TO: FAIRHOPE PLANNING COMMISSION
Meeting of: 01 FEBRUARY 1993
GENERAL COMMENTARY - Applicable to all preliminary
plat applications: It is respectfully requested that
all plat approvals be conditioned upon requirements set
out in planning/zoning officer's commentary (as acceptable
to the commission) and that minutes reflect such with a
copy of commentary referenced therein. It is also
suggested that specific License. to Const.ruct of the form
attached be authorized by amendment of the Commission's
by laws and that no work be allowed to begin on any
improvements until such license shall have been issued.
RIVER OAKS S/D - UNIT ONE - Application of Dr. Barnes
for Preliminary Plat Approval of 38 Lots and license to
construct improvements. The property i@ located on the
west side of Boothe Road between Twin Beech and Nichols.
and is -zoned R-2 for Single Family Residential Use.
The general plan of development indicates a total of
§@m@ 171 lots to be developed in stages. The general
plan is accepted to provide continuity of review but
is not to be considered a preliminary master plat.
Dr. Barnes owns all land abutting Unit One and there are
no notices to other owners required.
Except for one retention pond located adjacent to Boothe
Road, all stormwater from this unit will outflow onto
Barnes' property.
Double frontage lots between Boothe Road and Oakwood
should be provided with a ten -foot permanent planting
easement to screen rear yards from Boothe Road. There
should be required a tight evergreen hedge six feet in
height for that purpose.
Lot numbers should begin with one and be numbered in
series, with each units numbers independent of other units
Oakwood should be designated Oakwood Street since it runs
north and south. Driftwood should be designated Driftwood
Street since it begins in a north south direction and
continues on a diagonal to the quadrant. Other suffices
such as "drive", "court", "circle", "way", "place",
"boulevard" and the like are acceptable without regard to
direction of street since such are not indicated in the
regulations to imply a sense of direction.

It is noted that the radius of curvature of 100 feet shown
at two locations is at variance with the regulations,
which would require a 300 foot radius with a right-of-way
width of 60 feet. However, since the required radius of
curvature is a function of design speed rather than width
of street, that requirement should be waived. Further,
as regulations are revised in the future, such design
standards probably should be referenced to requirements of
the AASHTO design manual. Section 20-5 of the Fairhope
Code of Ordinances fixes the speed limit in residential
districts generally at a maximum of 25 miles per hour.
Preliminary Plat approval and License to Construct is
recommended -subject to the following conditions:
1. Designation of planting easement and screening for
double frontages on Boothe Road
2. Correction of lot numbers as set out above
3. Proper street suffices as set out above
4. Pre -construction conference among developer, his
engineer, city personnel and contractor
5. Locations of gate valves and fire hydrants shall be
subject to approval of fire department and water
department at preconstruction conference. ,
6. Sanitary sewer manholes shall be located at intervals
not to exceed 400 feet.
7. Curb radii at block corners shall be minimum of 40
feet to front of curb and the radius point shall be
common to that of the block corner.
8. Stormwater inlet and catch basin designs shall conform
to city's standards.
9. Remove set back lines from plat; note on face of plat
that "Building Setbacks shall conform to requirements
of Zoning ordinance in effect at time of aPPI i cat.i on
for Building Permit".
10. Furnish City two copies of corrected plat and plans
with required changes thereon.
CAMBRIDGE COURT - Application of Barrie -Chapman
Development, Inc. for Preliminary Plat approval and
License to Construct Improvements for 17 Lots on the
west side of Bon Secour north of Forster Avenue:
This plat is recommended for Preliminary Approval and

License to Construct subject to the following conditions:
1. Completion of Owners Certificate and Acknowledgement
on face of Plat
2. Notation on face of plat to effect that: "Building
Setbacks shall be as required by Zoning ordinance
requirements in effect at time of issuance of Building
Permit"
3. Shift SS Manhole No. 5 and show lateral connections
for Lots 16 & 17
4. Provide 10-foot planting easement with 6-foot screen
along rear of Lots 7 and 8 to separate townhouse area
5. Evidence of application for NPDES Permit from ADEM
6. Adequate measures to control runoff and erosion of
site during construction
7. Engineer's or Surveyor's seal on Contour Map
8. Pre -construction conference among developer, his
engineer, city personnel and contractor
The requirement of Section 708.8 that reverse curves be
separated by a tangent of at least 100 feet may be waived
in this case because of the maximum speed limit of 25
miles per hour imposed on residential streets.
GATEWOOD 5/D - Application of FSTC & Lessees for
Preliminary and Final Plat Approval of four lots on the
east side of Bishop Road between Morphy and Fairhope.
An additional 10 foot easement is provided along the
frontage for use as right-of-way and utilities
installation.
Plat appears to be in order and Final Approval is
recommended without conditions.

