The Planning 8 Zoning Commission met August 5, 1991 at 5:00 p.m. at
the City Administration Building, 161 N. Section St.
Present: William Lucey, James P. Nix, Maxwell Killoch, Cindy McBrearty
Tim Kant, William Richmond., Betty Rivenbark, Secretary and
Bob Lunsford, Zoning Enforcement Officer
The minutes of the July 1, 1991 meeting were duly approved on motion by
Maxwell Killoch seconded by James P. Nix and unanimously carried.
The commission reviewed an application for re -zone from R-A Residential
Agricultural to R-2 Medium Density Single Family Residential submitted
by Diane Martiniere/F. S. T. C. lessee for 2.5 acres of her leased property
located on the west side of County Road 27 about 3/8 of a mile south of
Windmill Road. Mr. Lucey asked for Mr. Lunsford's comments regarding
this. Mr. Lunsford said that the land was classified R-A when it was
annexed into the city some two years ago. That their application was
only for 1 /2 acre but he was recommending that the application be accepted
and advertised for public hearing at the September meeting subject to
the entire leasehold being re -zoned and -when published that the map and
legal description published reflect this. Mr. Killoch asked if there was
an application for subdivision and Mr. Lunsford said no. James P. Nix
moved to accept this for public hearing at the September meeting, William
Richmond seconded and motion carried unanimously.
Consideration was given to an application of Medical Park II/Fairhope
Medical Joint Venture request for 2 lot subdivision located on the west side 1
South Ingleside Street 300 ft. south of Morphy Avenue and west of Thomas
Hospital. This has in the past been developed by the Fairhope Medical Boar
East and all easements and improvements for ingress and egress have been
established. Bob had recommended preliminary and final approval provided
all required signatures appear on the plat. Tim Kant moved to approve
subject to signatures being obtained, Cindy McBrearty seconded and motion
carried unanimously.
A resubdivision of Volanta Woods lots 1-8 into a 6 lot subdivision, property
of Paul and Pierce Frederick on land abutting the north side of Grand Avenue
with Lot 1 abutting both Bon Secour and Grand was considered. Bob had
commented that the north 1 /3 of the lots generally falls within a flood hazard
zone; however, because of the depth of the lots this should not be a problem
in the positioning a building of reasonable proportions. But, due to new FEM
laws these lots will require flood certifications by a registered engineer or
land surveyor even though the building itself may be outside the flood zone.
The zoning is R-2 and on lot 6 with a 38' frontage the building setback line
needs to be located not less than 155 ft north of and parallel to Grand Aven
He recommended preliminary and final approval subject to the following:
completion of notary's acknowledgement on plat; and a note on the plat
clearly indicating the relationship of the proposed subdivision to the record
plat of Volanta, for ease of reference. James P. Nix moved to approve
preliminary and final subject to Bob's recommendations, William Richmond
seconded and motion carried unanimously.
Battles Wharf Estates, application of Bill and Janice Pulliam i for preliminary
and final approval of nine lot subdivision located on the west side of Hwy 98
south of County Rd 44 at Battles Wharf was considered. This is a private
subdivision with private access maintained by owners. Bob said this had
come up a couple of months ago and there was some question on the road
Woodworth Drive. However, he has talked to Sam Irby and that a summary
judment action out of the Circuit Court in Baldwin County rendered public
interest in Woodworth Dr. null and void. He pointed out that such streets
even though private, should be installed in conformity with requirements of
the design standards of the regulations. There followed a discussion on
access of emergency vehicles to the lots below the turnaround suggested.
Tim pointed out that although there are many private drives we need to
start somewhere requiring that the accesses be large enough that emergency
vehicles can come in and turnaround and get out. Mr. Lucey told him the
Commission was open to suggestions. Further discussion led to a motion bein,
made to approve subdivision as requested subject to them providing adequate
space for emergency vehicles to turn around and Bob's recommendations that

all signatures be on the plat and that the street and utilities be fully
installed and finally inspected and accepted by the City or a financial bond
posted in the amount of the estimated cost of such improvements and in favor
of the city being filed with the City Council. Motion was made by William
Richmond, seconded by Maxwell Killoch and unanimously carried.
Preliminary approval was recommended for Pecan Trace a 27 lot subdivision
of FSTC and lessee Klumpp/Boone located on the southeast corner of Morphy
Avenue and Thompson Hall Road with R-2 zoning. This is a plat of land
containing some 16.5 acres. Bob had recommended approval subject -to
all required endorsements being on the plat and a pre -construction conference
among the developer, the zoning officer, the city superintendent, and the
engineer performing design and supervision being held before starting con-
struction , removal of the County Engineer's endorsement from the plat
since the subject land lies wholly within the city limits and city's jurisdiction
is exclusive. Also, with the note that final acceptance of streets and
utilities for maintenance will require submission of as -built plans certified
by an Ala. Registered Engineer and satisfactory test results as required
by Chapter 19 of the City Code of Ordinances. Maxwell Killoch moved
for approval subject to all listed above, James P. Nix, seconded and motion
carried unanimously.
A sketch plan was presented by Ack Moore to the commission on Erling Riis
subdivision property located just north of Point Clear Yacht Club. Mr. Moore
said Mr. Riis has 5 children and he wished to subdivide his property into
private lots for each with a private street and turn around. This is located
outside the city limits, there is no zoning. The sewage disposal was question-
ed. Mr. Riis is on the sewer line already there. Cindy remarked that some
of these were small lots especially for Point Clear. Ack Moore pointed out
that there is no zoning, no regulations against lot size. The lot sizes were
75' X 100' with minimum width of 65'. Bob read - our regulations regard-
ing subdivisions and they fall within requirements. Bob said he had not had
time to review this, that he recommends we tell them to proceed and come bac
next meeting with preliminary plans, in the meantime he will review and if
he sees any problems he will let them know. All agreed this was best way
to proceed.
The September meeting was rescheduled for September 10, 1991 at 5:00 p.m.
due to normal meeting date being on Labor Day.
