Complex, 161 N. Section Street, Fairhope, Alabama at 5:00 p.m.
Present: Chairman Richard Sanderson, members William Lucey, Cindy
McBrearty, Tim Kant, James P. Nix, Cecil Pitman, Maxwell
Killoch, David Ed Bishop and William Richmond.
The minutes of the December 7th meeting were approved as written on
motion by Maxwell Killoch, seconded by Wm. Lucey and unanimously
carried.
A public hearing was held on a re -zone request from M-1 Light Industrial
District to R-2 Medium Density Single Family Residential for the property
located on Pecan Street east of Section Street containing some 4 acres.
Application made jointly by the Fairhope Single Tax Corp and
with the Marietta Johnson School of Organic Education. Mr. Sanderson
asked Bob Lunsford to brief the Commission on this request. Mr. Lunsford
went over the history leading up to this rezone request, mentioning that
the Organic School wished to build a private school on this property.
He mentioned that there were two questions to consider before decision
made 1) Is the proposed zoning change in conformity with the
Comprehensive Plan of the City? and 2) Is the proposed zoning change in
the best interests of the citizens, considering the City as a whole? He
further mentioned that the Board of Adjustments passed it on to the
zoning commission for re -zoning as they were not comfortable that this
was clearly a permitted use. Mr. Dyson addressed the Commission saying
that the Organic School Board did give up the property to Faulkner
as they felt it was in the best interest of the City to do this. That they
have always tried to cooperate with the City and wished the Commission to
consider this fact. Linda Gibson, President of the Organic School Board
spoke saying that the Organic School is alive and well, that they would like
to keep the school as close to the heart of the City as they could and
they don't see the school being a problem in this area, if anything it would
enhance the neighborhood. Mr. Littleton, a property owner within 300 ft
of this property, addressed the Commission saying he had no problem
with it being changed back, Mr. Sanderson asked him if he would consider
changing his property to R-2. He remarked that as long as he is alive
it will remain as it is, that he would do what is in the best inerest of
the City but he would leave it to the Commission's discretion, probably
would not request it on his own although he recognizes the importance
of compatability in zoning. There being no further comments from the
Commission or the audience, Mr. Lucey moved to recommend approval
of thie re -zone request to the City Council, Tim Kant seconded and motion
carried with all voting for re -zone except for Buddy Richmond abstaining.
There being no further business, meeting was duly adjourned.
