at the Fairhope Municipal Complex, 161 N. Section Street, in the City
Council Chambers.
Present: Dick Charles, Chairman; Tim Kant, Dan McCrory, Bob Clark,
Ed Brinson, Larry Green, Jean Wilson, Mike Ford, Lee Turner. Christopher
Baker, Director of Planning and Betty Rivenbark, Secretary.
The minutes of the May 3, 2004 meeting were considered and approved on
motion by Bob Clark, 2"
d by Ed Brinson and unanimously carried.
IR 04.02 Public Hearing —Water and Sewer Regulations Adoption and
Amendment to S/D Regulations. Dan McCrory said after seeking input
this is corrections/modifications to Water and Sewer Regulations.
Christopher Baker said these were run through legal counsel, a public
hearing had been held, it had been published and copies available for
public review at City Hall. The public hearing was held and one comment
was received, Lee Turner moved to approve, Larry Green 2"

and it carried unanimously.
SD04.23 Replat of property of Ms. Lois Boykin of Lots 12 and 13
Village of Montrose(Generally located west of Main Street between
Daphne and Fairhope) Mr. Baker said this is a 3.62 acre parcel of property
located outside the city limits in our jurisdiction and is zoned by the County
as R2A-a residential district. The request is to make two lots out of one.
Staff recommendation was to approve. Matt Koontz of Geo-Survey was
present representing Ms. Boykin and said they already have approval of
the County. The 30 ft access easement was discussed and it was pointed
out there is already an existing drive to the property of 14 ft. Ms. Wilson
said there is no need to pave 30 ft. access easement if 14 ft. easement
was acceptable to the County. Mr. Baker said that this 14 ft. easement
needed to be recorded on plat for future reference. In discussion Lyons
Bousson questioned removal of trees and Mr. Koontz assured him there
were no plans to remove any trees. Lee Turner moved to approve with 14
ft. easement shown on the plat. Larry Green 2"d the motion and it carried
unanimously.
SD04.30 Minor Plat of Enviro Properties Subdivision/Joe
Johnson (Generally located at the northwest corner of Twin Beech and
Greeno Road). Mr. Baker said this is a 7 acre parcel located outside the
city and is not zoned. He is desirous of creating 5 lots. His
recommendation was to approve with note that no trees on Greeno Rd
ROW be moved or altered without city permission. Mr. Johnson said that
the only drive is located south of Ist lot and it has been approved and
installed. He has no problem with note on the plat. Tim Kant moved to

approve with note on the plat regarding the trees. Lee Turner 2"

motion and it carried unanimously.
SD04.33 Minor Plat of Sea Cliff Oaks/Trey Jinright(Generally located at
the intersection of Sea Cliff and Scenic Hwy 98 in Montrose) Mr. Baker
pointed out that there is an existing ditch located on the south property line,
that both lots meet county zoning and no board fence will be allowed on
Scenic 98. His recommendation was to approve. Mr. Jinright spoke saying
he plans to improve ditch on south side of property so water will run to Fly
Creek and will work with property owners. All questions answered
satisfactorily, Larry Green moved to approve, Dan McCrory 2"d the motion
and it carried unanimously.
SD04.34 Minor Plat of Dominion Acres, Phase 1/Charles
Houser(Generally located west of US 98 adjacent to Dominion Farms)Mr.
Baker said this a 20 acre parcel proposed to be divided into two 10 acre
lots located in the county and is not zoned. He recommended approval
subject to the reserved ROW being shown on the plat and city water being
required. Discussion followed with Jerry Perez of Bay Area Surveying. He
was told that the subdivision requirements require the reserved ROW being
shown on the plat. Mr. Perez said that he had no problem with showing
ROW on lot 2 but what if buyer of lot 1 wanted to build house in middle of
land in middle of ROW. Mr. Baker said this would be on paper only and
they work with individuals all the time if they wish to change placement of
ROW. After further discussion, Bob Clark commented he feels consistency
in requirements is important and moved to approve staff recommendation
and require ROW shown on plat and hook up to city water. Jean Wilson
2"d the motion and it carried with two nay votes by Lee Turner and Mike
Ford.
SD04.35 Preliminary Plat of Magnolia Place/Doug Harless(Generally
located north of Gayfer Avenue Extension across from White Grove S/D)
Mr. Baker said Mr. Harless has an option on this 20.3 acre parcel located
outside the city and not zoned. He cited drainage as being major issue as
there have been big problems with White Grove S/D and also said they
should install street trees as required by our regulations. He recommended
tabling this until July 6 meeting for complete drainage review and further
information. Discussion led to a motion by Larry Green to table until the
July 6 meeting to get complete drainage information and have third party
review also have E & O information. Lee Turner 2"d the motion and it
carried unanimously.

