TO: Fairhope Planning Commission
Meeting of: 06 JULY 1992
THE HOMESTEAD OF FAIRHOPE - Application of Partners, Inc.
for Site Plan Review, multi -family and assisted living
facility with integrated restaurant and enclosed
residential facilities. The plan appears to be in
conformity with ordinance requirements. Density does not
exceed 14 units per acre and land coverage is less than
thirty percent of site. The restaurant proposed is
permitted as an integrated part of the complex and
includes a bakery and gift shop as permitted accessory
uses. No other commercial use is proposed. The access
drives within the complex are to be privately maintained.
A blanket easement for the entire site, except building
interiors, will be provided to the City to provide right
of access for utility and emergency services. Please note
that the single family use proposed along the south side
of Edwards Avenue projected is NOT included in this plan
but is subject to further action do determine that it is
an appropriate area for approval of patio garden homes
and, subsequently subdivision plat approval. A copy of
engineer's letter relative to drainage and flood heights
is attached hereto. Developer should be encouraged to
carefully coordinate plan for stormwater runoff with the
Alabama Highway Department for runoff involving state
right-of-way facilities.
Approval of the restaurant/bed-breakfast use must be
simultaneous with approval of two or more residential
structures in order for the restaurant to be qualified
as an integrated part of the complex.
Beauty and barber services serving other than residents
of the complex is a commercial use not permitted under
provisions of R-5.
GLEN HARDY FARMS - Application of Robert Mitchell d/b/a
Greater Gulf States Industries for Informal Sketch Plan
Review for 20 lots in part of Green's Subdivision located
on the south side of Volanta Avenue south of the Municipal
Park. A similar plan was approved some 14 years ago, but
preliminary approval has long since expired. This plan is
contingent upon vacation of parts of Dewey Avenue and
Mobile Avenue and the quit claims of. adjacent owners.
Site is zoned R-1 and will require health department
approval for underground waste disposal. Site slopes
generally southeastward and a small stormwater retention
area is shown south of Lot 3. This plan should not be
considered for future preliminary approval until street

vacations, quit claims and health department review has
been accomplished.
*VICTORIAN HOMESTEAD ESTATES - Application of Partners,
Inc. for Informal Sketch Plan Review for 41 lots at the
northeast corner of U. S. 98 and Alabama Highway 104.
Plan shows access from U.S. 98 by cul-de-sacs of excessive
length. Topography at 104 makes access there
impracticable. However, I would suggest looping of
Victorian Drive to close back on Homestead Lane to avoid
excessive lengths of cul-de-sacs. The closed loop would
allow improved traffic circulation and would facilitate
provision of city services at lesser time and cost.
Site is zoned R-1 and will require underground waste
disposal approval by health department. Provision should
be made for dense screening of lots with double frontages
abutting U.S. 98 and Highway 104.

BAY BREEZE - request of Mary Hobart Key for Informal
Sketch Plan Review, four lots on Buerger Lane at Battles
Wharf - at this writing on 27 June 1992 no drawings have
been received on this request and therefore no
recommendation is provided or contemplated.
MONS ESTATES - Application of Robert Mons III and Anthony
K. Wisely for Preliminary and Final Approval of three lots
near the southwest corner of Riverpark Road and Clay City
Road (County Road 33). Lots abut an existing county road
and are one acre, or more, in area. One lot previously
conveyed by metes and bounds to Wisely is included.
Preliminary and Final Approval is recommended subject to
all endorsements appearing on Plat.
General Commentary_ I request that the Commission call
a public hearing for the August meeting to consider the
following:
Revision of the R3pgh Patio Garden Homes provision of
the Zoning Ordinance as per enclosed draft
Determine that the area Zoned R-3 on the south side
of the easterly extension of Edwards Avenue which was
formerly designated Phase II of the Homestead P.U.D.
is appropriate for special zoning to permit Patio
Garden Homes per revised Section 7.5 of the Zoning
Ordinance, such designation to be concurrent with
adoption of such revision.
I have available for study draft revisions proposed for
the R5th Townhome provision and for the Planned Unit
Development Provisions of the Zoning Ordinance. There is
no urgency for consideration of those revisions, but I

would request that the Commissioners study same for future
deliberation. I will supply copies upon your request.
I also have in my possession the lot layout for the R3p9h
area mentioned above. However, I submit that subdivision
consideration is inappropriate until after consideration
of the zoning considerations required is at least begun.

SUBSEQUENT NOTE:
Planning Commission met at 5:00 p.m. on Friday, July 10,
1992 in continued session from 06 July 1992 and voted
unanimously to advertise for a public hearing on August 3,
1992 to consider revisions to the Planned Unit Provisions
of the Fairhope Zoning Ordinance, to wit: Special Zoning
for Planned Unit Developments.

The Homestead - Site Plan Review. After much discussion there
was a motion made by James Nix that they have a special meeting
to discuss further this project, Buddy Richmond seconded and
motion carried unanimously. Special meeting was set for Tuesday,
July 14, 1992 at 5:00. Richard Sanderson added he would like to
add discussing R3PGH to this meeting, Cecil Pitman made this motion
and Maxwell Killoch seconded, motion carried unanimously.
Informal Sketch Plan Glen Hardy Farms - Robert Mitchell. This is
a 20 lot subdivision in part of Green's Subdivision located on
the south side of Volanta Avenue. Robert Mitchell spoke saying
that he would take care of street vacations for right-of-way
purposes, and anything else that is required of them. James Nix
oved to accept sketch plan, seconded by Jack Lucey and motion
carried unanimously.

Richard Sanderson read from Bob's comments on access to this
subdivision. Bob had mentioned looping the two cul-de-sacs. Ack
Moore spoke saying there would be extreme grade and he would rather.
pursue the same plan and possibly add circles to help with the
traffic circulation. Bob also said that cost should be taken into
consideration. It was suggested that Ack Moore work with Bob and
Tim on this. Cindy McBrearty suggested installing an access lane.
James Nix moved for preliminary approval subject to working out
cul-de-sac situation with Tim and Bob. Tim Kant seconded, motion
carried unanimously.
Preliminary and Final Approval - Mons Estates
Three lots near the southwest corner of Riverpark Road and Clay
City Road. These are 3 1 acre lots which front on a county road.
Jack Lucey made motion for preliminary and final approval, Buddy
Richmond seconded, motion carried unanimously.
There being no further business, meeting was duly adjourned.
