1989 at 5:00 p.m. at the City Administration Building, 161 N. Section Street
Fairhope, Alabama
Present: Chairman Richard Sanderson; members Maxwell Killoch,
Cecil Pitman, James Nix, Tim Kant, Cindy McBrearty, William Lucey,
William Richmond and David Bishop. Bob Lunsford, Zoning Official
was present and Betty Rivenbark served as Secretary
The minutes of the December 5th meeting were considered and were
approved with amendments (amendments noted on minutes) by unanimous
vote of Commission.
The Commission accepted for public hearing at the next meeting a
request for R-2 Medium Density Single Family Residential zoning
for James Smith property located adjacent to municipal golf course
and pending for annexation. Motion made by James P. Nix, seconded
by Cindy McBrearty and unanimously carried.
A public hearing was held on an -imendment to the Zoning Ordinance
Article V, Section 5.42 - 5421 Uses Permitted and 5.422 Uses Permitted
on Appeal. Cecil Pitman moved to recommend approval to City Council
as presented, Maxwell Killoch seconded and motion carried unanimously.
A motion was made by Cecil Pitman, seconded by William Lucey to accept
for public hearing an amendment to the Zoning Ordinance under Article VII
General Provision, Section 7.6154 and add Section 7.6155. Motion
carried unanimously.
The Board asked for Bob's comments on an application for subdivision
on Fields S/D made by Gavin Hunter and FSTC. Bob related that this
is actually a resubdivision and that recommended preliminary and final
approval for the 4 lots in an R.2 district subject to the following:
1. Delete reference to First Addition and designate subdivision name
as a resubdivision of Part of Lot I of Fields Subdivision as recorded in
Slide 1138-A, Baldwin County Probate Records.
2. Clearly designate remainder of Lot I and all Lot 2 of the original
Fields subdivision. Identify on plat the newly created lots in
serial or literal order so as to be readily distinguished from the
existing lots 1 and 2.
3. Provide a 10 foot easement along the fronts of the proposed lots
for street right of way with drainage and utilities.
4. Provide necessary financial guaranty for installation of improvements
5. Provide following note on plat: Building setbacks shall be
determined at time of issuance of building permit as per then prevailing
requirements of the Fairhope Zoning Ordinance.
Seth Moore was present representing Mr. Hunter. He saw no problems
with what is being asked. Cindy McBrearty moved to approve subject
to Bob's recommendations. James P. Nix seconded and motion carried
unanimously.
Under old business, Mr. Sanderson asked that in approving the experimental
subdivision last month that records be kept on any problems that may arise
for future reference of same.
Bob asked the Commission to consider at the next meeting advertising for
public hearing on an amendment to zoning ordinance in Section 8.6
procedure for requesting a zoning amendment. William Lucey moved to
do this, seconded by Cindy McBrearty and unanimously carried.
There being no further business to come before the Commission it was
duly adjourned.
