HomeMy WebLinkAbout02-07-1994 Planning Commission MinutesThe Planning & Zoning Commission of the City of Fairhope met Monday, February 7, 1994, at 5:00 p.m. at the City Administration Building, 161 N. Section Street. Present: Chairman Richard Sanderson; members Maxwell Killoch, Cindy McBrearty, Cecil Pitman, Tim Kant, James P. Nix, Mike Ford William Richmond s The minutes of the January 6, 1994 meeting were duly approved as written. Dietze Tract An informal plan review was�b;-Id on this planned 33 lot subdivision west of County Rd 3, south o`t'County Rd 44 near Point Clear Stables. Bob had commented that the land lies outside the City and would not be subject to Fairhope Zoning Regulations, but will likely be subject to County zoning. Ack Moore of Moore Engineering was present representing Dr. Dietze. Bob had further commented that the owner would be required to conform to the more stringent provisions of either the county or city regulations. Also, the County would be the body to accept the improvement for maintenance and the County Engineer would have to sign the plat before final recording. Bob had remarked on the curb and guttering, fire protection, and stormwater management. No action was needed. A public hearing was held on Floyd & Deidre Shepard's request to re -zone from R-1 to R-6 property located on So. Ingleside Avenue. Mr. Sanderson asked Bob what the status was on our Masterplan and Bob replied he under- stands that Mr. Brady is in the process of getting the mapping from the County and he will have something to report at the next meeting. Dick said he wished these requests would wait until the masterplan presented that they seem untimely. Bob said in this case these people were trying to establish a home and to make them wait for 6 months would not be right. It was explained this was previously the land of Mr. McGrue down by Miller Street and there are two mobilehomes across the street and one on adjacent land. Bob explained that they are not talking about a trailerpark, that this is the way the ordinance is written. William Richmond asked what size piece of property this is. One acre. It was asked if anyone was present to object or anymore questions. Discussion led to a motion by Mike Ford to recommend to the city council the zoning change from R-1 to R-6 with a stipulation that this would be no more than two mobilehomes allowed on this property. William Richmond seconded and motion passed unanimously. A public hearing was held on a request by Jim and Cindy Boothe to re -zone from R-1 Low Density Single Family Residential to R-3 High Density Single Family Residence Ingleside Terrace(located off of Edwards Avenue). Mr. Sanderson read 2 letters he had received from a Mrs. Bonner and Mrs. Antinarella questioning the project and the impact it would have on the property and neighborhood, and stating they were against it. Clay Adams spoke representing Mr/Mrs. Boothe saying that they only wished to enhance the neighborhood. That if the -change is approved they would only be able to add 3 more houses, the yards would just be smaller, this is a cul-de-sac and they would maintain their own borders, put up fencing. A neighbor questioned the additional sewer and water lines, saying they have low pressure there now. Seth Moore said there is an existing water line and a new sewer line would be put in. Maxwell Killoch asked about surrounding zoning - it is all R-1. Mr. Killoch asked if this isn't spot zoning, that this runs against the comprehensive plan as we have it now. Mrs. Boothe said again that this would only allow 3 additional houses if changed, and they would only enhance the property not do anything to take away from the neighborhood. It was established that they would start out with a 1500 sq. ft. house and use 3 different designs. Bob asked if they had done a drainage calculation and Clay said no, they were waiting to see results of this request before spending that money. Richard Sanderson asked for comments from the audience for/against this. A lady living on Wesley Street said she had bought a large lot to keep her privacy and if they do this why can't she. Mr. Bodden said this would just bring more people, and he is against this. Another lady spoke saying the drainage now from the back of Food World is a problem and more traffic would be brought in, she is against i Maxwell Killoch moved to reject this request until we looked at the new master - plan. Motion died for lack of a second. Tim Kant moved to recommend re-zon as requested to the City Council. William Richmond seconded -motion and the vote was: For re -zone Kant, Pitman, Richmond, McBrearty. Against re -zone: Ford, Nix, Sanderson and Killoch. Re -zone request denied and this recommen to City Council. ng led Planning & Zoning Commission February 7, 1994 - page two A public hearing was held on a zoning request of R-6 Mobile Home Park zoning concurrent with annexation for the lands of Sara Klumpp located on Gayfer Avenue Ext. East of Baldwin County 27. Bob commented that this, land has not been annexed but this is the request they are making to be annexed. Mr. Sanderson called for comments and a gentleman who lived across the street said he was upset to arrive home one day and see a mobilehome park across the street from him. Mr. Sanderson had remarked earlier that he thought it was presumptious of them to develop this land into a mobilehome park as much as they had without this even being acted on. Bob said they can develop this as a mobilehome park now, that they are not under any zoning restrictions. He was asked if they were contiguous and he replied they would be by a strip of land joining them. That if they annex we have more restrictive regulations. George Klumpp spoke saying that they planned a nice mobilehome park, with land- scaping and skirting on the units. It was asked how many units planned - 35-Ist phase and 70 altogether. Rudy Khrut spoke saying that if they run a sewer line he thinks the neighbors should be able to join on to it as they are having problems with their land perking now. A lady spoke saying she was against it, that she runs a truck business now and that this would not be good next to them. Mike spoke saying he has to consider what is good for the community and the right to use the land as you want to. It was question whether or not the land would perk. It was said again that they can put it there whether we zone it for this or not, but it was pointed out that if they do not tie into our sewer lines they would be limited to the number they have because of perking situation. Fred Watkins spoke saying he is against it, that he has 6.9 acres and that the lights from this would shine right in his front window. Mike Ford asked if we could not put this off and look at the regulations of the county before making a decision, He moved to table it for a month. William Richmond seconded and motion carried unanimously. George Wright had asked to be heard regarding a petition from some residents on Fels Avenue about re -zoning their property. George was not present. The Commission said to convey that if someone wished to change their property back to residential they only needed to present an application. Tim Kant asked to be heard about a problem. He said the landfill is catching the devil from all the trash being generated by new construction. That he wished to suggest that this be hauled to the Magnolia landfill. He was asked about the lot clearing and he said it is now going to Magnolia Springs landfill, that there are dumpsters on the property of new houses but still a problem. Richard Sanderson said he wished to support Tim. A motion was made by Tim to recommend to the City Council that the city landfill stop receiving materials from new houses under construction, that they be instructed to go to Magnolia Springs landfill. Maxwell Killoch seconded and motion carried unanimously. Cecil Pitman, as an afterthought, suggested to George Klumpp that he might wish to consider in the development of his trailerpark having R-1 on the front of the property, single family homes as a buffer, and then put the trailers to the rear. All thought this a good suggestion. There being no further business, meeting was duly adjourned.
