HomeMy WebLinkAbout06-07-1993 Planning Commission MinutesTO: FAIRHOPE PLANNING COMMISSION FROM: Meeting of: 07 JUN 1993 Planning/Zoning Officer EASTGATE UNIT 5 - Application of Roberds Corporation and FSTC for informal plan review - 14 Lots as a subdivision with a privately maintained street for development of patio garden homes under provisions of R3p9h Zoning Provisions. The area is currently zoned R-5, which permits uses in other residential categories. The lots as delineated meet the minimum frontage requirement of 40 feet and also meet the minimum area requirement of 4000 square feet, with privately maintained street. As a privately maintained street there is no right-of-way provided. Easement for ingress and egress for service and emergency vehicles will be provided and easements are shown for installation and maintenance of utilities. The street construction will have to conform to minimum requirements of the subdivision regulations, except that pavement width could be reduced to IS feet. Developer's attention is directed to Section 405 of the Regulations relating to privately maintained streets. On preliminary approval, engineering plans will be required for street and utility installation, private street or not. It will be to developer's advantage to assure that no utility mains are buried beneath the paved street. No formal action is required or appropriate for this informal submittal. THE COTTAGES UNIT 4 - Application for Preliminary and Final Plat Approval, Philip Gilchrist, et al. Plat submitted without Owner's Certificate executed - P%ejected as incomplete submittal and will not be placed on the agenda for June meeting. ZOCOMM93 CRESCENT POINT - Application for Informal Plan Review, Pelican Properties, 13 Lots on existing County Road 1. Applicant has requested review by the following agencies: Corps of Engineers - wetlands determination ADEM - NPDES Permit, storm water discharge Health Dept - Underground sewage disposal County Highway Dept. - Access of Co. Rd. 1 Fairhope Water Dept. - potable water supply Applicant may use marginal access road as an alternative to access Lots 1-5. Construction of such access and right-of-way width will have to meet the more restrictive of either City or County standards. I expect that the City will require a single bore under the existing county road and installation of a pipe of sufficient size to serve all lots from the eastern side of the road (or canal), rather than having to make multiple bores for services. If the marginal access road is to be constructed, final plat approval will occur only after construction is complete or a financial guaranty for completion is posted and approved. This application requires no formal action at this time. GENERAL NOTE: I expect to present to you on June 7, for your study and consideration for a public hearing at the July or August meeting the following: 1. General revisions to subdivision regulations in preparation for codification of same 2. Storm Water Drainage, a modified version of the policy promulgated by the County, which is included in the recommended revisions in 1 above as Section 804 3. General revisions to Commission by-laws Please also take note of the attached Procedure for Planning Commission Review, revised to provide the opportunity for the General Superintendent and the Superintendent of Public Works to be involved in the review process. ZOCOMM93 The Planning & Zoning Commission met Monday, June 7, 1993 at 5:00 p.m. at the City Administration Building, 161 N. Section Street. Present: Chairman Richard Sanderson, members Maxwell Killoch, Cecil Pitman, Tim Kant, David Bishop, William Richmond, Cindy McBrearty, Robert Lunsford, ZEO, Betty Rivenbark, Sec. The minutes of the May 3, 1993 meeting were approved as written on motion by Maxwell Killoch, seconded by Cecil Pitman and unanimously carried. Eastgate Unit 5 - Informal Plan Review - 14 lots, Roberds Corp. R3PGH Mr. Sanderson commented that no action was required on this. Bob' s comments said that this would .have a privately maintained street. He had further commented that the necessary easements would be provided and that engineering plans will be submitted when preliminary approval is sought. Cresent •Point - Informal Plan Review, Cty Rd 1 13 lots Bob had commented that the applicant has requested review from: Corps of Engineers on wetlands; ADEM - NPDES Permit, for stormwater discharge; and Health Dept for underground sewage disposal; the County Highway Dept, access of Cty Rd. 1; Fairhope Water Dept for potable water supply. During discussion it was pointed out that one bore would be allowed for utilities and that a marginal access road could be allowed. Further discussion led to comments that the developers may consider bringing the road further into the the lots and have a cul-de-sac and have 12 lots instead of the 6 shown. If they decide to do this they will have to bring in another sketch plan. If they put in regular road they will have to meeting requirements of more restrictive entity and only after construction is complete will they get final plat approval or they will have to present financial guaranty. They were encouraged to proceed with plans. Bob presented to the Commission copies of the proposed revisions for the subdivision regulations in preparation of codification of the same including a stormwater drainage plan and also by-laws of the Planning Commission for review for public hearing at a later date. There being no further business, meeting was duly adjourned.
