Section Street Present: Chairman, Richard Sanderson; members William Lucey, William Richmond, Cindy McBrearty, James Nix, Mike Ford, Tim Kant Cecil Pitman The minutes of the December 13, 1993 meeting were duly approved on motion by Tim Kant, seconded by William Richmond and unanimously carried. Creekwood Unit 2 - An application of Del A. Corte for 3 lots on Scenic Highway 98(Main St). Mr. Sanderson asked Bob if he would share his comments with the Commission. Bob had written that this property lies within Flood Zones and that all lots would require certification of elevations by a Licensed Professional Engineer prior to issuance of building permits, further that the developers should be cautioned that all construction and fill must include safeguards to prevent runoff into Fly Creek. That subject to inclusion on the plat of written notes of the foregoing he recommended preliminary and final approval. Cindy McBrearty moved to approve subject to Bob's comments. Jack Lucey seconded and motion carried unanimously. Aryshire Glenn This was an informal plan review of 10 lots located on the north side of County Road 30 z mile east of Cty Rd 13. Bob had commented that this was not subject to the city's zoning regulations, and that the cul-de-sac as shown was a little over length requirement but he saw no reason to require a second bulb. Preliminary plat will require engineer' certification and site development will also require issuance of a permit by ADE Also we will need County Engineer's approval. No action was required today Richard Sanderson asked for any comments from the commission or the audience there were none. Preliminay plan will be considered at later date. Homestead Village Alteration of Preliminary Plan, PUD. Mr. Sanderson asked Mr. Liechty if he wished to show what proposed, and he came forward and showed the Commission what proposed. He said in getting his plans approved that he had run into a snag with requirements from the state and he had originally planned 2 -2 story buildings for managed care facility but now wants 1 - 1 story building and 1 -3 story building with height not to go over 35 ft. Tommy Springer was present and said he backs up to this property and questioned Mr. Leichty's plans.Leichty• explained the 3 st ry building would be 300 ft. from Mr. Springer's house and would in no way invade his privacy, that there would be a parking lot between the 3 story building and his house and that they had plans to plant trees between the building and any fencing, had plans to do a lot more landscaping, plant hundreds more trees. The question of raising the density was questioned and Bob said this would not change the density from what originally planned. Would be the same and that he had a letter stating this. The drainage plan was outlined for Mr. Ford who was not present when this first came before the Commission. There being no further questions or comments, Cecil Pitman moved to approve alteration of plan as requested, James P. Nix, seconded and motion carried unanimously. There being no further business, meeting was duly adjourned. TO: FAIRHOPE PLANNING COMMISSION FROM: Meeting of: 06 JAN 1994 Planning/Zoning Officer Creekwood Unit 2 - Application of Del A. Corte for Preliminary and Final Plat Approval Three lots on Scenic Highway 98 (Main Street) near the north corporate limits. Property lies within Flood Zones, Alo, B and C. All lots will therefore require certification of elevations by an Alabama Licensed Professional Engineer under provisions of the Flood Damage Prevention Ordinance, prior to issuance of building permits. The property abuts an existing public road and the area is less than would require implementation of Storm Water Management Criteria of the Subdivision Regulations for stormwater retention. However, developers are cautioned that all construction and fill within the lots must include safeguards to prevent runoff into and siltation of Fly Creek. Subject to inclusion on the plat of written notes to provide notice of the foregoing, Preliminary and Final approval is recommended. Aryshire Glenn - Informal Plan Review of Ten Lots, located on the north side of County Road 30 at approximately one-half mile east of County Road 13. The area of development is approximately 15.5 acres with a 700 foot cul-de-sac to provide access and frontage. The land is not subject to the city's zoning regulations. Although the proposed cul-de-sac is marginally over the length limit of 600 feet, I fail to see that the requirement for a secondary bulb, or turnaround, would serve the interests of either the developer or the public. Both the size of development and the requirement for a new street will invoke the stormwater management provisions of the Subdivision Regulations. Preliminary plat consideration will require engineer's certification as set out in the regulations. Site development will also likely require issuance of permit by A.D.E.M. Since the land lies within the extra -territorial jurisdiction, the County Engineer must also approve the plat. Therefore, preliminary plat consideration will not be scheduled until a letter of acknowledgment is forwarded to the City by the County Engineer, indicating that the engineer has received a copy of preliminary submittals for the development. ZOCOMM94.fpc 17,18,24 SEP 94 . .. Consideration of this plan is informal and requires no action by the Commission. Homestead Village - Application for alteration to Preliminary Plan, P.U.D. The proposal is to convert building plans from two-story garden apartments to two-story patio apartments at the west end of the property and in the south-central part of the property, behind the chapel. The change primarily affects the means of ingress/egress of buildings and the common areas and does not violate the density restrictions. The proposal also would increase the building height of the C.A.L.F. unit at the northeast corner of the property to three stories or 35 feet; a waiver of height limit is requested for this building because of state requirements for the particular license for this C.A.L.F. Mr. Leichty will be present to address the licensing problem. Given the proximity to the three-story building existing at A.H.E.P.A., I see no reason not to allow the height variance so long as the construction meets all building and fire codes and the state requirements. The Commission clearly has the authority under Section 4.12 of the Zoning Ordinance to consider for approval heights in excess of two -stories or 30 feet. That authority is implicit in the language of Section 6.62. ZOCOMM94.fpc 17,18,24 SEP 94
