HomeMy WebLinkAbout09-14-1988 Regular MeetingThe Planning 8 Zoning Commission of the City of Fairhope met September 14, 1988 at 5:00 p.m. at the City Municipal Complex. Present: Chairman Dick Sanderson; members Tim Kant, Mike Ford, Cindy McBrearty, William Richmond, Cecil Pitman, James P. Nix. Zoning Officer, Bob Lunsford and Secretary Betty Rivenbark The minutes of the August 1, 1988 meeting were duly approved on motion by James P. Nix, seconded by Tim Kant. The Board accepted for public hearing at the next meeting, October 3, 1988, a request for zoning of R-2 Single Family Medium Density for the property of Gavin Hunter concurrent w/annexation. The property being located at the Southeast corner of Fairhope Avenue and Troyer Road. Tim Kant moved to accept, William Richmond seconded and motion carried unanimously. Bob explained to the Commission the request to rearrange Lot 7 and 8 in Greeno Park into lots 7, 8 & 9 and requesting a waiver of alley and allow utility easement to serve on lots 1-6. Richey Irvine spoke saying that the alleyway served no general purpose, that the sewer line runs along the rear of property and they are requesting waiver of alley. Mr. Sanderson said the Planning & Zoning Commission did have the authority to grant a variance. Cecil Pitman moved to recommend granting Mr. Irvine's request, Richard Sanderson seconded. Mr. Nix said he was not opposed to what requested, he is questioning the validity of the requirement of the alley. He would like it looked into to determine if we need it, if not get rid of it. Mr. Sanderson asked Bob to prepare the appropriate change for action at the next meeting. Motion was approved unanimously. Bob presented to the Commission a request for preliminary approval of Quail Creek Estates. There are 314 lots involved in the total plan, 70 in Unit I, he said there were two adjustments that needed to be made that have been made and that he recommended approval for Unit 1 and tentative approval to the master plan with the stipulation that each phase come back as proposed. The question was asked about the annexation bill, Mr. Sanderson said he understood it had passed and was waiting for the governor's signature. Ack spoke to the Commission and showed a master map to the public present. A resident asked about where Cowpen Creek ran, that he had a drainage problem. It was determined that he is above area being discussed. Another resident said he did not like R-5 designation next to his property what could he do. He was told to appear at zoning meeting which is scheduled for October 3, meeting. Cindy asked about restrictive covenants and told that they do have them and they will have an architectural review board also. They were asked to provide a copy of the restrictive covenants to the Planning Commission members. The cost of the lots was discussed and zoning. They stated that they would like to start as soon as they go through the normal process of zoning. James P. Nix moved for preliminary approval of Unit I, Cecil Pitman seconded and motion carried unanimously. Under old business Cindy mentioned that she would like to get back working with Dick Sanderson, Gibby Killoch and Bob on the sign ordinance. Under new business, the Commission recognized Curtis Gordon who was seeking guidance on a concept he had for the L' Orange property located on Magnolia Ave. That it is zoned B-3b and that he had already gotten approval of 9 residential units in this spot but now he wished to have the Commission consider the concept of PUD with 6 patio garden homes, keeping in tune with Fairhope and the architecture of the area. Bob said he was familiar with this to a point, that they were suggesting individual lot arrangement w/private street. That he needed to get adequate details. Mr. Gordon was told that the Commission liked the concept that it would be a good area for patio garden homes. The earlier drainage problem was discussed and it was thought that this could be handled without any problems. Mr. Sanderson told Mr. Gordon he had his direction. Mr. Gordon thanked the Commision for their guidance. There being no further business, meeting was duly adjourned.
