RIVER OAKS - UNIT ONE - Application of Dr. Roy Barnes for
Final Plat Approval, 28 Lots on
Bishop Road. Application has not been placed on the
agenda because submittals are not in conformity with the
regulations. In order to avoid the question of automatic
approval as provided by law, I recommend that the
Commission cause the record to show that this application
is unacceptable for the following reasons:
1. Plan of final construction not submitted
2. Owners certificate on Plat not executed or
acknowledged.
3. Lienholders certificate not executed.
5. Health department certificate not executed.
6. Engineer's certificate not executed.
7. Surveyor's certificate not executed.
8. Superfluous certificates (telephone, water/sewer,
electric) not required should be removed from plat.
BRANCHWOOD - Application of Rutherford Smith for
Preliminary Approval, 31 lots east of
County Road 33, south of County Road 48.
Application has not been placed on the agenda because
submittals are incomplete and fail to conform to the
requirements of the regulations. Deficiencies noted
include:
1. Engineer's certificate on plat not executed.
2. Health department's acknowledgement of receipt of
plans not executed.
3. Contour map incomplete - no elevations shown.
4. Stormwater management plans not properly certified
5. Plans incomplete per Section 804
6. Calculations not provided as required by 804

The Planning & Zoning Commission of the City of Fairhope met Monday, April 4
1994 at 5:00 p.m. at the City Administration Building, 161 N. Section Street
Present: Chairman Richard Sanderson; members Maxwell Killoch, Cindy McBrea ty
Cecil Pitman, Debbie Quinn, James P. Nix, Mike Ford, William Richmond, Tim
Kant , Robert Lunsford, Zoning Officer and Betty Rivenbark, Secretary
The minutes of the March 7, 1994 meeting were duly approved as written on
motion by Maxwell Killoch and seconded by William Richmond.
It was noted at this time that River Oaks - Unit One application of Dr.
Roy Barnes, request for final Plat Approval of 28 lots on Bishop' Road
had not been placed on the agenda because the submittals to Mr. Lunsford
were incomplete and failed to conform to the regulations. Also, Branchwood
application of Rutherford Smith for Preliminary approval of 31 lots east of
County Road 33, South of County Road 48 was not placed on the agenda
because the submittals were not in conformity with the regulations and require-
ments.
Under discussion Tommy Harris talked to the Commission about a PUD he was
thinking about developing on his father's 258 acre ranch - Scenic View Ranch
Estates located close to Weeks Bay. It is in the planning jurisdiction area.
His concept on dividing the ranch stemmed from 5 to 13 acre tracts. He said
he is seeking input. He did point out he wished to keep dirt roads as horse
paths. He said it would be self-contained development with lakes, horsepaths
and dedicated areas. He did say this joins with the Weeks Bay reserve area.
He said the front area is already developed along the highway with 2400
sq ft homes. He said this is just a concept, he is trying to decide whether
to continue to pursue it. The commission members asked him questions and
Cecil Pitman asked he would consider blacktopping this. Mr. Sanderson asked
Bob for an overall view. Bob asked if any lot would be under 5 acres? He
responded no. Bob said that under our subdivision rules and regulations he
would not need to come to us if more than 5 acres. Bob said our subdivision
rules say curb/gutter with paving. Dick Sanderson said maybe blacktop the
roads with bridle paths . All felt it a good idea to encourage Tommy to
pursue this but most preferred he pave the roads. Bob said he would be
glad to work with him.
Buddy Richmond told the Commission he had some ideas that he had on possible
solutions to help with what we are facing with our rapid growth and future
requests for large developments. He said they had faced a similar situation
when he was down in Florida. He read a prepared statement he ►igad.
Dick Sanderson suggesting forming a sub -committee and appointed Buddy,
Maxwell Killoch, Cindy and Debbie to work with Bob on this.
Under old business, Kevin Boone came forward with a revised set of plans
showing single family residences on the highway as proposed to him. Only
difference was he had gone 214 ft. rather than the 300 ft. recommended.
Kevin said he had given Fred Watkins, Sr. a set of his revised plans to
review and he had heard nothing back from him. The Commission questioned
the 214 vs 300 ft. Kevin said behind the housing he planned to put fencing an
landscaping as a buffer and he thought this adequate. He said he would be
glad to go with plans as presented. Bob recommended giving it approval with
the buffer of 4 lots as R-1 and with the fencing and landscaping. Richard
Sanderson asked Mr. Killoch if this presentation met with what he had recomme d-
ed and Mr. Killoch said yes. Cecil Pitman moved to forward this to the City
Council with the recommendation that this be zoned with the 4 lots on front as
R-1, and the remainder being R-6 concurrent with annexation request. This
being located on Gayfer Ext. East of Hwy 27 about 340 ft. Tim Kant seconded
and motion carried with note that this included fencing and screening as
stated.
Bob mentioned that since River Oaks -Unit One was a final plat application he
would like to have a motion to the effect that this was turned down and not
presented at this meeting. James P Nix, moved, Cecil Pitman seconded and
motion carried unanimously.
Tommy Harris approached the Commission again with discussion on a proposal
he wished to make on behalf of the residents on Greeno Road. That it was
unlivable now and they wished to re -zone to commercial. Dick Sanderson
said he had calls about this and that they had the benefit of the 40 ft. ease-
ment without having to pay taxes and that they are planning to landscape and
also these people have been justly compensated that he does not feel they shoul
be upset. Tommy said these homes have been marketed for 9 mos. and no one

has even inquired about this property. Tommy said these are long time
homeowners and not just people who have recently moved there, we need
to consider them and see if there might be any relief in the future, possibly
consider business and professional office spaces.
Bob said the comprehensive plan is being worked on now and should be
ready by the end of the year and he suggests we don't do any more re-
zoning on Greeno Road until the plan is received and we can study it.
The Commission members agreed with what Bob suggested.
