HomeMy WebLinkAbout03-07-1994 Planning Commission MinutesTO: FAIRHOPE PLANNING COMMISSION I FROM: Meeting of: 07 MAR 1994 Planning/Zoning Officer Point Clear Woods - Application of .Tack Ponder for Preliminary Plat Approval, 27 Lots off Confederate Rest Drive, East of Scenic Highway 98 and South of Lakewood Club Estates Unit 2. The Plat appears to be in order and in conformity with the subdivision regulations. Construction plans have been reviewed for compliance with Section 804 for storm water management. This is the first significant development reviewed under provision of 804. Although there are some items to be modified, I believe that Mr. Walter Scott, the project engineer, is to be commended for a rather thorough implementation of the applicable storm water requirements. Preliminary approval is recommended subject to completion of the following items: 1. The must be presented a legal document establishing an entity to be responsible for maintenance of common areas and off-street drainage and detention facilities 2. Engineer's certificate should be modified to appear as required by Section 804 (page 33) and should appear on both the plans and the stormwater calculations. 3. County Engineer's review and approval For you information I attach with my commentary a copy of the checklist to be used in review of stormwater management. I welcome your comments and criticism. Aryshire Glen - Application of Ausman Land and Development for Preliminary Plat Approval, 10 Lots on the north side of Gayfer Avenue Extension between County Road 13 and County Road 27. The Plat appears to be in order and in conformity with the subdivision regulations. The land proposed for development is rather flat and the proportion of impervious areas to total lot area is rather small. Engineer's calculations indicate a differential runoff of less than 3.5 c.f.s., which can be retained in the grassed ditches proposed. However, the design should include concrete curb as a means of stabilizing pavement edges. Ribbon curb may be acceptable, with the top surface 3/4" below elevation of pavement edge, with 3/4" asphalt overlay to seal joint and allow runoff to ditches. Ribbon curb bottom should extend below bottom of base so as to prevent ZOCOMM94.fpc 19 FEB 94 transmigration of water to base material. Preliminary approval is recommended subject to.completion of the following items: 1. Water main shall not be routed under pavement at Cul-de-sac - must be accessible to tapping for service without disturbing pavement 2. Engineer's certificate should be modified to appear as required by Section 804 (page 33) and should appear on both the plans and the stormwater calculations. 3. County Engineer's review and approval Gainswood Unit 1 - Application of Kimmer Development Co. for Final Plat Approval, subject to surety, 45 Lots on the west side of County Road 27, between County Road 32 and County Road 24. This application is somewhat unusual in that no surety was presented upon Preliminary Approval (meeting of August 1993, conditional) and, with the physical improvements at about 85% complete, the owner, for reasons of his own, wishes to obtain final approval upon letter of surety, so that he may convey lots. There is included with this submittal a Letter of Credit from AmSouth Bank which indicates a committal of $400,000. for physical improvements. A condition of preliminary approval according to minutes of meeting of 2 August 1993 was County Engineer's approval of storm water management and design of intersection of County Road 27 at Gainswood Boulevard. Recommend Final Plat Approval upon written evidence that all conditions of preliminary approval were met and subject to County Engineers approval of Final Plat prior to recording. Twin Acres - Application of Fairhope Single Tax Corporation and Michael Wesley for Preliminary and Final Approval, 6 lots at the northwest corner of County Road 44 and County Road 27. Land lies outside the City and will rely upon individual septic tanks and drain fields for sewage disposal, but is accessible to public t4ater supply. Land abuts improved roads and no new streets are proposed. The Plat appears to be in order and in conformity with the subdivision regulations. There are no new roads and the size of the development area is not such as to require ZOCOMM94.fpc 19 FES 94 application of the stormwater management provisions of Section 804. Preliminary and Final Plat Approval is recommended subject to the County Engineer's approval prior to recording of Plat. Estella Place - Application of Fairhope Single Tax Corporation and Thomas H. Brown for Final Plat Approval, 6 Lots at the northeast corner of North Ingleside Street and Estella Drive. Improvements in this subdivision have been installed under the 1993-94 Public Assessments Program. Right-of-way of Estella Drive was previously dedicated by Fairhope Single Tax