Planning & Zoning Commission met Monday, February 1, 1993 at 5:00 p.m.
at the City Administration Building, 161 N. Section Street.
Present: Chairman Richard Sanderson; members William Lucey, Maxwell
Killoch, Cindy McBrearty, William Richmond, Tim Kant, James
P. Nix, Cecil Pitman, David Bishop. Bob Lunsford, Zoning
Enforcement Officer and Betty Rivenbark, Secretary
The minutes of the January 4, 1993 meeting were approved as written on
motion by Maxwell Killoch, seconded by William Lucey and unanimously
carried.
The Board considered River Oaks subdivision Unit 1with 38 lots, property
of Dr. Barnes. There were 10 conditions that Bob had noted needed
to be taken care of before preliminary approval given. Bob read this
10 items he had written in commentary(copy.attached with minutes). He
said based on these ten items being taken care of he would recommend
approval. Mr. Sanderson called for any comments from the audience or
board. There were none. William Lucey moved for preliminary approval
subject to Bob's comments being adhered to. Tim Kant seconded and motion
carried unanimously. This is located on west side of Boothe Road between
Twin Beech and Nichols zoned R-2. A total of 171 lots planned for subdivision.
Cambridge Court an application of Barrie -Chapman Dev., Inc. for preliminary
plat approval 17 lots on the west side of Bon Secour north of Forster Avenue
was before the commission again, having discussed at 2 prior meetings.
Bob had listed 8 points as conditions before preliminary could be granted.
( Eight points in commentary attached to minutes) . The audience was invited
to come look at drawings(they did) and Ack Moore, Engineer on project
told how he had designed run-off on project. He said he had 2 42" pipes
that empty off of Bon Secour, that run down cul-de-sac to holding pond and
also overflow weir with 100 sq. ft. of rubble. Tim Kant asked who would be
responsible for holding pond maintenance. Bob said the City would not.
Mr. Barrie came forth and said that something would have to be added in the
restrictive covenants of property owners. All questions answered satisfactorily
David Bishop moved to grant preliminary approval subject to Bob's points
being adhered to. Maxwell Killoch seconded and motion carried unanimously.
Gatewood subdivision, 4 lots on the east side of Bishop Road was discussed.
Preliminary and final approval was being sought. Bob had commented that
an additional 10 foot easement should be provided along the frontage for use
as right of way and utility installation and that had been done. He further
commented that plat is in order and he recommended final approval. Tim Kant
moved to grant this as recommended. Cindy McBrearty seconded and motion
carried unanimously.
Under new business, Bob mentioned that there would be a PUD coming before
the commission at the March meeting development of Stillman Knight.
Bob also had presented a revised set of by-laws to be considered for action
at the March meeting.
Mr. Sanderson mentioned planning workshop February 18, 1993 in Daphne
and encouraged all to attend that could.
There being no further business, meeting was duly adjourned.
R E S O L U T I O N
WHEREAS, the owners of certain properties abutting
the north Corporate Limits of the City of Fairhope,
Alabama have expressed a desire to have their property
annexed to -the City, and;
WHEREAS, the said owners desire to have zoning
established according to the attached map, and;
WHEREAS, on preliminary examination, it appears
that the proposed zoning is generally consistent with
existing land use in the area, is not in conflict with
the comprehensive plan and will, viewed in its entirety,
be beneficial to the City, and;
WHEREAS, the establishment of zoning will be subject
to public hearings and deliberation,
NOW, THEREFORE, be it resolved by the Fairhope
Planning Commission that the concept of zoning for the
subject lands appears sound and that the owners are
encouraged to pursue formal application for establishment
of such zoning subsequent to annexation.
ADOPTED this the 7th Day of December 1992.
