VALLEY VIEW - Application of Mahan Corporation for
Preliminary and Final Plat Approval,
Seven Lots on north side of Pensacola Avenue between Bon
Secour and Perdido, a redivision in Block 23 Volanta for
the purpose of constructing patio garden homes.
Section 7.511 of the Zoning Ordinance provides that patio
garden homes may be intermingled with other types of
housing. It is within the scope of the Commission's
authority to decide whether this type use is permitted in
a neighborhood within a particular zoning district.
The lots as delineated appear to meet the minimum
requirements for patio garden homes and the plat is
generally in order. However, you will note that this
application is submitted under the authority of a contract
for sale held by Mahan Corporation and the approval of
this application may be a condition to fulfill terms of
the contract.

numbers,_._ While there is no proprietary interest of a
property address vested in any particular owner, change
can be disruptive and is not to be undertaken lightly.
I recommend that preliminary and final approval, if such
be granted, be on condition that Mahan's ownership be
completed and the plat be signed within 60 days from
date of approval or such approval shall be null, void and
of no consequence. No other owner may secure the
signature of approval on such plat until such owner has
re -submitted the application under his/her own name and
the same shall have been approved.

It appears that the overall development plan is for some
180 lots, averaging about 65' x 1301, which approaches an
average density of five lots per acre.
Plat and plans generally appear to be in order except for
the following items:

1. Plat requires certificate of FSTC (see attch notice)
2. Lot for sewage lift station must be dedicated to City
3. Street name conflict between overall development plan
and plan -profile sheets must be resolved
Developer should be advised that each lot to be connected
to Fairhope's sewer will be subject to a tap fee of
$2000.00, which must be paid before a water meter will be
set for the premises.
Subject to the three items set out above and the required
approval of the County Engineer, I recommend that the
Commission grant Preliminary Approval to this application,
provided however, that as a CONDITION PRECEDENT to such
approval the developer shall cause to be held a pre -
construction conference before any work is undertaken.
The Planning/Zoning Officer, the County Engineer, the
City's General Superintendent and Water/Sewer
Superintendent, the project engineer, and the general
contractor shall be present at such conference. License
to Construct shall be issued jointly by the
Planning/Zoning Officer and the County Engineer and no
work shall be undertaken without such license.
The question of public parks was raised during the last
meeting. Since Section 11-52-8, Code of Alabama, 1975
authorizes municipal planning commissions to adopt a
Master Plan for the municipality and such area outside
the city as, in the Commission's judgment, bear a relation
to planning for the City, I would recommend that the
Commission study the feasibility of undertaking such a
Master Plan and consider requirements for parks in the
process.
The fact of requiring a developer to dedicate facilities,
including parks, does not create a duty for the City to
accept dedication of or to maintain such facilities until
the City Council has, by formal resolution or other
affirmative act, formally accepted same for maintenance.
Whereas there are a relatively few lots in Unit One, I
would suggest the question of park dedication not be
raised until further study as recommended above.
OAK POINT - Application of George R. Irvine, Jr. for
Preliminary Approval, 14 Lots of some three
acres each, west of County Road 3, vicinity
of Yenne Lane. Plat and plans are not in order for
consideration of Preliminary Approval and, at my
suggestion, Mr. Irvine is seeking Informal Plan Review

in order that he may have the Commission's advice before
expending further funds on this project.
I have discussed the requirement for stormwater management
with Mr. Irvine and he indicates that he and his engineer
are aware of the requirements of the regulations and
expect to conform thereto.
Upon presentation of preliminary plat, all required
certificates must appear thereon and be properly executed.
All street grades must conform to requirements of the
subdivision regulations unless it can be demonstrated
that such is topographically infeasible.
There must be presented with submittals a letter from
the County Engineer acknowledging receipt of a copy of
the plat and plans. Receipt of plat must also be
acknowledged by the Health Department.
Failure to follow procedural due process requirements
of Section 11-52-32 (required notice) will result in
rejection of the application as incomplete.
As a condition precedent to Preliminary Approval, a
preconstruction conference will be required and the
County Engineer or his delegate must be a participant.
If Mr. Irvine and his Engineer have all submittals
substantially complete in time, I shall be available
to meet with them, by appointment, up until three
business days prior to closing date for July meeting
agenda. However, any changes arising from such meeting
must be complete by closing date and time, or the
submittals must be rejected as incomplete or incorrect.

