May 3, 2004 at the City Administration Building, 161 N. Section Street at
5:00 PM.
Present: Richard Charles, Chairman; Tim Kant, Larry Green, Bob Clark,
Jean Wilson, Ed Brinson, Mike Ford. Christopher Baker, Director of
Planning & Zoning, Betty Rivenbark, Secretary. Absent: Dan McCrory,
Lee Turner.
The minutes of the April 5, 2004 meeting were duly approved as written on
motion by Larry Green, 2"d by Bob Clark and unanimously carried.
Christopher Baker advised the commission that Fairhope had received an
award from the American Planning Association as Best Planning Program
in the State.
SD04.21 Minor Plat approval of R.J. Rezner for The Orchard(Generally
located east of Cty Rd 27, north of Gayfer Ave. Ext.) Mr. Baker said that
this was a 39.5 acre parcel they are dividing into 5 lots located outside the
City Limits and not zoned. He said everything is in order but mentioned that
lots 3 and 4 will have access only to the reserved ROW and if lot 5 is
subdivided in the future the ROW will have to be given to the Eastern
property line. Also, the owner has agreed drainage will be performed at
the time of the building permit as there is not a layout at this time. He
recommended approval subject to note on the plat with the access
limitations as mentioned. A motion was made by Larry Green to approve
with access limitation note on the plat. Ed Brinson 2"d the motion and it
carried unanimously.
SD04.24 Minor Plat of Lot 4 Brannon Park(Generally located north of US
98 just before the Fish River Bridge)Joe Bullock of EDS was representing
the owner A & B, LLC. Mr. Baker said this is a resubdivision of Lot 4 and is
located outside the city limits and is not zoned. He said all issues have
been met or agreed to and his recommendation was to approve. A motion
was made by Larry Green to approve, 2"d by Bob Clark and unanimously
carried.
SD04.25 Final Plat approval of Gayfer Estates Plantation, Phase 1,
Jerry Gilbreath(Generally located at the Blueberry Lane and Gayfer
Avenue Ext.) Mr. Baker said this is a 22.28 acre parcel being divided into
47 lots and has been annexed in the city as R1-Single Family Residential
and they are R-1 non conforming, as they were preliminary platted before
they annexed. He said everything is in order and recommended approval.
Larry Green said the developer should be commended for following staff
recommendation and moved for approval, Jean Wilson 2"d the motion and
it carried unanimously.

SD04.26 Minor Subdivision approval of Bosby Subdivision/Alfred
Bosby(Generally located west of south Ingleside, north of Twin Beech
Road) Mr. Baker said this is a 3 acre parcel in the City Limits, zoned R1
Single Family Residential that fronts on Ingleside and they are proposing to
create 3 lots. He said even though these are one acre lots his
recommendation was to approve subject to establishing finished floor
elevations for each lot as there are some drainage issues over there and
establishing the finished floor elevation will eliminate that problem for future
buyers/builders. Jean Wilson moved to approve subject to staff
recommendation. Ed Brinson 2"d the motion and it carried unanimously.
SD04.27 Informal Plan Review of Hunter's Glen Phase 3/Lennart
Holmberg (Generally located east of Cty Rd 13, north of Twin Beech Road)
Mr. Baker went over the history of Hunter's Glen said that Phase 3 does
not meet our current subdivision regulations as proposed. He said Phase 3
as proposed is a cul-de-sac. That the previous phases had been approved
in 1993 and 1995 although not built until later. He recommended giving
input while requiring that sidewalk and trees be installed as required and
that future phases of this development meet the subdivision regulations.
Carlton Niemeyer in conversation with Mr. Baker had said that the road
base for this phase was constructed in the early 90's and is requesting
approval as is. The question was asked how many lots planned. Walter
Scott of McCrory Williams spoke saying that 47 lots were shown in the
master plan. Tim Kant said the lots are almost an acre. Christopher Baker
said that when the preliminary plat comes before him he can write a letter
to Mr. Holmberg telling him any future plans must meet subdivision
regulations. Jean Wilson said that we should require sidewalks and trees.
Mr. Scott said they plan to do that. No motion was required.
SD04.28 Informal Review of Highland Bridges, Phase 2(Generally
located east of Cty Rd 13 south of Cty Rd 32 near the airport) Mr. Baker
said that this is located outside of the city but in the ETJ and falls within the
airport zoning and noise districts. He said this was approved in 2000 before
our current subdivision regulations and the lot sizes fall in the "urban"
parameters of the current regulations. It was designed as rural type of
development with an equestrian easement across the back of all of the
lots. David Diehl of EDS spoke saying the lots are a little over an acre with
70 feet front setback, they have street trees in the 80 ft ROW with swale.
Dick Charles mentioned that it falls within the airport zoning district and
they need to be aware of this when building. The preliminary will be filed
next month. No action was required

