November 6, 1989 at 5:00 p.m. at the City Administration Building,
161 N . Section Street
Present: Richard Sanderson, Chairman; members James P. Nix,
Tim Kant, Cindy McBrearty, Maxwell Killoch, Roy White, William Richmond
Betty Rivenbark, Secretary and Bob Lunsford, Zoning Enforcement Officer
The minutes of the August 7, 1989 meeting and October 2, 1989 meeting
were approved as written on motion by Maxwell Killoch, seconded by
William Richmond, and unanimously carried.
At this time Mr. Sanderson said he would like to have Bob tell the
Commission and audience the recommendation of the committee on the
annexation of the F.S.T.C. property into the City. Bob commented
that the FSTC had peti !tinned the City for annexation of about some
814 acres. He further explained that a committee from the FSTC and
Planning Commission had met and come up with the recommendations
today, which included Single Family, Multi -family, patio garden,
Mobile home park, business professional, general business and residen-
tial agricultural. He showed some color coded maps with the different
zones highlighted. At this time Mr. Sanderson asked for questions
from the audience and invited people to come look at the maps. George
Klumpp came forward and said that he is zoned agricultural and that
he wishes to make a residential subdivision. A discussioh'followed on
trying to make changes now or wait. It was explained that due to the
1990 census we were working with limited time frame and we needed
to expedite annexation. At this time Lorena Gregorius came forward
with a problem she is experiencing in her area and was questioning
whether if this is annexed in as R6 as proposed would the City then
require property owner/lessee to conform to City regulations. Three
other people spoke about same trailer park citing problems with septic
tanks and drainage. Mr. Sanderson pointed out that these problems
should be directed to the Baldwin County Health Department that we
were not the body to address on this. It was pointed out that even if
it is accepted by the City it will come in as non -conforming existing use.
Ms. Gregorius asked if they could expect some relief from the City.
Mayor Nix responded that after they come into the city they would have
an avenue to pursue in correcting the problems. At this time Dale
Crittenden, the lessee of this property, came forward and said he was
taking exception to the problems cited. He told of the things he had 'done
and that he had done according to health department and county rules
and regulations. Mr. Sanderson requested some harmony among the two
opposing groups. Mr. Crittenden said he would be glad to meet with
these people any place any time. Ms. Gregorius said she would be in
touch with him. Mayor Nix explained that this has already been advertised
and that he thinks we should go ahead approve the zoning requested
by the FSTC and the Planning & Zoning Commission initiate the re -zoning
request in Mr. Klumpp's case. At this time Claude Arnold spoke saying
that the FSTC had promised them that they could choose the zoning they
desired and they did not do that in their case. Dian Arnold came forward
and explained that they wanted R-6 in order to have a place for their
children to have homes if needed in the future. That she is also requesting
this zone change. After Mrs. Arnold's request, Mr. Sanderson said he
would entertain a motion to approve the zoning as requested by the FSTC.
Mr. Killoch asked how many problems are we accepting? Mr. Nix replied
that we would just have to deal with each one as they came up. Mr.
Killoch moved to accept the zoning as requested by the FSTC and recommend
approval of same to the City Council. Tim Kant seconded and motion carried
unanimously. Mr. Lunsford was requested to proceed with the zoning
change request by made by Mr. Klumpp from RA to R-2.

Carlton Niemeyer came before the Commission to discuss a 6 lot private
subdivision he wishes to develop with a private road next to Wild Oaks
off of Hwy 98. Mr. Lunsford said the lots were somewhat deficient in
area. Carlton remarked that they were zoned R-2 by the County and
that this was a minimum lot of 20,000 ft. It was suggested changing some
of the lots to get better footage. Mr. Niemeyer said there is already
a 24' line already there that was put in when Sibley square was built.
Roy White questioned if there had been any easements vacated. No one
could remember any. There is already a drainage line on the North
property line with 3 entrys. Further discussion about the size of
the lots led to Mr. Sanderson asking if anyone wished to make a motion
to waive the 25,000 sq ft requirement and accept the 20,000 sq ft lot
requirement and frontage requirement of the County. No motion was
forthcoming. The Mayor asked about flip-flopping the road, Mr. Niemeyer
said he wanted to do that but looking at it, it was not feasible. With
this guidance Mr. Niemeyer said he understood what the Commision was
saying and could proceed.
At this time Dian Arnold came forward again and asked that the Commission
initiate a zoning change for her land and waive the expenses that would
ordinarily be incurred. Leslie Stejskal spoke saying the FSTC did not
object to this zone change if this is what they want. William Richmond
moved to ask the City to initiate the zoning change from RA to R6.
Maxwell Killoch seconded and motion carried unanimously.
Mr. Lunsford brought to the Commission at this time a request from
Bedsole Properties that had been first acted on in August of 1988 regarding
Greeno Park, where lot 7 was approved a division into 7, 8, and 9.
Preliminary approval was given for this request. Now they are requesting
final approval subject to bond being posted for improvements and Council appi
of bond. Motion was made by J P Nix to give final approval subject
to bond being posted. Maxwell Killoch seconded and motion
carried unanimously.
There being no further business, meeting was duly adjourned.
