The Planning & Zoning Commission meeting was held Monday, November 1, 19�
at 5:00 p.m. at the City Administration Building, 161 N. Section Street.
Present: Maxwell Killoch, William Lucey, Cecil Pitman, William Richmond
Cindy McBrearty, Mike Ford. Zoning Enforcement Officer
Robert lunsford and Betty Rivenbark, Secretary
The minutes of the October 4, 1993 meeting were duly approved on motion
by William Lucey, seconded by Mike Ford and unanimously carried.
Martin's Bluff - Final Plat approval was being sought by John Martin for
this two lot subdivision south of Sans Souci. Bob had remarked that it
is an adjustment to the lot line that before the lot line had one lot on the
highway and one lot on the bayfront and now he is dividing in the middle
with both having bay frontage. Carolyn Boothe spoke to the commission
saying their property was next to his and questioned what they were doing.
Mr. Lunsford showed them how the existing 2 lots were going to run.
When she saw what planned she had no problem with it. Bob said this
plat meets the requirements and recommended approval. Cecil Pitman
moved to approve as recommended, Cindy McBrearty seconded and motion
carried unanimously.
Willow Pond - Site Plan Review of 24 unit apartment complex located at
Gayfer Avenue and Bishop Road. Bob had commented that before the
building permit is issued the developer must provide the following:
1. Landscape Plan; 2. Drainage calculations indicating balance of differentia
runoff; 3. Construction plans sealed by an Alabama architect; 4. Affidavit
of architect that design meets requirements of all laws, codes and ordinances;
5. Utility connection plan. He said further that the site plan presented
met the density requirements of the ordinance and adequate parking was
shown. David Christiansen from the architect's firm was present and
answered questions about the drainage plans. Mr. Ford asked about the
runoff and Mr. Christiansen said the layout takes into consideration the
water rentention and the water runoff will be no greater than before.
Mr. Lucey said he saw no problems with them proceeding with the plans
with the conditions that Bob had outlined. No official action was taken
but they were advised to proceed.
Rock Creek - PUD - Phase II - A re -subdivision of Lot 175, Phase I was
being requested. Bob had commented that when the property was put in
the public assessments several large tracts were designated as lots in
Phase I and this proposal consists of 57 lots with a portion ( lot 232) again
reserved for future development. He said the improvements in this phase
will not be developed under a public assessments program, but will
be installed by the developer. They are requesting preliminary and
final approval at this time subject to irrevocable standby letter,of credit
guranteeing installation of improvements and also indemnifying the city's
interest in the public assessments matter. He noted the City Council
must approve the form and amount of the letter of credit with respect
to the assessments program. Further, he had no problem recommending
conditional preliminary and final approval subject to conditions precedent
to such approval being met and a final set of plans with all changes
arising from Pre -construction conference noted thereon and filed with the
city, conditions being 1. irrevocable standby letters of credit, approved
by the City Council; and 2. a pre -construction conference (scheduled for
9:00 A.M. Wednesday morning 11/3/93) with the Commission's representative
City's General and departmental superintendents and developers engineer
with regard to installation and location of drainage and utilities. Any
material changes arising from such conference shall be noted on the plat
and the plans and a copy shall be filed with the City, which revised copy
shall have the current endorsements of the owners and the engineer affixed
thereto. Cecil Pitman moved for approval subject to what outlined by Bob,
William Lucey seconded and motion carried unanimously.
There being no further business, meeting was duly adjourned.
