VICTORIAN VILLAGE ESTATES Application for Final.Plat
Approval, 24 Lots. Paving of streets in this development
is partially complete.'. Developers propose to furnish
personal bond satisfactory to the City for guaranty of
completion of improvements. Owing to abandonment of
Julia Drive connecting Plantation Boulevard to Edwards
Avenue, it is imperative that the developer provide a
general right-of-way easement extending from Plantation
Boulevard through the Homestead to Edwards in order that.
the public be assured of similar continuity of access to
that which was to have been provided by Julia Drive.
That general easement should be recorded at the same time
as the plat.
ROCK CREEK P. U. D. - Application for Final Plat Approval,
180 Lots including 4-commercial areas. Final subdivision
plat approval is recommended subject to the following
conditions:
1. Installation of temporary turnarounds at the ends of
Rock Creek Parkway and Beaver Dam Road and as
req_ui�red a subdivision regulations.
2. All required signatures appearing on Plat
3. Names of Owners and adjacent land owners on Plat
The required improvements are being constructed under
public assessment and installation is guaranteed by
performance bond of general contractor and the special
assessment lien. The final approval of this plat for
purposes of recording is not a waiver of any legal,
regulatory or technical requirement as a condition
precedent to final acceptance of the streets and utilities
therein by the City under the assessments program.
THE WOODLANDS IN FAIRHOPE - Application for Final Plat
Approval, 23 Lots. Plat appears to be in order and final
approval is recommended. The required improvements are
being constructed under public assessment and installation
is guaranteed by performance bond of general contractor
and the special assessment lien.
GREENBRIAR S/D - Application for Final Plat Approval, 16
Lots. The required improvements are being constructed
under public assessment and installation is guaranteed by
performance bond of general contractor and the special
assessment lien. This property is located on the west
side of Blue Island Street north of Fairhope Avenue.
Final Plat of Lots 1-3 as Unit 1 is recorded at Slide
1233-A. Final Plat approval of Unit 2 as Lots 4-19.is

HUNTER'S GLEN - UNIT 2 - Application for Prelimin ry
Approval, 12 Lots. This is a application continue from
the April hearing. Both plat and plans appear to be in
order and preliminary approval with license to construct
is recommended. I have no problem recommending final
approval for this plat subject to posting of required
bond by developer, if developer so wishes.
GABEL STATION - UNIT 2 - Application for Preliminary
Approval, 6 Lots. This application involves the
construction of some 120 feet of additional street
primary a relocation of the cul-de-sac and the extension
of water and sewer services. No construction plans were
submitted with plat and endorsements were not shown on
plat. Applicant was advised to resubmit corrected plans.
At this writing such has not been received. If proper
submittal is available at meeting, it may be reviewed =
during meeting at Commissions discretion. I cannot offer
a recommendation on that which I have not had. adequate
time to review.
QUAIL CREEK'EST. - UNIT 2 - Application for Preliminary
Approval, 18 Lots. Application is recommended for
approval, subject to the following: -
1. Temporary turnarounds as required by the regulations.
2. Providing the City a copy of plat showing assigned
911 type property number for each lot.
3. All required endorsements appearing on plat.
4. Tangent lengths being include in curve date.
Subject property lies south of the west end of existing
Quail Creek Drive at Lakeshore Drive.
THE VILLAS - Application for Preliminary Approval, 18
Lots. Application is recommended for approval subject
to the following:
1. Providing the City. a copy of plat showing assigned
911 type property number for each lot.
2. All required endorsements appearing on plat.
3. Temporary turnaround as required by regulations
4. Council's permit to access Quail Creek Drive
Subject property lies south of Quail Creek Drive near
the existing tennis courts and pool.
FIRST ADDITION TO MONTROSE WOODS - Submittal of Informal
Plan Review, 5 Lots. Land lies east of U. S. 98, south of
existing Montrose Woods Drive and is adjacent to Rock
Creek. The parcel lying between Lot 5 and Lot 25 of
Montrose Woods is not designated with a lot number and it