Corporation. The Plat appears to be in order and in conformity with the subdivision regulations. Final Plat Approval is therefore recommended, without condition. Hartshorn Place - Request for Informal Plan Review, 7 Lots proposed with a second unit reserved for future development. There is insufficient information given to locate the development exactly, but it appears to be near the nar east corner of County Road 32 and County Road 27. Unit 1 would abut existing County Road 27. It should be noted that the determination of applicability of Section 804 governing stormwater management must be made on the basis of the total development area; therefore, separate consideration cannot be given unit one without having stormwater design for the total project. Preliminary submittals must be accompanied by stormwater design required by Section 804. Installation of storm water controls may be staged in phases based on complete design. This review is informal and requires no action by the Commission. Un-named Sketch Plan - Submittal of Moore Surveying for informal plan review of some 185 Lots between Windmill Road and Fairhope Avenue, east of County Road 27. Owing to lot sizes indicated, it is presumed that owner expects to have public sewer service. There are shown three�cul-de-sacs of excessive length. Owner should consider extending to property line for future continuity of adjoining development. Total development area appears to be about 58 acres and will require application of the stormwater management Z O C O M M 9 4. f p regulations of Section 804, as well as N.P.D.E.S. permit. Since there is major access from this development proposed to Windmill and since the development will have a quarter mile of frontage on Windmill Road which is now unpaved, developer shall be required to install paving and curb and gutter on Windmill frontage. Developer shall also provide additional right-of-way for the north half of Windmill Road to be not less than 40 feet in width. This review is informal and requires no action by the Commission. ZOCOMM94.fPC 19 FEB 94 The Planning & Zoning Commission met Monday, March 7, 1994 at 5:00 p.m. at the City Municipal Complex, 161 N. Section Street. Present: Chairman, Richard Sanderson; members Maxwell Killoch, Tim Kant, Cecil Pitman, Cindy McBrearty, Debbie Quinn, Mike Ford, William Richmond Mr. Sanderson paid tribute to William "Jack" Lucey a longtime member of -the Commission who passed away in February. Maxwell Killoch read a statement and there was a moment of silence in his memory. Mr. Sanderson also welcomed Debbie Quinn, our new member, to the Commission The minutes were considered and were approved as written on motion by Maxwell Killoch, seconded by Cindy McBrearty and unanimously carried. 'oint Clear Woods Preliminary Plat approval of a 27 lot subdivision being Developed by Jack Ponder located on Confederate Rest Drive, East of Scenic Highway 98 and South of Lakewood Club Estates was considered. Bob's :omments were considered on this and he had recommended preliminary approval subject to the following: 1. a legal document establishing an entity that would :)e responsible for maintenance of common areas and off-street drainage and Jetention facilities being presented; 2. An engineer's certificate being gut on both the plans and stormwater calculations; and 3. County Engineer's ^eview and approval. ( Bob had also included a checklist to be used to review stormwater calculations) . Willie Williams questioned the drainage runoff and how t might affect the area. Dick Sanderson explained that this would be the County's responsibility. Further discussion led to a motion by Cindy McBrearty to give preliminary approval subject to the 3 items Bob had mentioned. Maxwell Killoch seconded and motion carried unanimously. Aryshire Glen This was a 10 lot subdivision off of Gayfer Ave. Extension between Cty Rd 13 and Cty Rd 27. Preliminary approval was being sought. Bob had commented that the plat appeared to be in order and in conformity with the subdivision regulations and he recommended that subject to the following: 1. That the water main should not be routed under the pavement at the cul-de-sac, but, must be accessible to tapping for service without disturbing the pavement; 2. That the engineer's certificate should be on the plans and the stormwater calculations; and 3. that it be reviewed and approved by the County Engineer. Cecil Pitman commented that these looked like nice lots and so moved for approval subject to Bob's comments. Maxwell Killoch seconded and motion carried unanimously. Gainswood Unit 1 Application was being made for Final Plat Approval of this 45 lot subdivision on the west side of County Road 27 between Cty Rd 32 and Cty Rd 24. Bob had commented that this was an unusual application in that no surety had been presented when preliminary approval was given, but, now the owner wishes to