HomeMy WebLinkAbout04-01-1991 Planning Commission MinutesThe Planning & Zoning Commission of the City of Fairhope met April 1, 1991 at 5:00 p.m. at the City Administration Building, 161 N. Section Street Present: Chairman Richard Sanderson, members William Lucey, Tim Kant, Cindy McBrearty, Cecil Pitman, James P. Nix, William Richmond, Maxwell Killoch. Robert Lunsford, Zoning Enforcement Officer and Betty Rivenbark, secretary were also present. The minutes of the March 4th and March 18th special meeting were approved as written on motion by William C. Lucey, seconded by James P. Nix. A public hearing was held on the property of Sandra Levin located on the north side of Morphy and west side of Bishop Road, a 3 acre tract that she is requesting to change from R-A Rural Agriculture to R-3 High Density Single Family Residential in order to build her mother a house on a small portion. Bob was making the recommendation that all be changed to R-3 because if a portion is taken from this property it would make a non- conformity for R-A, which we didn't wish to do. Mr. Sanderson called for comments from the Commission members or anyone in the audience. There were none. William Lucey moved to recommend approval of zone change to City Council, Cindy McBrearty seconded and motion carried unanimously. A public hearing on R-5 zoning concurrent with annexation was held for the Ingersoll property, some 3.87 acres on the East side of Greeno Rd. located between Spring Run and Autumn Drive. Mr. Lunsford told the commission members that Mr. Ingersoll wished to build multi -family residences, some 33 units. Mr. Ingersoll related that these apartments would be restrictec to elderly and handicapped, that Walcott 8 Associates is doing the work on the plans and is working with Mr. Lunsford. That this property adjoins Mercy Medical on the east and they are trying to keep with what is already there. After all comments received, Cecil Pitman said that it seems like something that is needed and he recommended approval to the City Council of this zoning as requested, Maxwell Killoch seconded and motion carried unanimously. A discussion was held on proposed revision of boundaries that the city wishes to exercise for subdivisions. Bob had reported at the last meeting that he had received a request from John Dorgan of the County office asking us to redefine our boundaries for him, and it was his understanding that all the cities were being asked to do this in the county. Bob had presented a map showing where the boundaries are now and proposed new boundaries. Legal description being: BEGINNING at a point where the eastern margin of Mobile Bay is intersected by an east -west line drawn midway between the Corporate Limits of the City of _Fairhope and the City of, Daphne; run thence East along said midline to a point on the range line dividing Ranges t and 3 East; thence run South along the range line to the southeast corner of Section 1, T6S, 'R2E Baldwin County, Alabama which is on the centerline of said highway 1.3 miles, more or less, to an intersection with the west margin of the --west fork of Fish River thence run southerly along the west margin of Fish River to the mouth of Weeks Bay; thence run southwesterly along the western shore of Weeks Bay to an intersection with the eastern shore of Mobile Bay; thence northerly along the eastern shore of Mobile Bay to the point of BEGINNING. (map attached). James P. Nix moved to seek concurrence of the county to adopt as proposed. William Richmond seconded and motion carried unanimously. Bob had worked up an ordinance amending Section 1. of the zoning ordinance by adding section 7.878 pertaining to banners as a result of questions raised at March 4th meeting. Discussion was held and unanimously decided that the length of a permitted banner shall not exceed 3/4 the length of the building with a maximum length of 30 ft with the vertical height not exceeding 20 percer of its horizontal length. James P. Nix moved to recommend advertising with the suggested change, Cecil Pitman seconded and motion carried unanimously.