is unclear what disposition of this parcel is intended.
It should be designated as a lot or noted as excluded from
the subdivision. Developer should be encouraged to
provide 911 type property with his preliminary plat
submittal. Also, on preliminary submittal, applicant
should indicate water supply and level of fire protection
to be provided. No'formal action is required on this
informal submittal. Land is outside corporate limits.
BAY OAKS S/D - Submittal of Informal Plan Review, 5 Lots
outside of City on the north side of existing Buerger Lane
on the west side of Scenic 98 at Battles Wharf. Developer
will be required to provide public water service to lots.
The encroachment onto Lot 5 of building existing on Lot 6
should be cured before formal submittal of plat.
Developer should be encouraged to provide 911 type
property addresses with formal submittal. No formal
action is required for this informal submittal.
General note:
Recent conversation with Teddy King of the Health
Department reveals concern on their part with an
endorsement on preliminary plats regarding health
department approval. Their procedure is that no
approval is final except upon issuance of permit,
installation and final inspection of fields on a
lot by lot basis.
It is therefore imperative that all recognize the
possibility of a lawfully platted lot which is not
saleable for usable in the absence of health department
approval for underground sewage disposal.
Absent -direct control over approval process for such
sewage disposal, I believe that the Planning Commission's
role is limited to advising the developer that the health
department does have final authority. I believe that can
be accomplished by requiring the following certificate to
be endorsed on all formal plats, preliminary or final:
"A copy of the within proposed plat has been received by
the Health Department on the date noted and is hereby
acknowledged. This endorsement does not constitute any
level of approval for the design, location or installation
of underground sewage disposal systems. Such approval can
be obtained only on a lot by lot basis upon application of
lot owner to the Health Department.

The Planning & Zoning Commission met Monday, May 3, 1993 at 5:00 p.m.
at the City Administration Building, 161 N. Section Street
Present: Chairman Richard Sanderson; members William Lucey, Cindy
McBrearty, James P. Nix, Tim Kant, Maxwell Killoch, Cecil
Pitman, David Bishop
The minutes of the April 3, 1993 meeting were duly approved as written
on motion by Cindy McBrearty seconded by William Lucey.
Hunter's Glen - Unit 2 Preliminary approval on 12 lots was considered.
This was carried over from last meeting and Bob had commented that the
plat and plans appeared to be in order and he recommended approval
subject to posting a bond by developer. William Lucey moved to approve
preliminary as requested subject to posting bond, Maxwell Killoch seconded
and motion carried unanimously. Leslie Stejskal spoke from the audience
mentioning that his only concern was the water coming off of this develop-
ment and that Carlton had assured him that a detention pond would be built
and he wanted to go on the record as voicing his concern.
Rock Creek - PUD Application for final plat approval was being sought.
This involves 180 lots including 4 commercial areas. Bob had recommended
final subdivision plat approval subject to: 1. installation of temporary
turnarounds at the ends of Rock Creek Parkway and Beaver Dam Road
2. All required signatures appearing on the plat and 3. names of owners
and adjacent land owners on the plat. Cecil Pitman moved for approval
subject to these 3 things recommended and Cindy McBrearty seconded
and motion carried unanimously
Woodlands - Unit 1 Final plat approval for 23 lots. Bob had noted that
the plat was in order and recommended approval and that this was being
handled under a public assessment program and guarantee by performance
bond of general contractor and the special assessment lien. David Bishop
moved to approve on Bob's recommendations, Maxwell Killoch seconded and
motion carried unanimously.
Victorian Village Estates - Final plat approval on 24 lots was being sought.
Bob had mentioned that they had not paved 200 ft. and subject to a bond bein
posted and subject to right of way deed being given extending from Plantation
Blvd through the Homestead to Edwards he recommended final plat approval.
He further noted that general easement should be recorded at the same time
as the plat. Tim questioned a drain box out there. Bob said all recommenda-
tions were subject to a final inspection also. William Lucey moved to approve
noting all Bob's recommendations. Maxwell Killoch seconded and motion
carried unanimously.
Greerbriar Subdivision - 16 lots for final plat approval. It was noted that
the required improvments are being constructed under a public assessment
program and installation is guaranteed by a performance bond of general
contractor and the special assessment lien. Bob recommended approval subject
to all signatures appearing on the plat. Mr. Moore mentioned that they had
them. Maxwell Killoch moved to approve, Cindy McBrearty seconded and
motion carried unanimously.
Gabel Station - Unit 2 6 lots. Bob had written that this involved 120 ft.
of additional street, a relocation of the cul-de-sac and the extension
of water and sewer services. Further, that he had not submitted construction
plans and endorsements were not shown on plat. He said he had advised
applicant to resubmit corrected plans but had not received them yet.
Tim asked if they were repairing the streets. Bob said extending and repairii