obtain final approval with the improvements about 85% complete upon a letter of surety so that he may convey lots. He further said that he presented a letter of credit from AmSouth Bank for $400,000. Bob further recommended final plat approval with written evidence being presented that all conditions of preliminary approval had been met and subject to County Engineer's approval of final plat prior to recording. Mr. Killoch ques- tioned the lots at the end of the cul-de-sac. Bob said that on these narrow lots they move the front setback back. Dick Sanderson questioned that there was already a house under construction on this property. Murray Thames, the owner, responded that he had built a house for his daughter and when he went to the County they said since he owned all the property they saw no problem with issuing a permit for this construction. He said he did not know he was doing anything wrong and it was not his intent to do so. Frank Craw- ford of McCrory & Williams asked if they would be required to put asphalt in the and of the cul-de-sacs. Several comments were made from the Commission members and all agreed that they did not wish to waive the asphalt at the end of the streets, but, require it as it should be. Mr. Thames was asked why he supplied the surety letter now. He said he was told that he would have to wait another month to convey lots and he did not wish to do so. Cecil Pitman moved to grant the final approval with the asphalt turnarounds installed. Motion carried unanimously. Estella Place Application of FSTC/Tom Brown for Final Plat Approval, 6 lots �t the northeast corner of N . Ingleside and Estella Dr. Bob commented that ther re drainage problems there and there will continue to be, Mr. Moore did the broject but did everything he could. He said in issuing permits he will insist Vlr. Brown provide engineering to show correct water drainage on these lots �o they will not make the situation worse. Richard Sanderson said he has talked to Mrs. Beiser and Bob Lunsford about this, he recounted the responsibilities and limitation of the Planning Commission. Mrs. Beiser asked to speak and reco nted the problems she has had over the years. She said since Estella Place finished the water no longer runs off. She said she was told that fill dirt will be put �n and that will only run the water towards her. Bob said they will have to have the lots filled to above the manholes or there will be a sewer backup. Tim said if the water does backup the engineer will be held liable if there is additional runoff. Bob said this is zoned R-1 Single Family Residential the lowest density we have and he doesn't see how they, can deny this. Cecil Pitman asked if we .ould require larger pipe installed to?&ve the situation. Richard Sanderson said again we have done the best we can and Mr. Lunsford will make sure with each one the proper engineering is submitted. Tim Kant moved to approve subject to whoever develops be responsible for drainage easement and it will be up to the owner to maintain this. Maxwell Killoch seconded and motion carried unanimously. quail Creek Unit II Mr. Sanderson said that Phil Rutherford had reported that II the improvements had been made on these streets and we need to accept hem so that the City Council can act on this tonight. Unit 1 would front on Hwy 27. Cecil remarked that maybe they ought to make the lots larger not o many. Bob asked if R-3 was what proposed and Seth Moore answered yes. ob told him that we would not like them to develop small lots and then request annexation, not consistent with the way we like to develop. Cindy said 185 s too many, we need to look at our masterplan, that everything now is overrun, ur schools and the city. Seth 32 lots are planned for the first phase. No actior as required and Mr. Moore was asked to convey Commission's thoughts to the eveloper. evin Boone/Klumpp mobile home park had been carried over from last meeting. r. Killoch had written comments on this and suggested that the front of the evelopment be single family homes as a buffer and then develop as a PUD. Kevin said he planned to have this as rental property. It was suggested that t still could be. Cindy suggested that we hear from the residents that might fish to voice an opinon on this. Mr. Killoch asked if he annexed, where he fight try to connect with City. Mr. Boone said at Tillman's Corner. Mr. Boone aid he could develop this as a trailer park without even coming into the city ut at least he was trying to give the electric service to the city. Cindy remarN he thought there was a question of all the property perking that might have rompted-him to seek annexation. Mr. Boone said he had talked to Fred Watkin r and Jr. and Mike Fi Ilingim. Further discussion led to a motion to table this or another month to further seek solutions. J here being no further business, meeting was duly adjourned.
