HomeMy WebLinkAbout05-04-1992 Planning Commission MinutesM E M O R A N D U M TO: Fairhope Planning Commission Meeting of 04 MAY 1992 THE COTTAGES - UNIT THREE - Application of Earle and Neimeyer for FINAL APPROVAL of 14 Lots for continued Patio Garden Home Development as per previously approved preliminary plan. Lots abut upon existing Cottage Drive. Final Plat approval is recommended subject to all signatures and acknowledgements appearing thereon. GAYFER MEADOWS - Application of Martin Kearney and Fairhope Single Tax Corporation for re -consideration of FINAL APPROVAL to include further resubdivision of previously approved Lots 4, 5 and 6. This subdivision was granted preliminary and final approval 10 September 1991. Prior to recordation, owners decided to further subdivide. In order not to needlessly confuse the record, it was my recommendation that owners revise plat and submit for reconsideration and, if granted,.record final submittal. I therefore recommend that FINAL APPROVAL be extended to include Lots 1 through 9 as re -submitted, subject to all required signatures and acknowledgements appearing on Plat. I respectfully suggest that the September 1991 minutes be cross-referenced to action of this meeting. SKETCH PLAN REVIEW request of Harry Johnson withdrawn THE HOMESTEAD - Application of The Partners for sketch plan review of a proposed Planned Unit Development on some 18 acres of land of Fred L. Corte east of Corte Park and south of the easterly projection of Edwards Avenue. The north 30 feet of this property is subject to a 30 foot right-of-way reservation for Edwards Avenue extension pursuant to an agreement between the City of Fairhope and Fred L. Corte, et al as recorded in Miscellaneous Records 54 at Pages 1269-1272, Baldwin County, Alabama. In consideration of the referenced right-of-way reservation and resulting double -frontage lots, I would recommend that the east -west drive between Lots 1-25 and the north part of the multi -family be considered as a privately maintained drive, with easement for ingress and egress of emergency and utility services. All private drives within the development must, of course, be constructed to conform to subdivision regulations. Since Lots 1-25 are to be conveyed, a subdivision plat must be approved therefor, with lots abutting the private drive mentioned above and provision for screening future buildings from the double -frontage which will result from future construction of the extension of Edwards Avenue. Developers propose that the central portion of the Administrative/Conference Building be three stories; a height dispensation by the Commission will be required. Respectfully submitted, Robert Lunsford Planning/Zoning Officer MEETING OF 01 JUNE 1992 - NO WRITTEN COMMENTARY THE HOMESTEAD WAS CONTINUED FOR FURTHER STUDY 088-18 This Rev: 10/24/92 10 10/26-29/92 12/1/92 The Planning 8 Zoning Commission of the City of Fairhope met Monday, May 4, - 1992 at the City Administration Building, 161 N. Section Street at 5:00 p.m. Present: Chairman Richard Sanderson; members Tim Kant, Cecil Pitman, Cindy McBrearty, William Richmond, Maxwell Killoch Bob Lunsford, ZEO and Betty Rivenbark, Secretary The minutes of the April 6, 1992 meeting were duly approved on motion by Maxwell Killoch, seconded by William Richmond and unanimously carried. The Cottages, Unit III were considered for final approval. This is an application of Earle and Niemeyer, 14 lots for continued patio garden homes. Preliminary approval had been given some time ago. Bob had recommended approval subject of all signatures and acknowledgements appearing on the final plat. He did question Mr. Earle about whether or not this property was under single ownership. Mr. Earle responded that they held options on the property subject to the board's decision today. Mr. Lunsford said he would also like to add to his recommendation subject to all being in single ownership. Maxwell Killoch moved to approve with Bob's recommenda- tions, Cecil Pitman seconded and motion carried unanimously. Gayfer Meadows was before the commission again(final approval having been given September 1991) for a further subdivision. Before had been approved lots 4, 5, 6 and now requesting lots 1-9. Bob commented that this had not been recorded and he recommended final approval be given to lots 1-9 as re -submitted subject to all signatures being on the plat. A motion was made by Cecil Pitman, seconded by Maxwell Killoch to grant re-subdivisi4 requested subject to Bob's recommendations. Motion carried unanimously. A sketch plan review request of Harry Johnson had been withdrawn at this time. Property located next to John Duck on S. Mobile Street. The Homestead sketch plan review of planned Planned Unit Development on some 18 acres of land of Fred L. Corte east of Corte Park and south of the easterly projection of Edwards Avenue. Mr. Sanderson said he had studied this proposal and several members of the commission had gone to Pensacola this morning to look at facility there. He said he could very safely say that they were all quite enthused about it. The Commission talked at length about the sketch plan presented. Mr. Sanderson said we are going to have to re -zone some portions and make minor amendments to the zoning ordinance . He said it was the first time we have analyzed a PUD using the requirements set out in the zoning ordinance and we need to make some changes to accomodate the proposal. Mr. Sanderson had a list of changes he wishes to recommend but said he has learned that there will be individual lots sold. He read his recommendations: 300 ft. frontage amended, eliminate 6.11A, reduce dwelling unit requirement to 200, delete reference to B-1 local shop- ping district and spell out permitted & prohibited uses, change zoning from R-3 to R-3 PGH and change R-5 to B-2, amend 5.4 conflicts of sub -sections. He said these can be handled and he does not see any reason that they can t proceed. He said the development is projected to start in August and Co proceed. in 3 years. That the City attorney will draw up an agreement between the c ty and developer and there is a saving clause that in the final stage if not com- pleted zoning will revert back to original zoning. Bob read what needed for preliminary submittal. Cindy questioned amending the ordinance for just this PUD, said could we just make an exception on this one. Dick said if we did not amend it would need to go to Board of Adjustment as the commissi n did not have authority to do otherwise. Further discussion was held and Ack asked for clarification, Mr. Sanderson said this was only sketch plan approval and he has permission to proceed. That possibly he, Mr. Lunsford and Mr. Moore could meet and discuss further, see what we need to do. Mr. Pitman said he wished to commend Mr. Sanderson for spending so much time in review of this. Mr. Sanderson thanked him and said that he hoped we had given feeling to developer that we were in favor of the project. Dick mentioned the meeting with the council and the planning commission and that some revisions are in the work on the sign ordinance but not ready yet. There being no further business, meeting was duly adjourned.
