HomeMy WebLinkAbout03-07-1988 Regular MeetingThe Planning & Zoning Commission of the City of Fairhope met March 7, 1988 at 5:00 p.m. at the City Administration Building, 161 N. Section St. Fairhope, Al. Present: William Lucey, Vice -Chairman; members James P. Nix, Tim Kant, Mike Ford, Cindy McBrearty, Maxwell Killoch, William Richmond The minutes of the January meeting were duly approved as written on motion by Maxwell Killoch, seconded by Cindy McBrearty. The commission considered a request for a correction plat for Volanta Pines subdivision. Seth Moore was present representing the owners. His request involved 2 drainage easements that were filed with the original plat that are not required for public use. Discussion was held on the reasons for placing them there in the first place. Seth said that the water runs that way on Bon Secour and it was suppose to be a vehicle to take water away on Quail Loop if needed. Seth reported that the developer wished to do away with it at this time. Bob said he had looked at it and his recommendation would be to allow the correction plat as requested. James P. Nix moved that this be allowed, Tim Kant seconded and motion passed unanimously. Jim Horner came before the Commission with a sketch plan concerning a re -division of Lots 12, 13, part of 14 on Block 1, Volanta subdivision. Bob reported that these were non -conforming lots of record and that he would like to combine these lots into 2 lots thereby hefeels he would be exempt under the subdivision regulations section 601.6 provided no new lots are created. That he would like to be allowed to use 50 ft. in lot 14 as driveway only and would adhere to setback requirements. James Nix moved this would be an exception under the subdivision regulations 601.6 and be allowed as requested, Cindy McBrearty seconded and motion carried unanimously. Mike Arnold came before the Commission with a sketch plan seeking guidance on the Winberg/Davis property that we reviewed in July of last year. He identified the property saying it is behind the Parker House Restaurant 1200 ft. long and 106 ft. wide. I n the last twenty years they have been surrounded by smaller lots that there are two existing lots there now and they wish to divide property into four more but they do not have the money to install the improvements required ( curb and gutter, paved road) . Discussion was held on the right-of-ways there now that could be converted to road to get to new lots. Mr. Troup was present(the nearest neighbor) and he was asked if he really wished to pave this road ... he answered no. Questions were raised about the possibility of creating a drainage/run-off problem if these are divided and Mr. Troup felt it would run to his lot, and accepts that it will run this way. Bob said that paving could be waived until 51% of the residents in this area wanted to be in an assessment program. Mr. Richmond asked who would be responsible for the gravel road once it was installed. Ms. Davis and Winberg said they would dedicate the right of way to the City and maintain the private road. Bob pointed out that even though it may be dedicated, we have no responsibility to take care of it until the City Council accepts the maintenance. Further discussion led to Commission conveying that they saw no problem with what proposed bring back plat with a formal proposal. Ack Moore asked the Commission to look at a sketch plan review for the proposed subdivision surrounding Quail Creek golf course. He had drawn 367 lots and it would be done in phases. That they planned to install paving, curb & gutter as required by subdivision regulations. That they were going to request R-2 zoning but many were R-1 size. Mr. Nix remarked that the bill to annex the golf course is in the legisla- ture now and that the subdivision would be contiguous and they could request annexation when this bill. passes. Mr. Moore said the first phase would consist of 78 lots. The Commission saw nothing wrong with sketch plan. Matt Dial said there is an existing agreement that if we need to install drainage on their property we will install it and if they need to install drainage on our property they will install it under- ground. (here being no further business, meeting was duly adjourned.