SD04.37 Preliminary Plat of Grouse Moor Subdivision/Richard
Meritt(Generally located north of Bishop Road just to the east of the
airport)Mr. Baker said Mr. Merritt owns this 15.1 acre parcel that they are
proposing to divide into 12 lots located outside the city but in the airport
noise and height district. He said further this is a Greenfield development
and is leap frog and the comprehensive plan does not support leap frog
development. They are requesting a waiver of running street to property
line and waiver of sidewalk requirement. He recommended approval
subject to curb and gutter, sidewalks, and a note on the plat regarding the
airport noise and height requirements. Discussion followed with Seth
Moore. He explained they are seeking a country environment and the lake
is on the north side of the property Larry Green said requirement is to pave
to property line. Jean Wilson moved to approve subject to concrete ribbon
curb on east side and nothing on west side of street. Motion passed with
Bob Clark, Bike Ford and Ed Brinson voting against motion.
SD04.38 Preliminary Plat of Highland Bridges Phase 2(Generally
located east of Cty Rd 13, south of Cty Rd 32 and east of the airport) Mr.
Baker said David Diehl is representing the owners of this final phase of this
development containing approximately 20 acres. They are proposing to
Create 14 lots. Mr. Baker said this was previously approved in 2000 and
Phase 1 developed and Phase 2 is substantially similar to the layout and
infrastructure. He said our subdivision regulations have changed and this
subdivision fits between our rural and urban development standard with
lots being about one acre each. He recommended approval with the
requested waivers. Joe Bullock spoke saying they are going to have a 10
ft equestrian trail around the development, they will pave to stub outs, have
80 foot right of ways and 70 foot front setbacks. After discussion, Lee
Turner moved to approve staff recommendation. Ed Brinson 2"d the
motion and it carried unanimously.
SD04.39 Final Plat of Miller's Crossing, Phase 2/Jason Estes(Generally
located north of Cty Rd 32 just to the west of the Newton School) Mr. Baker
said this contains approximately 19.89 acres and is proposed to be divided
into 45 lots and is not zoned. He said all issues have been met or agreed
to and he recommended approval. Discussion led to a motion by Larry
Green to approve subject to Fire Department approval. Jean Wilson 2"d
motion carried unanimously.

SD04.40 Review of the Eastern Shore Trail
through Montrose. Christopher Baker said t e trail will run on the east side
of Main Street from the current terminus near Judge Roy Bean's in Daphne
to the Fairhope terminus near St. James Episcopal Church. There will be
some bridges constructed to transverse Fly Creek, Rock Creek and a gully.
This is a 6' wide multi -modal concrete pedestrian/bicycle trail. He noted 11
trees will be removed but replaced. He recommended approval. Cara
Stalman spoke for the county and said this is the "missing link" between
Fairhope and Daphne. It was pointed out that this will be maintained by
the county until such time the city takes over Scenic 98 for maintenance.
Larry Green, for the record, congratulated them for wonderful job they've
done and moved for approval as per staff recommendation, Ed Brinson 2"d
the motion and it carried unanimously.
SR04.05 Site Plan Review new Church Mouse building/Spencer
Johnson (Generally located on west Church Street just before Fairhope
Avenue)Mr. Baker said this has been several restaurants and is zoned B2
in the Central Business District. He recommended approval. Mac Walcott
spoke on behalf of Mr. Johnson saying that the previous dining room and
courtyard have been removed and the building will be extended to the
street. He said no more runoff will be there than what there before. Larry
Green moved for approval, Ed Brinson 2"d the motion and it carried
unanimously.
Under old business, Christopher Baker said that he was asked to look into
zoning issues with house moving and that the City Council needs to
address this and he had nothing to report on removal of property into the
CBD driven by site plan review.
The July meeting date was changed to July 6th, meeting was duly
adjourned at 6:35 PM.