THE VILLAS (at Homestead) - see attached memo to
developer/architect/engineer, which I believe is self-
explanatory. (No public discussion required or
suggested unless initiated by developer.)

THE VILLAS (Homestead) - Application of Homestead Village
for subdivision of 12 townhouse
lots as approved part of P.U.D.
It is my recommendation to the Commission that no further
changes in the Preliminary Plan of Homestead Village,
including approval of this application be made. Instead,
the Final Plan should be submitted for approval as
required by the P.U.D. provisions of the Zoning Ordinance
and the Plan recorded. Consideration of this subdivision
application should be given simultaneously with that of
the Final Plan.
It should be noted that the developer was informed before
the August, 1993 meeting that the Final Plan should be
filed. The ensuing nine months is adequate time in which
to prepare and file such plan. Continuing revisions to
the preliminary plan may tend to confuse the record and,
in any event, is not in accord with the intent of the
P.U.D. provisions.

The Planning 8 Zoning Commission meeting of the City of Fairhope met
Monday, June 6, 1994, at 5:00 p.m. at the City Administration Building
161 N. Section Street.
Present: Chairman Richard Sanderson; members Debbie Quinn, Tim Kant
Cecil Pitman, Maxwell Killoch, James P. Nix
The minutes of the May 2 meeting and May 9 meeting were approved with
corrections noted, on motion by Cecil Pitman, seconded by Maxwell Killoch
and unanimously carried.
A public hearing was held on a request by Charles W. Parrish to re -zone his
property at 305 Fels Avenue From B-2 General Business to R-2 Single Family
Residential. A motion to recommend approval of this change to the City Council
was made by James P. Nix, seconded by Maxwell Killoch and unanimously
carried.
Valley View - Preliminary/Final Ap rp oval - This is an application of Melissa
Mahan who wishes to divide 1 parcel into 7 lots for the purpose of building
7 patio homes on the north side of Pensacola Avenue between Bon Secour
and Perdido. Tim Kant asked how many houses would the parcel hold if
left as is. Bob Lunsford answered four. Tim Kant was also concerned
about the access to the rear of the property for emergency vehicles and
for City garbage trucks. Ms. Mahan stated there would be an alley in the rear
and no fences between the houses to obstruct the removal of garbage. Mr.
Sanderson asked the size of lots in the general area - 66 X 132. Bill Jones
as a property owner spoke of his concern regarding the traffic problem
in that area. His concern was that because of the business located there
and the left hand lane there was quite a traffic problem and with the
addition of 7 more families it would be much worse. James P. Nix asked
if the adjacent property owners were notified. Bob Lunsford said they were.
Motion .vas made by Debbie Quinn, seconded by Tim Kant to approve the
requested change. Votes in favor of request were Cecil Pitman and
Debbie Quinn. Votes against were Richard Sanderson, Tim Kant, Maxwell
Killoch and James P. Nix, The request was denied. Mr. Nix stated that
if a request was made for subdividing the one parcel as R-2 zoning it would
probably be approved.

River Mill Unit 1 Preliminary Plat Approval 35 lots on the south side of County
Road 48 at Blueberry Lane. Mr. Sanderson asked Bob to relate his comments.
Bob said the plat and plans are generally in order except for the following
.items: Plat requires certification of FSTC; lot for sewerage lift station must be
dedicated to City; and street name conflict between overall development and
plan - profile sheets must be resolved. Seth Moore spoke saying the FSTC
had approved the plat and that they have changed the master plan and con-
struction plan to meet the requirements. Mr. Kant asked who was going to
maintain the island at the entrance. Craig Dyas said they were going to form
a property owners association and they would maintain it. Tim Kant moved to
approve the subdivision subject to Bob's recommendation, seconded by Debbie
Quinn, motion passed unanimously.
Oak Point Informal Plan Review There was no representation for Irvine. The
commission looked favorably on the plan review as long as the drainage plan
is okey and asked Mr. Lunsford to convey this to Mr. Irvine.
Under old business the committee for zoning standards on density - James P.
Nix requested that each individual receive a copy of the committee's recommen-
dation, study them and report back to committee before a study session is
held. Secretary Max Killoch will put comments in order when submitted and
Bob will distribute.
There being no further business, meeting was duly adjourned.
