HomeMy WebLinkAbout11-07-1994 Planning Commission MinutesThe Planning & Zoning Commission of the City of Fairhope met Monday, Novem-
ber 7, 1994 at 5:00 PM at the City Administration Building, 161 N. Section St.
Present: Chairman Richard Sanderson; members Cindy McBrearty, Buddy
Richmond, John Duck, Tim Kant, Debbie Quinn, Maxwell Killoch
Cecil Pitman. Zoning Enforcement Officer Bob Lunsford and
Secretary Betty Rivenbark, Secretary
The minutes of the October 3 meeting and October 25th special meeting
were duly approved as written on motion by Tim Kant, seconded by
Maxwell Killoch.
Horne Subdivision - This was a 2 lot subdivision land of Richard Horne/FSTC
located between Johnson Street and Fairhope Avenue. Preliminary and final
approval was being sought. Bob had commented that the entrance to this
would be from Johnson Street and that they met the minimum frontage area
requirements. He said there are two structures on the property that need
to be removed or repaired. Lorena Gregorius spoke saying her company
is listing the 2 lots and that they have made it a precedent of the sale that
the 2 structures be removed before the first of the year. Mr. Sanderson asked
for a motion and Mr. Killoch moved to give,preliminaryand final -approval as
sought, subject to the 2 buildings being removed. Cindy McBrearty seconded
and motion carried unanimously.
Jansen Subdivision - 3 lots of Claude Jansen on Greeno Road in the M-1 Distric.
Preliminary and final approval is- being sought. Bob commented that this would
require storm management design and it had been submitted on Lot 1 where
the Sonic building is being built. He recommended preliminary and final approva
subject to no issuance of any building permit for lots 2 or 3 until there has
been submitted certification of complete storm water management design for all
of the subject subdivision and this so noted on the plat. Bob Taupeka - said he
wished to see a layout showing lots 2 8 3. He was showed one. This property
is all zoned M-1. Cindy at this time said that we need to address the number
of curb cuts on- Greeno Road, that she sees this as a problem that we need
to take up. John Duck moved to grant approval of this subdivision subject
to Bob's comments being adhered to. Tim Kant seconded and motion carried
unanimously.
Heritage Oaks An informal review of a request of Neil Leichty of a layout
of property in an R-2 district on the west side of Bayview Street north of
Magnolia Avenue showing 3 lots with private street access. The Commission
discussed this and Bob had commented that stormwater provisions do not apply
to this proposal and it appears that runoff can be largely prevented from over-
flowing onto properties to the north and south. However, design should include
provisions for mitigation of erosion hazard along and below the bluff line to the
west. Street design must meet the criteria of the subdivision regulations,
including private maintenance responsibility. Mr. Sanderson said he is against
the easement idea and loss of the huge tree, piling lots together not good.
Tim said he is concerned about the bluff, it is unstable. Debbie said she
agrees with what everyone said. Cindy said she shares the concern of cutting
this into small lots. Richard Sanderson said he feels it will totally destroy
the character of the neighborhood. Brett Duch spoke representing Mr. Leichty
and said he was not sure that the oak would have to be removed, and this woul
only increase runoff 10%, there would be less drive area, that environmentally
it would be better. No action was needed or taken.
IBranchwood This was 31 lots outside the city on the east side of Cty Rd 33,
south of Cty Rd 48. Preliminary approval had been granted in May 1994.
Rutherford Smith, the developer is requesting final plat approval. Bob had
said that the construction of improvements had been completed the County 'Engin
will have to sign the plat. He said it is completed as far as city requirements.
John Duck moved to approve subject to County's approval, Buddy Richmond
Iseconded and motion carried unanimously.
Tim Kant brought up that he thought we needed to have a study session before
the first of the year, that we needed to look at green areas, sidewalks. Cindy
said we need to discuss curb cuts. All agreed to strive to setting time/date
Ito do this.
