what come up with. John Duck put in the form of a motion to
continue these 7 rezoning requests until the January meeting. Cindy
McBrearty seconded and motion carried unanimously.
Re -zone request from R-2 Single Family to B-2 General Business 50 S.
Church Street property of the Corte family
Bob read his comments. He had said that this is the last surviving single
family use existing in the immediate area. That there is no abutting properl
zoned single family. That the property north and east is commercial and
south and across St. James is zoned R-2 but is used as a public school,
to the immediate west is zoned for mult-family and further west is University
of South Alabama. Considering- the existing land uses in the area he
recommended approval of this request. Dan Corte spoke saying they feel
like everything around them is commercial that B-2 is best and highest
use. No immediate plans to do anything but hope to keep the house like it
is. Cecil Pitman moved to reccomend approval of this re -zone request to
the City Council. Maxwell Killoch seconded and motion carried with Buddy
Richmond voting against this.
There being no further business, meeting was duly adjourned.
