HomeMy WebLinkAbout05-09-1994 Planning Commission Special Meeting MinutesThe Planning & Zoning Commission met Monday, May 9, 1994 at 5:00 PM for , l a special meeting for the sole purpose of further consideration of Dr. Barnes I subdivision - River Oaks. Present: Chairman Richard Sanderson; members Cindy McBrearty, Mike Ford, William Richmond, Cecil Pitman, James P. Nix, Tim Kant, Maxwell Killoch, Debbie Quinn. Bob Lunsford, Zoning Officer, -Tut Wynne, City Attorney and Betty Rivenbark, Secretary Mr. Sanderson apologized to Dr. Barnes and said if he had met all the criteria set out by the Planning & Zoning Commission he should have been granted approval at the May meeting. He called on the Gen. Supt. , Phil Rutherford to comment about his inspection of streets and drainage. Phil said he had gone out there and found a large piece of plastic stuck in the drainage pipe on the road, that is the reason it has not been draining. Mr. Sanderson said it is pretty obvious that it is the County's problem. He said he would ask for a motion to approve subject to all the conditions set out by Mr. Lunsford at the last meeting. Bob said again what he required: performance bond of not less than 50%, engineering certification, and document showing who would be responsible for maintenance of the pond. James P. Nix moved based on- him having been given preliminary approval in February 1993, that he provides the 50o performance bond, engin- eering certification, and document showing responsible party for maintenance and results of independent engineers study that he be granted final approval on his subdivision. Mike Ford seconded. Discussion followed. Debbie Quinn asked if this also included the swale area; t he swale area is not being main- tained. Dr. Barnes said that this will be seeded/grassed, probably was rained out. Ack Moore said he had been 419'=-tained by the Kopesky's and that he had gone out there and found: that they were encroaching on the county's right of way - Dr. Barnes said he is sure that can be corrected. Further, that the pond not working, the drainage chimney is silted up and they need to open up ditch downstream. Mr. Maradik said his property will not drain. It was noted that when the county widens the road that will take care of that problem. Ack said he understood they are having problems with the condemnation so it will probably be 2-3 years before county completes this project; also, the trees they will cut need to be addressed. Ack said further that he looked at Mr. Maradik's pond and there is some kind of weeg growing in there, he thinks this was caused by what chemicals Dr. Barnes was using. Dickie Dryer said the county ran tests and the fecal chloroform was higher than that they found on the causeway and he just wished to make this point. Cecil Pitman spoke saying that he thought Mr. Sanderson was too apologetic, that they had problems with this and that they needed the time to work them out. That he is sympathetic with Roy and the surrounding residents. Ron Kopesky asked how long the bond lasts. Tut Wynne answered saying at least 2 years or until accepted by the City for maintenance. Dr. Barnes said to tell him what the problems are and he will work them out. Ron said right now it just doesn't perk. Mr. Nix said again that the City has hired an independen• engineering firm to check out the calculations that have been presented and that whatever the results he will have to modify the drainage system according- ly, which work is guaranteed under the required Performance Bond. The question was called for and the motion carried unanimously. There being no further business, meeting was duly adjourned.