SD04.29 Informal Review of proposed development east of Cty Rd 13
north of Twin Beech Road. Mr. Baker said this is a 24.6 acre parcel and
they are proposing 63 lots currently outside the city with no zoning. Mr.
Baker said that water is available to serve this development and sewer is
available at Morphy, they will have to provide a lift station for the 10,500 ft
lots they are proposing. He said there are several locations of greenspace
and that they should be grouped together. The engineer has been advised
of stormwater requirements. John Peterson spoke for Mr. Alonzo and said
drainage will be a challenge. Larry Green mentioned again the green areas
and need for combining. Mr. Peterson said they prefer a detention area
and it will not be included in the open areas. No action was required.
SD04.31 Minor plat approval of Finger Industrial Park(located at the
industrial park off of Greeno Rd)Planning has approved it twice before and
it was never recorded. Seth Moore spoke said they have a buyer for the
building. Tim Kant said the Economic Board had showed it. Larry Green
moved for approval, Ed Brinson 2"d the motion and it carried unanimously.
SD04.32 Request of Lee Turner for Section 11.52.11 Review of Sewer
and Water Extension(Generally located east of Scenic 98, south of
Bailey's Creek in the Point Clear area) Mr. Baker said under section
11.52.11 the planning commission is to review and approve the location,
character and extent of utility extensions to make sure it is in compliance
with the comprehensive plan. Mr. Baker said further this had been
recorded for approximately 40 years. He recommended approval. Larry
Green moved to approve, Ed Brinson 2"d the motion and it carried
unanimously.
SR04.01 Request of Kevin Boone for Site Plan Review of a new
building at Church Street and Fairhope Avenue. Mr. Baker said this is
where the gumbo shop is located on Church Street and is zoned B2 in the
Central Business District. They are proposing a combination of business
and residential. He said off street parking will be supplied and the height
requirement will not be exceeded. He recommended approval. All
questions answered satisfactorily, Larry Green moved to approve, Ed
Brinson 2"d the motion and it carried unanimously.
SR04.02 Request of Bill Hyatt for a Site Plan Review of a proposed
retail center(Generally located east of Greeno Rd north of Pizza Hut and
south of Rite Aid) Mr. Baker said the property is zoned B2 and surrounding
properties are also B2. He cited significant drainage issues with this
property. He said no additional curb cuts are being proposed and it

would be nice if the developer agreed to move the building forward, but he
has not indicated he would do so. Mr. Hyatt has submitted lighting and it is
being checked out. Mr. Baker recommended approval. Discussion
followed on the drainage problems on this lot in the past. Frank Dagley,
the consulting engineer, said they had gotten input on design and city
ordinances. He said they only plan to contain their water not solve the
city's problems.

Further discussion led to a motion to approve by Ed Brinson 2"d
by Tim
Kant, more discussion led to an amended motion and amended 2nd to
approve with drainage being resolved on this property to city's satisfaction
and an independent person making drainage calculations, at developers
expense, on this property before final approval given. Motion carried
unanimously

Per staff recommendation, a public hearing date of June 7, 2004, time of
June Planning & Zoning meeting, was set to consider the adoption of new
Water and Sewer Regulations and amendment to the Subdivision
Regulations.
Under old/new business Christopher Baker asked for a site plan review of
the Ham/Stankoski building. He said they will be directing water to the
street and that it is 34 ft to the top shed roof with retail in the bottom of the
building and offices in the top. He recommended approval. Tim Kant
moved to approve, Ed Brinson 2"d the motion and it carried unanimously.
Tim Kant asked that Christopher Baker look into current ordinance on
moving houses and any zoning issues, look at Central Business District out
of the site plan review ordinance. And location of houses when moved and
report back next month.