The Villas - PGH - 18 lots. This was reviewed and preliminary approval
was recommended subject to 1. providing a plat showing assigned 911 type
property numbers for each lot, 2. all required endorsements appearing
on the plat. 3. Showing the temporary turnaround as required by the
regulations. 4. Permission from the council to access Quail Creek Drive.
James P Nix moved to approvel preliminary subject to 4 things outlined by
Bob. William Lucey seconded and motion carried unanimously.
Quail Creek Estates - Unit II 18 lots. Bob had recommended approval
subject to: 1. Temporary turnarounds being installed. 2. Providing a plat
showing assigned 911 type property numbers for each lot. 3. All required
endorsements appearing on the plat and 4. Tangent lengths being included
curve data. Tim Kant moved for approval subject to what Bob outlined.
Cecil Pitman seconded and motion carried unanimously.
Bay Oaks S/D An informal plan review for held on 5 lots on Buerger Lane
( property at Battles Wharf outside the city limits) Bob had mentioned that
developer would be required to provide public water service to these lots.
There was a problem with encroachment of building on lot 6 on lot 5 that
needed to be addressed, we needed 911 property addresses with formal
submittal. All agreed with Bob's comments and said to proceed.
Montrose Woods Preliminary review 6 lots. Bob said he saw no problems
at this point, would ask for 911 numbers and ask that they indicate the
water supply and level of fire protection if provided.
Bay Chase S/D 3 lots Volanta & Mobile Ave. Preliminary and final could
be given subject to all endorsements being on plat. Clay Havard spoke
saying he lived up there and wondered what water effect would be unless
planned curving and sidewalks. Further most of this property was involved
in wetlands for last 40 years. That we should have further investigation
on this as Fly Creek is silting in there now that we should be very careful
about what done up there. Mr. Turberville the owner of the lot in question
spoke saying that he doesn't understand problem with the drainage as he
has talked to Mr. Rutherford and he said they would extend the ditch
on the south side down Volanta Ave to the bay. That this is not wetlands
nor in flood zone. He has discussed this with the building dept.
Bob said we could check with the corps on the wetlands issue. Mr. Turber-
ville said he did. A gentleman in the audience questioned the railroad R.O.VI
Mayor Nix said this question came up a while back and a review revealed
no right of way dedicated and the city did not have a claim to anything.
The question was asked what about Mobile Avenue. and he said no plans
to open to Volanta. Further discussion led to Cindy saying a lot of concern
has been expressed about this area and we would like to be assured there
would be no additional drainage problems as well as we would like verification
that this is not wetlands. Mr. Turberville said he would like to build a
house on Block F and subdivide into 3 lots. He said he has re-routed some i
the water. That he has taken 3 ditches and re-routed to one ditch to run
to the bay. Bob said he would like to modify his recommendation to give
preliminary approval only at this time. William Lucey moved to carry this
over to answer the questions being raised before giving final approval.
Cindy McBrearty seconded and motion carried unanimously.
Bob had also included note regarding health department approval.

There being no further business, meeting was duly adjourned.
R E S O L U T I O N
WHEREAS, the owners of certain lands described below,
which lands are located generally north of the corporate
limits of Fairhope, Alabama as the same existed at the
end September, 1992 and which lands are further described
in those certain Petitions for Annexation filed with the
City of Fairhope, and;
WHEREAS, the Fairhope Planning Commission in special
session this date has reviewed the said petitions, and;
WHEREAS, the Fairhope Planning Commission perceives the
annexation of said lands to the City to be wise,
expedient and necessary for the mutual benefit of both
the owners and the City, and;
WHEREAS, the subject lands are:
Aldea Subdivision, Lots 1 and 2
Rock Creek Subdivision, All lots
Wild Oaks S/D, Lots 1-3, 15, and 18-21
Ecor de Chene Subdivision, Lots 1 and 2
Gartrell Agee Lands, per RPB 53 PAGE 779;
NOW, THEREFORE, BE IT RESOLVED by the Fairhope Planning
Commission that the Commission's chairman be, and hereby
is, authorized to transmit this Resolution to the Fairhope
City Council as the Commission's recommendation that the
Council proceed forthwith to adopt an Ordinance annexing
the said property to the City of Fairhope and, further,
that the Executive Secretary be, and hereby is, directed
to preserve a copy of this Resolution in the official
minutes of the Special Session of the Fairhope Planning
Commission convened at Fairhope City Hall at 5:00 p.m.
on the llth day of March 1993.
