HomeMy WebLinkAbout06-06-1988 Regular MeetingThe Planning 8 Zoning Commission of the City of Fairhope met Monday, June 6, 1988 at the City Administration Building, 161 N. Section Street, Fairhope, Alabama at 5:00 p.m. Present: Chairman Richard Sanderson; members Maxwell Killoch, Cecil Pitman, Cindy McBrearty, William Lucey, Mike Ford, Tim Kant, James P. Nix, William Richmond The minutes of the May 2, 1988 meeting were duly approved as written on motion by Maxwell Killoch; : seconded by Tim Kant and unanimously carried. The Commission considered at this time a 3 lot subdivision for preliminary and final approval - Bay Echo, owners Jessie Davis and Ethel Winberg This had been discussed before on July 6, 1987 and March 7, 1988. Mr. Lunsford addressed the Commission stating that the plat meets all the requirements of the subdivision regulations, but he notes that it be clearly indicated that the City shall take no action to open, improve or maintain rights -of -way dedicated to the City except by resolution of the City Council. ( note minutes of 7/6/87 where dedication of road discussed). Cecil Pitman moved to approve preliminary and final 3 lot subdivision as requested based on Mr. Lunsford's recommendation. Mr. Sanderson asked if there were any comments from the audience. Peggy Dyson pointed out there was a question of where the property line is. Mrs Davis remarked they are fully aware of this question and it is about 2 ft among thembselves, they have settled it. Dr. Gravelee was also present. He is interested in obtaining a piece of property to build on. He said he has no objection to vyhat they wish to do. Tim Kant seconded the motion and it carried unanimously. At this time Carlton Niemeyer and Lorena Gregorius asked to speak to the Commission. He said he had a sketch plan he wished to present, that he had just found out that the City still has 5 mile jurisdiction outside the City Limits. Bob had not looked at what Mr. Niemeyer wished to bring before the Commission. Ms. Gregorius said she had discussed her 8 lot subdivision outside the city limits with Bob. It was suggested that Bob look at both subdivisions and bring up for preliminary and final approval at the next meeting. This was agreeable to both parties. DRAWER 429 FAIRHOPE, ALABAMA 36533 (205) 928.2136 May 3, 1988 Honorable Noel Fischer, Chairman Baldwin County Planning & Zoning Commission Dear Mr. Fischer: The Fairhope Planning and Zoning Commission vigorously supports the concept of district zoning in Baldwin County. We have studied the text of the ordinance and the district maps. COUNCILMEMBERS: DAVID E. BISHOP MICHAEL A. FORD JEANETTE PUCKETT BARNEY L. SHULL ROY C. WHITE In consideration of the actual uses that are already establish- ed in that area it seems obvious that the four corners of U.S. 98 and Parker Road should be zoned business for an appropriate distance in all directions. South of that intersection to the Fairhope City Limits, however, there are no established businesses. It is open timber and farmland. Fortunately, the proposed or- dinance deals with that kind of situation. It provides an R-A zoning classification which, by its wording, is actually interim zoning: R-A, Rural Residential and Agricultural District. This district provides for large, open, unsubdivided land that is vacant or is being used for agricultural, forest or other rural purposes. District regulations are designed to protect the essentially open character of the district until it is timely to reclassify the land to appropriate residential, commercial or industrial categories. Parcels must be five(5) acres or more to be eligible for rezoning to other uses deemed to be consistent with the intent of this Ordinance. In addition, on U.S. 98, parcels must have a minimum of three hundred(300) feet frontage with adequate depth to accom- odate a service road in addition to the buffer and landscape re- quirements. Approximately one third of the total area of Zoning District 9 is proposed for that classification. We believe that to be a wise decision since it keeps all options open for both the property owners and the Planning Commission. THE CITY OWNS ITS WATER WORKS. ELECTRIC DISTRIBUTION SYSTEM, GAS SYSTEM AND SEWERAGE SYSTEM Noel Fischer - Page two May 2, 1988 In view of the above we believe it would help the City of Fairhope maintain the integrity of its master plan with- out harm to the property owners if at some point South of Parker Road, to be determined by your commission, land on both sides of U.S. 98 be zoned R-A to the Fairhope City Limits.
